Oldest federal judge, 97, embroiled in battle with bench trying to suspend her

The oldest federal judge is fighting to keep her office as her fellow justices say she must be suspended due to concerns about her mental health.

 

US Circuit Judge Pauline Newman, 97, was appointed by Ronald Reagan in 1984.Newman’s fellow justices on the US Court of Appeals for the Federal Circuit unanimously voted to sideline her in September, Bloomberg Law reports.The vote came after Newman refused to undergo medical testing and provide medical recordsas concerns arose about her mental health.

 

“Affidavits prepared after more than 20 interviews with Court staff reflect consistent reports of deeply troubling interactions with Judge Newman that suggest significant mental deterioration including memory loss, confusion, lack of comprehension, paranoia, anger, hostility, and severe agitation,” the Judicial Council wrote.

 

Now, a special committee of Newman’s fellow judges has recommended the Judicial Council extend Newman’s suspension. On Wednesday, the special committee called for her suspension to last another year or “at least until she ceases her misconduct and cooperates such that the Committee can complete its investigation, whichever comes sooner.”

 

“Her misconduct is thwarting the investigation and making it impossible for the Committee adequately to perform the important function of determining whether she is fit to perform the duties of her office,” the committee wrote.

 

She tried to challenge the initial suspension handed down in September, arguing it was unconstitutional, Bloomberg Law reports.

 

“This district court took and accepted at face value the government’s side of the story, which included, I hate to say, some plain falsehoods about how the investigation had been run,” Newman told Bloomberg Law. “There was nothing resembling the Judicial Conference rulesfor how an investigation should be done.”

 

However, she lost that legal challenge after a judge dismissed the case earlier this month.Newman said at the time she had two medical evaluations, but the Judicial Council questioned their validity, according to Bloomberg Law.

 

Newman’s attorney told Bloomberg Law they plan to appeal the decision.

 

The 97-year-old is a key figure in the world of intellectual property law and has been dubbed the “heroine of the patent system.” Her former clerk, Brian Abramson, told Bloomberg Law earlier this month that he has seen her still performing well.

 

“She is clearly cogent and able to articulate very complex points of law and capable,” Abramson said.

 

“She’s been maintaining a fairly steady speaking schedule at conferences and events,” he continued. “Every time she speaks she captures very eloquently the state of the law, the complexity of the issues that are before us, her concerns about the direction of the law, and its ramifications for innovation and the good of the people.”

Hamas is filming the torture of Israeli hostages in an attempt to force Israel to ease conditions for Palestinian prisoners.

 

In one video, members of the terrorist group directly address Itamar Ben-Gvir, Israel’s national security minister who controls prison policy, two Israeli officials told The Telegraph.

 

The video shows hostages being tortured while Hamas warn that harsher conditions for Palestinian prisoners held in Israel are affecting the well-being of hostages in Gaza.

 

In May, CNN reported that Palestinians arrested in Gaza were facing brutal conditions at the Sde Teiman desert camp in the Negev desert, some of whom were blindfolded and beaten.

 

A New York Times investigation also found that some 1,200 Palestinian civilians had been held at the Sde Teiman camp “without the ability to plead their cases to a judge for up to 75 days.”

 

Mr Ben-Gvir has made it a priority to worsen conditions for Palestinian prisoners since taking office in December 2022, causing him to clash repeatedly with the Shin Bet intelligence agency who feared it would ignite another violent conflict with Hamas.

 

The video is understood to have intensified the rift, with Mr Ben-Gvir said to have doubled down after viewing it.

Mr Ben-Gvir, who leads the hard-Right Jewish Power party, has been a source of friction between Israel and its closest allies due to his extreme views on the Palestinians, as well as his opposition to a ceasefire deal with Hamas that would free the hostages.

 

In August last year, He said the prisons had begun reducing as much as possible the “indulgences for Hamas terrorists and stopping ‘summer camp’ that was going on in the prison wings in the past.”

 

He also ordered the prisons to forbid inmates from making their own pita bread while limiting hot showers to three wings in one prison.

 

Since October 7, Israel has arrested and killed thousands of Palestinians in Gaza and the West Bank, most of whom Israeli authorities say are members of terror organisations.

