His stepping away from re election could have triggered a process whereby DJT slips in.
DJT never conceded and Biden was sworn in because he had the support of the Army and 6 of 9 Justices.
CQ Brown took over for Miley and does not appear to have recognized Biden's win as Miley did.
This puts Biden and DJT as president elect but Harris as VP ( Pence conceded) . A DJT win makes him the sole President elect as Biden is not in the running.
Another theory is December 17th States certify the new election. If we are currently without a CiC ( military invoked Continuity of operations) then Dec 17th would identify the will of the people for a new CiC. DJT could be lawfully sworn in as CiC and J20 as President
