Public Defender Jeff Adachi Says D.A. Kamala Harris Blowing Off Crime Lab Scandal — and Him

San Francisco Public Defender Jeff Adachi sharply criticized District Attorney Kamala Harris' handling of a growing scandal at the San Francisco Police Department crime lab today, saying the city's top prosecutor had ignored repeated requests to meet with him and failed to disclose the full extent of problems at the lab.

“Anytime I've asked the District Attorney for a meeting, I've been told the District Attorney is out of town or not available,” Adachi said, noting that Harris had initially scheduled — but then canceled — a meeting when the Public Defender's office first learned of alleged tampering with drug samples by lab technician Deborah Madden. “We need a District Attorney who will give this the attention it deserves.”

The remarks came at a press conference Adachi held in the wake of a judge's order yesterday that prosecutors turn over thousands of pages of documents about Madden and problems at the crime lab's narcotics unit. The records include the transcript of an internal police interview with Madden wherein she described startlingly sloppy protocols for measuring drug weights — an important factor in criminal sentencing — and stated that she and other lab technicians routinely “just laughed” at testing errors.

All of Harris drug prosecutions were at risk of being let out of jail because the police lab appeared to be skimming drugs from the confiscated stash. If this came to light, it would reflect badly on Kamala's actual prosecutorial record. The Public Defender that had uncovered this scandal died suddenly.

Judge issues scathing ruling in drug lab scandal

SAN FRANCISCO

The district attorney's office says it has concerns about the judge's legal analysis and will address those through court motions. San Francisco public defender Jeff Adachi says the ruling should compel prosecutors to turn over information he has requested and is still waiting for.

"This is about the integrity of our justice system," says Adachi.

He calls the court ruling huge. It blasts District Attorney Kamala Harris and her office for failing to turn over damaging evidence about Debbie Madden.

Madden is the retired police drug lab technician, who used to testify against drug suspects and is now accused of skimming cocaine from the lab. She was convicted of domestic violence back in 2008.

The U.S. Supreme Court has ruled that kind of information must be given to the defense.

"If you were accused and a witness testified against you and you weren't told the truth about that witness' background, how might that affect the verdict in your case? How might that affect your sentence?" asks Adachi.

In her ruling Superior Court Judge Anne-Christine Massullo says the district attorney's "failure to produce information actually in its possession regarding Madden and the Crime Lab is a violation of the defendants' constitutional rights."

However, the judge declined to toss out 60 cases saying dismissal is a remedy of last resort. The district attorney's office calls that a victory.
