during "break" they leave at least one person on the hill to keep the session open while the rest are at home essentially keeping them from being

arrested there as well

Members of Congress are immune from arrest while attending or traveling to/from Congress, except in cases of treason, felony, or breach of the peace. However, this immunity does not apply outside of these circumstances, and they can be arrested and charged with crimes unrelated to their official duties or speech/debate in Congress. Additionally, Congress itself cannot charge Members with crimes; only federal prosecutors can do so.

 

In summary, while some members of Congress may choose to stay in Washington D.C. for various reasons, there is no requirement for a specific member to remain in the city to keep the current session open while others return home.
