Israeli settlements illegal – top UN court

West Jerusalem is carrying out a “de-facto annexation” of the West Bank, the International Court of Justice has ruled

The court’s 15 justices agreed on Friday that “the transfer by Israel of settlers to the West Bank and Jerusalem as well as Israel’s maintenance of their presence, is contrary to article 49 of the fourth Geneva Convention”.

Reading out the non-binding advisory opinion, ICJ President Nawaf Salam described Israel’s building of settlements in the West Bank as a “de-facto annexation” of the territory, and stated that the Jewish state should end its “unlawful” presence in occupied Palestinian territory as “rapidly as possible.”

The ICJ has been investigating Israel’s “policies and practices” toward the occupied Palestinian territories since early 2023, at the request of the UN General Assembly. At a series of hearings in February, the Palestinian Authority’s foreign minister, Riad Malki, accused Israel of apartheid and called on the court to declare the occupation of Palestinian land illegal. Israel did not send legal representatives to the hearings.

While Friday’s ruling will inform the UN’s stance on Israeli settlements, the ICJ lacks any means of enforcing the decision.

“The Jewish people are not occupiers in their own land — not in our eternal capital Jerusalem, not in the land of our ancestors in Judea and Samaria,” Netanyahu said in a statement shortly after the verdict was read out. “No false decision in The Hague will distort this historical truth, just as the legality of Israeli settlement in all the territories of our homeland cannot be contested,” he added.

Netanyahu’s hardline coalition partners have called for an even harsher response. Speaking to reporters last week, Finance Minister Bezalel Smotrich said that Netanyahu should formally annex the entire West Bank and East Jerusalem if the court were to rule against Israel. Smotrich also promised to step up the construction of settlements to “thwart the establishment of a Palestinian state.

Israel seized the West Bank, Gaza, and East Jerusalem during the 1967 Six-Day War. The West Bank is split into three areas, with less than a fifth of its territory under full control of the Palestinian Authority. Just over a fifth is under Israeli security control and Palestinian administrative control, while the remainder – comprising around 60% of the territory – is under full Israeli control.

It is in this latter area – designated ‘Area C’ under the 2000 Oslo Accords – where Israel has built most of its settlements. Under the agreements, Israel was never meant to maintain permanent control over this area. However, the Israeli government has signed off on the construction of nearly 150 settlements there since the early 2000s, and more than 450,000 settlers now live in the West Bank, according to data from Israeli anti-settlement activists.

Volodymyr Zelensky: ‘Trump Doesn’t Really Know What’s Going on in Ukraine’

The BBC reports that Zelensky met with UK Prime Minister Keir Starmer earlier. Starmer has pledged to support Ukraine “for as long as it takes” and has committed to spending £3 billion on aid for the country.

Netanyahu Blocks Order To Build Field Hospital for Gaza Children

Tens of thousands of children have been wounded in Gaza and newborn babies are dying because they cannot get proper nutrients

Israeli Defense Minister Yoav Gallant announced Wednesday that the Israeli military was setting up a field hospital inside Israel to treat Palestinian children from Gaza, but Prime Minister Benjamin Netanyahu has vetoed the plan.

Netanyahu’s office said that it informed Gallant in writing that the prime minister does approve establishing a “temporary hospital” for Gaza’s children, and therefore, it would “not be established.”

An official in the Israeli Defense Ministry told The Times of Israel that Netanyahu blocked the hospital for “political reasons.”

Netanyahu could come under criticism from extremist members of his coalition government for enabling the treatment of Palestinian children, which includes not only kids wounded by Israeli airstrikes but also newborn babies who are dying due to a lack of nutrition since their malnourished mothers cannot breastfeed.

Some children have been evacuated into Egypt for medical care, but since Israel captured the Rafah border crossing on May 7, that vital lifeline has been cut off.

According to Gaza’s Health Ministry, nearly 16,000 children have been killed by the Israeli assault on Gaza, and about 38,000 have been wounded, which includes many amputees. Due to the Israeli siege, children’s limbs have been amputated without anesthetics.

