Swing State Poll 2024: Pennsylvania, Michigan, Wisconsin: Blue Wall Shows Cracks As Race Tightens, Quinnipiac University Poll Finds; U.S. Senate Races: Michigan Moves To Toss-Up, Dems Lead In PA & WI

Less than a month until Election Day, the so-called Blue Wall battleground states of Pennsylvania, Michigan, and Wisconsin show a tight presidential race where neither Vice President Kamala Harris nor former President Donald Trump is winning as all three states are too close to call, according to Quinnipiac (KWIN-uh- pea-ack) University polls of likely voters in each of the states released today.

In Quinnipiac University's September 18 poll, Harris held a lead in Pennsylvania, a slight lead in Michigan, and the race was essentially tied in Wisconsin.

"That was then, this is now. The Harris post-debate starburst dims to a glow as Harris enters the last weeks slipping slightly in the Rust Belt," said Quinnipiac University Polling Analyst Tim Malloy.’

ATLANTA – With less than a month to go before voters head to the polls, the State Election Board is embroiled in a fight with Georgia's most populous county over a monitoring team to observe the county's election practices.

 

The monitoring team was part of a resolution of a complaint against Fulton County stemming from the 2020 election. The State Election Board in May found that the county violated some parts of the state election code. It voted to issue a letter of reprimand, which included instructions for an agreement on a mutually acceptable monitor to be entered into by the board's August meeting.

 

But the county and state election boards have been unable reach agreement.

 

The county favors a team proposed by Ryan Germany(liar, cheater), a former chief lawyer for the secretary of state’s office, and the Atlanta-based Carter Center. The Donald Trump-endorsed majority on the State Election Board has proposed an alternative slate that includes people who questioned the results of the 2020 presidential election.

 

In late August the county went ahead and hired its team without agreement from the state board, and it has been in place monitoring pre-election practices for over a month. Butthe disagreement between the county and state boards continued to fester and escalated significantly this week.

 

On Monday the Fulton County board filed a lawsuit asking a judge to declare that the state board lacks the authority to force it “to accept, and Fulton County to pay for, additional monitors for the 2024 election that have been hand-picked by certain State Election Board members.”

 

At a State Election Board meeting Tuesday, member Janice Johnston said the county doesn't seem to be holding up its part of the bargain. She had voted against the agreement because she didn’t believe the investigation into the original complaint was complete and has repeatedly tried unsuccessfully to reopen it.

 

Johnston proposed subpoenaing a trove of 2020 election documents from the Fulton County clerk of court. She and the other two Republican members of the board voted for the subpoena over the objections of the lone Democratic member and the nonpartisan chair, who pointed out that the state attorney general said the case was closed and could not be reopened.

 

An Aug. 19 legal opinion written by state Attorney General Chris Carr and obtained by The Associated Press says final decisions of the State Election Board are “preclusive" and that “re-litigation of all claims which have already been adjudicated, or which could have been adjudicated, is therefore prohibited.”

 

Fulton County attorneys assert that the approval of the motion at the May meeting and resulting reprimand meant the case is closed and can't be reopened, and that “argument is likely correct,” Carr wrote.

 

Asked about the attorney general's guidance, Johnston said, “That was opinion. That's not a legal finding. That was their advice or opinion. We have different opinions about that.”

Fulton is home to about 11% of the state’s electorate and includes most of Atlanta. Problems with its elections, including long lines and slow reporting of results, have drawn national scrutiny. Then-President Trump falsely asserted that widespread voter fraud in Fulton County during the 2020 presidential election cost him the state.

 

After a particularly problematic primary that year, the county andthe State Election Board formally agreed to assign an independent monitor to examine county’s election practices during the general. He documented “sloppy processes” and “systemic disorganization” but found no evidence of illegality or fraud.

 

Fulton County’s elections have been closely watched since then, and the State Election Board voted last year not to take over its elections after a performance review found the county showed marked improvement.

 

The county and thesecretary of state's office both signed off in July on a team proposed by Germany, who also was part of the team that did the performance review. The county also rejected a proposal from Johnston.

 

The Republican majority on the State Election Board repeatedly said during meetings in August that they did not approve of the county's team. But the county board reaffirmed its selection, and county commissioners voted to approve the contract days later.

 

The state board Republicans in September repeated their dissatisfaction, and Johnston suggested that she and board chair John Fervier meet with Fulton County election board chair Sherri Allen.