 

One senior Israeli official who showed the video to Mr Ben-Gvir said he responded by claiming that it only gives Israel legitimacy to crack down further on Palestinian prisoners.

 

“Even after being warned that because of his desire for likes on social media, our hostages are suffering in Gaza and being tortured, he smiled and said he would continue,” a senior Israeli official said.

 

Mr Ben-Gvir told The Telegraph he was “not aware” of the allegations.

 

The Israeli government announced last month that it would begin reducing the number of inmates held at the camp.

 

The decision to phase out the camp was harshly criticised by Mr Ben-Gvir, who repeated his hard-line vis-a-vis prisoners. He said: “Why are they closing Sde Teiman? Because they are overcrowded? Prisons are overcrowded, and it is good that they are.”

When the polls closed on election night in 2020, President Donald Trump appeared to be winning Pennsylvania. But over the next several days, as officials counted mail-in ballots, his lead shrunk and then disappeared. By Saturday, Joe Biden was the clear winner of Pennsylvania — and with it, the presidency.

The protracted counting process left a days-long vacuum that Trump filled with demands to stop counting the ballots while he was still ahead, declaring victory in Pennsylvania and building the false narrative that the mail-in votes were fraudulent. It became a core part of the false narrative that helped propel Trump’s “Stop the Steal” crusade and spurred election denialism among his allies and supporters that has continued to this day.

The delay was caused by a quirk of Pennsylvania’s election law, which forbids the opening of mail-in ballots until 7 a.m. on the day of the election. The narrow Election Day vote margins in 2020 coupled with the unprecedented number of people voting by mail because of the pandemic created a massive backlog and left election officials racing to finish the count. Pennsylvania, one of the most hotly contested battleground states, is one of only seven states, including another battleground, Wisconsin, that doesn’t allow pre-canvassing — the act of opening and processing mail ballots ahead of Election Day. In 2020, 27 states allowed pre-canvassing. Since then, 16 more states have passed laws permitting it.

 

But not Pennsylvania. Despite widespread calls for change, Pennsylvania is likely to again take several days to announce this year’s winner, alarming state election officials who worry the delay will cause confusion, deteriorate trust in the process and make election workers targets for harassment.

“If the electoral college comes down to Pennsylvania or Wisconsin, we might still face a long period where we don’t know the winner,” said Rachel Orey, an elections expert at the Bipartisan Policy Center.

Pennsylvania state lawmakers had four years to change the law and allow pre-canvassing, but the legislative session ended this month without them doing so. The Democratic-led Pennsylvania House of Representatives passed a bill in May that would have allowed county officials to begin pre-canvassing mail ballots seven days before Election Day, as was recommended by a bipartisan panel. But the Republican-controlled State Senate never brought it for a vote, with some Republicans arguing that the change wasn’t needed or that it should include other changes to election laws.

 

“It’s reprehensible that they didn’t get it done,” said Kathy Boockvar, a Democrat who was Pennsylvania’s secretary of state during the 2020 election. “This is not rocket science. The reality is that not passing this bill will mean that ballots will take longer to count, which means it will be longer until we have the results of the election.”

State Rep. Scott Conklin, a Democrat who sponsored the pre-canvassing bill, said that when he asked county commissioners across the state to name one wish for administering elections, the answer was resoundingly to allow them to start processing mail ballots early.

Conklin said refusal to do so could once again allow election deniers to baselessly claim that the mail ballots counted after Election Day are fraudulent. Ahead of the 2020 presidential election, Trump and his allies began to cast doubts on the integrity of mail ballots and urged his supporters to vote in person, creating what became known as the “red mirage.” Initially leading, Trump declared victory in Pennsylvania the day after the election, less than 24 hours after polls had closed. His campaign sued to stop the count even though nearly 1 million mail ballots statewide had not yet been tallied. Then-Trump attorney Rudy Giuliani and other Trump backers alleged widespread fraud in the mail ballots without evidence.

“This is a perfect case of where the elected officials are purposely causing a delay, causing an atmosphere of conspiracy and doing it on the backs of good citizens who trust them,” Conklin said, referring to the Republican legislators who blocked the legislation.
