Lawyers for accused 9/11 terrorists say move to revoke plea deal was ‘corrupt’

Lawyers for three alleged 9/11 terrorists fumed Wednesday at Defense Secretary Lloyd Austin’s decision to revoke plea deals that would’ve spared their clients the death penalty, calling the move “corrupt.”

“We have had an unprecedented act by a government official to pull back what was a valid agreement,” Walter Ruiz, a lawyer for Mustafa Ahmed Adam al Hawsawi, said during a hearing in Guantanamo Bay, according to CNN.

“For us, it raises very serious questions about continuing to engage in a system that seems so obviously corrupt and rigged,” he added.

Austin, 70, scrapped plea deals last week that were extended to Hawsawi, Walid Muhammad Salih Mubarak Bin Attash and alleged 9/11 mastermind Khalid Sheikh Mohammed by the Office of Military Commissions, which is prosecuting the case.

The pre-trial agreements sparked a furor among family members of 9/11 victims and survivors of the attacks, with many slamming the deals as a miscarriage of justice and arguing that the three alleged 9/11 co-conspirators should face trial and be subject to the death penalty if found guilty.

The defense secretary defended revoking the plea deals on Tuesday, telling reporters that he did not take the decision “lightly.”

“There’s not a day that goes by when I don’t think of 9/11 and the Americans that were murdered that day; also those who died trying to save lives and the troops and their families who gave so much for this country in the years following that,” Austin said during a joint press conference with Secretary of State Antony Blinken and Australian officials.

“I’m deeply mindful of my duty to all those whose lives were lost or changed forever on 9/11, and I fully understand that no measure of justice can ever make up for their loss,” he added.

“So this wasn’t a decision that I took lightly, but I have long believed that the families of the victims, our servicemembers, and the American public deserve the opportunity to see military commissions — commission trials carried out in this case.”

At Wednesday’s hearing, which was scheduled before the plea deals were announced and then later withdrawn, Ruiz argued that the agreements were “years” in the making, and made “ in good faith … only to have that taken away.”

The agreement was the result of more than two years of negotiations. Ruiz noted that parties, including the prosecution, had worked “for years … in good faith” to reach the pretrial agreement, “only to have that taken away.”

Gary Sowards, a defense attorney for Mohammad, argued at the hearing that Austin lacked the authority under the military’s Manual for Military Commission to scrap the plea deals because the alleged terrorists had “begun very important, substantive, specific performance” to hold up their end of the deal.

Sowards further indicated that he intends to “explore” how Austin may have been “coerced and influenced” to revoke the agreements.

“We should not gratify the chaos that is resulting from this precipitous decision,” he said.

Prosecutor Clayton Trivett told the judge that the government had not yet worked through “the issues raised” by the defense.

“’We want to consult with people’ — that sounds like ‘we want to get our stories together,’” Sowards said of Trivett’s comments.

“There is no story that says what happened on Aug. 2 was authorized after what happened on July 31.”

A senior defense official told CNN that Austin “exercised his own independent judgment” when striking the plea deals and that the Pentagon chief “acted lawfully.”

Voting machine contract under scrutiny following discrepancies in Puerto Rico’s primaries

Puerto Rico’s elections commission said Tuesday that it’s reviewing its contract with a U.S. electronic voting company after hundreds of discrepancies were discovered following the island’s heated primaries.

The problem stemmed from a software issue that caused machines supplied by Dominion Voting Systems to incorrectly calculate vote totals, said Jessika Padilla Rivera, the commission’s interim president.

While no one is contesting the results from the June 2 primary that correctly identify the winners, machine-reported vote counts were lower than the paper ones in some cases, and some machines reversed certain totals or reported zero votes for some candidates.

“The concern is that we obviously have elections in November, and we must provide the (island) not only with the assurance that the machine produces a correct result, but also that the result it produces is the same one that is reported,” Padilla said.

More than 6,000 Dominion voting machines were used in Puerto Rico’s primaries, with the company stating that software issues stemmed from the digital files used to export results from the machines.

The contract between Dominion and the elections commission ends June 30.

José Varela, vice president of Puerto Rico’s House of Representatives, called for Padilla to appear at a public hearing Thursday to address the issues.

“We cannot allow the public’s confidence in the voting process to continue to be undermined as we approach the general elections,” he said.

The problems called to mind the island’s botched 2020 primaries, when a lack of ballots at some centers forced the government to reschedule voting in a first for the U.S. territory.

On June 2, Puerto Rico held primary elections to select gubernatorial candidates for the pro-statehood New Progressive Party and the Popular Democratic Party, which supports the island’s territorial status.

In a surprise upset, Jenniffer González, Puerto Rico’s congressional representative, beat Gov. Pedro Pierluisi in the primary held by the New Progressive Party. Meanwhile, Puerto Rico Rep. Jesús Manuel Ortiz defeated Sen. Juan Zaragoza in the primary held by their Popular Democratic Party.

Both parties reported hundreds of ballots showing inaccurate results, with the PNP reporting over 700 errors and the PPD pointing to some 350 discrepancies. These inaccuracies affected ballots for positions including governor, mayor and resident commissioner.

In response to the discrepancies, the elections commission conducted a full vote tally and audited paper receipts from hundreds of ballot-counting machines.

Edwin García Feliciano, Puerto Rico’s Ombudsman, called the incident a “threat” to the island’s electoral system and called on the governor and the island’s federal control board that oversees the island’s finances to establish a plan to guarantee a better outcome in the upcoming general elections.

“All planning is based on resolving emergencies, including unlikely ones,” García Feliciano said. “But predictable circumstances, which are well known to the public, cannot be addressed by improvisation and in a rush.”

The island is now preparing for the November general election, where voters will choose a new governor and local representatives. While Puerto Ricans are U.S. citizens, they are not allowed to vote in the U.S. presidential elections. ___

Colorado clerk who became hero to election conspiracists wanted to preserve data

Former Colorado county clerk Tina Peters, a hero to election conspiracy theorists who is accused of orchestrating a breach of election security equipment, was trying to prevent voting information from being erased, her lawyer said at the start of her trial Wednesday.

Under the laws in place in 2021, when Peters allowed a man who prosecutors say was working with MyPillow CEO Mike Lindell to make a copy of a Dominion Voting Systems computer’s hard drive, she was allowed to hire a “consultant” to make such a copy, defense attorney Amy Jones said during opening statements.

“She believed she needed to save that data,” said Jones, who did not deny that a copy was made.

But prosecutor Robert Shapiro portrayed the man as a “cyber mercenary” who Peters brought in without conducting a background check and committed identity theft by passing him off as another person who had obtained clearance to work for her office. He said Peters contacted the man, who has not been charged, after she met with Douglas Frank, another person working with Lindell, one of the nation’s most prominent election conspiracy theorists. Frank, an Ohio math teacher, had been traveling around the country looking for evidence of voter fraud when he met with Peters and she hatched the plan, he said.

Despite that, Shapiro told jurors the case against Peters was not about election fraud or conspiracy theories.

The Georgia State Election Board has voted to accept a new rule requiring counties to preserve voting machine memory cards which contain ballot images, audit logs, etc. This came after they discovered that 1.7 million ballot images were missing from the 2020 election.

Though it wasn't exactly clear what Trump was referring to, CrowdStrike is the name of the cybersecurity firm that was hired to investigate the hack of the Democratic National Committee in 2016. DOJ officials were not able to shed any light on the matter.

CrowdStrike, in a statement, said that it had already "provided all forensic evidence and analysis" to the FBI regarding its DNC hack investigation.