 

Fervier said at Tuesday's meeting that they met last week, that Johnston proposed that the monitoring team be expanded and that the state board sent a list of eight proposed members. Allen told them the county commissioners would have to make the change, and Fervier said he believed no action was taken on that front.

 

Fervier then said he was alerted that morning about the Fulton board's petition to the judge.Johnston said she interpreted that as a rejection of the monitoring team members they proposed and accused the local board of not complying with its obligation under the agreement.

Trump-allied Georgia election board wants 2020 election deniers to monitor Atlanta-area voting

The Donald Trump-allied Georgia State Election Board is pushing to install people who deny the result of the 2020 presidential election as part of a monitoring team in Fulton County, the biggest Democratic-leaning county in the state and one that was consequential for Joe Biden’s victory four years ago.

 

The board has no legal authority to install its own recommended monitors, but that did not stop the GOP majority from voting on Tuesday to repeat its effort to include its own suggested monitoring team in Fulton County. The move, coming less than 30 days before Election Day, is the latest example of what critics say is the board acting in a way that may create chaos next month.

 

Asked by CNN whether this was an effort to get partisan election deniers to be part of the monitoring teams, board member Dr. Janice Johnston said, “absolutely not” while also conceding the decision on who monitors election precincts is ultimately up to the county.

 

Fulton County, meanwhile, has sued the board, objecting to the push to force it to use election deniers as monitors.

 

“The State Election Board has no statutory authority to force the Fulton County BRE [Board of Registration and Elections] to accept, and Fulton County to pay for, election monitors hand-picked by the State Election Board,” the lawsuit states.

 

Fulton County has already agreed to a monitoring team proposal that would include Ryan Germany, a former staff attorney for the Georgia secretary of state during the 2020 election, as well as members of The Carter Center, former President Jimmy Carter’s non-profit organization which has been internationally acclaimed for its election monitoring.

 

But GOP members of the state-election board told CNN neither Germany nor the Carter Center should be allowed to be a monitor because of bias.The Carter Center has a world-renowned reputation of election observation, Johnston said, but that’s “in the past.”

 

“Currently, when I meet people that they hire to be their volunteers through the Carter Center, I oftentimes find people that come from partisan organizations, such as the ACLU and Common Cause,” Johnston said.

 

Instead, Johnston and her peers are recommending Heather Honey, who previously worked with the Cyber Ninjas, which faced months of criticism over their questionable audit practices, and Col. Frank Ryan, who refused to certify election results in the past. Both fundamentally distrust the results of the 2020 election

 

“The person that you want is the person that pays attention to the details and reports objectively,” Johnston said in defending the recommendation the board suggested.

 

Multiple new rules this year have been adopted by three election board members loyal to Trump, who has publicly praised their efforts, and several legal challenges have been filed against the board. (Just because Trump praised them, does not in any mean the Board is loyal to Trump, CNN should be sued.)

Elections board subpoenas Fulton County clerk

Meanwhile, the board also passed a motion on Tuesday proposed by Johnston to subpoena the Fulton County clerk for access to election-related documents for an investigation into voter irregularities, despite the fact the state’s Republican attorney general said the probe can’t proceed.

 

This summer, the board revived an inquiry into allegations that roughly 3,000 ballots were counted twice during the 2020 recount, but Attorney General Chris Carr told the board in an official opinion that it did not have legal standing to ask his office to investigate.

 

Johnston said Carr’s legal opinion was just that – an opinion – and would not stop the board from proceeding with its own investigation.

My motion is to complete the investigation in that particular case, and actually finish out that investigation,” Johnston said.

 

Fellow election board RepublicanJanelle King alleged that Fulton County is operating in bad faith. “Had they produced these documents when we first asked for them, we wouldn’t be here. Had they worked with us with the monitoring team, we wouldn’t be here,” King told reporters Tuesday.

 

“This is not the board wanting to put pressure on any county. But if you are not going to listen, if you are not going to be responsive, you are not going to do what you say you are going to do, we have to,” King said.

 

As for thosewho still believe the GOP board members are working on behalf of Trump, Johnston told CNN, “I’ve never met the man.”

 

Johnston said that the board would consult with its legal counsel and the attorney general if Fulton County did not show up for its subpoena.

 

There is no date scheduled for the next election board meeting, and Tuesday was expected to be the final one before the November 5 election.
