Let me say this once again because it is important. A judge may know right from wrong, even that you are suing but using the wrong law as your defense or argument; they are not obligated nor part of their job to tell you this, correct you, nor point you in the right direction. They will just decide: do you have a valid case or not; and if not dismissed. But you "Can" ask a judge to explain the law and they must explain the law to anyone in the court , lawyers, DAs, defendants, prosecutors, plaintiffs, and jurors So the lawyers could have asked why they are not covered by the first and then ask what Amendment would cover their people to hear President Trump and the judge or judges "must" tell them. And that should be done before you let them make a decision.

A judge is not privileged to tell you what is the right application of law but a judge must explain the law to everyone in the court room. Ask the right questions.

So, Missouri sued under the wrong law, free speech when they should have sued under the 4th Amendment right to be secure in their persons and effects regarding a candidate for CiC and POTUS.

 

PDJT needs to sue on abridging, which means cut off, the right to free speech of the 1st Amendment and that the Constitution is the Supreme Law and immutable to all States and Judges otherwise.

 

In addition Trump can sue over the 6th Amendment too, because he has the right to a public "hearing" and can be heard in public, as public as he wants it to be. And the 6th Amendment allows him to call witnesses on his behalf, which also includes himself as a witness.