Foreign doctors and health workers who volunteered at Gaza hospitals have recalled horrific scenes. Nick Maynard, a British surgeon who worked at Gaza’s al-Aqsa Hospital, recalled a story about a young girl who was left to die on the hospital floor.

“One child that I’ll never forget had burned so bad you could see her facial bones,” Maynard said. “We knew there was no chance of her surviving that, but there was no morphine to give her. So, not only was she inevitably going to die, but she would die in agony. And what made it even worse was that there was nowhere for her to go and die, so she was just left on the floor of the emergency department to die.”

The crew of 8 people were also arrested during that initial interception. Simultaneously, a total of 47 house searches were carried out in Bulgaria, Colombia, Norway, Panama, Portugal, Spain and Trinidad and Tobago. Subsequent weeks saw three other individuals detained, bringing the total number of arrests to 50.

Europol has supported this investigation since August 2023. On 20 December 2023, authorities intercepted a sailboat in international waters off the coast of Martinique with 1 500 kilos of cocaine on board. Eight individuals, including the crew members and some involved through other means, were arrested that same day. Following this operation, in the framework of intelligence activities underway with its operational counterparts, Europol has been able to develop actionable intelligence regarding the drug trafficking activities of this organised crime group. This led to further investigations and operational activities involving 10 countries.

The suspects were arrested as part of an international operation against drug trafficking led by the Spanish National Police (Policía Nacional). The Spanish authorities worked closely with the Norwegian Police, the United Kingdom’s National Crime Agency (NCA) and the United States Drug Enforcement Administration (US DEA) in the framework of an Operational Taskforce set up at Europol. Footage released on social media appears to show an Israeli strike targetting a donkey cart pulling civilians in Rafah in southern Gaza, sparking outrage online.

The footage shows an aerial view of the attack that strikes the passengers but appears to leave the donkey unharmed.

"And after at least half an hour of surveillance, understanding that these were not innocent civilians, they were eliminated - the donkey naturally remained alive," an Israeli voice can be heard saying over the footage.

Middle East Eye cannot independently verify the footage.

Palestinians in Gaza have been using donkey carts to move around or to transport the dead and wounded in the absence of fuel and lack of ambulances.

Israeli attacks across the Gaza Strip in recent days have killed dozens of Palestinians, including 17 people who were killed in a strike near a tented area housing displaced people in the designated "safe" area of al-Mawasi in Khan Younis on Tuesday.

The attack on al-Mawasi comes after air strikes killed at least 88 people and wounded 289 others last week in a displaced people's camp in the same district.

The United Nations said on Tuesday that the past week has been one of the deadliest in the Gaza Strip since the start of the war on 7 October.

Joe has also said the he has done more for the Palestinians than anyone, which means that he finds some benefit in watching them die under relentless bombardment by Israel with US provided munitions.

This ability to twist perceptions of what is going on in the Middle East and also at home based on a grossly exaggerated standard narrative of perpetual Jewish suffering means that Jewish groups benefit from a double standard that enables them to avoid condemnation for their over-the-top manipulation of government and other institutions with avoidance of any penalty for their activity. Matt Brooks, the CEO of the Republican Jewish Coalition spoke Tuesday at the RNC, providing the standard line about poor suffering American Jewry, saying “President Trump will bring back law and order so that American Jews can once again wear a kippah and walk the streets without fear,” while waving a kippah with Trump’s name embroidered on it. This playing the perpetual victim is true in the United States most particularly, but it also works in Britain, France, Canada and Germany where fundamental rights like freedom of speech are under attack to protect the state of Israel.

Prime Minister Benjamin Netanyahu is a monster, even regarded as such in his own country due to his corruption and that of his wife. He knows that if the Gaza war were to end, he might quickly wind up impeached and in jail. Interestingly, one of his major crimes involved receiving $250,000 as a bribe from Israeli film maker Arnon Milchan, who made his fortune in the United States and was also involved in espionage directed against US nuclear technology to enable the Jewish state to develop its own secret – and illegal – nuclear weapons arsenal. Milchan and Netanyahu were together involved in illegally obtaining the nuclear triggers needed to detonate the nukes.
