The top court refused this week to hear from Nxivm, which hired the Washington law firm Sidley, Austin, Brown & Wood to have allegations that the company is a cult struck from the Web site of cult researcher Rick Ross.

At the time this case was filed, the presiding judge, Thomas J. McAvoy,
denied NXIVM/ESP's request for the issuance of a Temporary Restraining
Order against Ross and The Ross Institute on procedural grounds.
Thereafter, Judge McAvoy also denied NXIVM/ESP's request for the
issuance of a Preliminary Injunction against Ross and The Ross Institute on
substantive grounds.
NXIVM/ESP appealed the denial of the Preliminary Injunction to the U.S.
Court of Appeals for the Second Circuit - and lost that appeal ( Note:

appeal ). Thereafter, NXIVM/ESP appealed the Second Circuit's decision to
the United States Supreme Court which denied certiorari ( Note:
