DOJ to Monitor Polls in 27 States on Election Day

The Department of Justice announced Friday that it will monitor polls in 27 states, including all seven battlegrounds, on Election Day for compliance with federal voting rights laws.

 

The DOJ's Civil Rights Division will coordinate the effort across 86 jurisdictions.

 

The number of election monitors is the most since the 2004 election and represents a 49% increase from 2020, The Washington Post reported.

 

"Monitors will include personnel from the Civil Rights Division, other department divisions, U.S. Attorney's Offices and federal observers from the Office of Personnel Management. Throughout Election Day, division personnel will maintain contact with state and local election officials," the Justice Department said.

 

The announcement comes amid concerns over voter intimidation and the safety of election workers and in the aftermath of arson attacks on ballot boxes in Oregon and Washington. However, the DOJ is not sending monitors to either of those states.

 

Republicans in three states have said federal monitors are not welcome inside polling places. In the 2022 midterms, state officials in Florida and Missouri prevented monitors from entering polling locations. Texas officials also have signaled they won't allow the feds to enter polling sites on Tuesday, the Post reported. DOJ monitors are being sent to all three states, according to Friday's release.

 

"This certainly has become politicized," Missouri Secretary of State Jay Ashcroft told the Post. "The Department of Justice lied when they came in and used pretenses to try to bully their way in when they knew what they were doing was not legal."

 

Former DOJ voting rights lawyer Katherine Culliton-Gonzรกlez, now a chief policy counsel at Citizens for Responsibility and Ethics in Washington, told the Post that monitors "go to places where there is a potential for problems."

 

"Normally, monitors have a very calming effect," she said.

 

Among the battleground states, the DOJ is sending monitors to six counties in Michigan, five in Georgia, four in Wisconsin and Arizona, three in Pennsylvania and North Carolina, and one in Nevada, according to the release.

 

"Complaints related to violence, threats of violence or intimidation at a polling place should be reported immediately to local police authorities by calling 911. These complaints should also be reported to the department after local authorities have been contacted," the release said.

Georgia County Mails Thousands of Absentee Ballots Late

Georgia's third-largest county is running late in mailing more than 3,000 absentee ballots to voters just a few days before the election.

 

To deliver the ballots on time, election officials in Cobb County north of Atlanta were using U.S. Postal Service express mail and UPS overnight delivery, and sending the ballots with prepaid express return envelopes.

 

โ€œWe want to maintain voter trust by being transparent about the situation,โ€ county Board of Elections Chairwoman Tori Silas said in a statement Thursday. โ€œWe are taking every possible step to get these ballots to the voters who requested them."

 

Silas blamed the delay on faulty equipment and a late surge in absentee ballot requests during the week before the Oct. 25 deadline.

 

However, a judge ruled Friday that Cobb County voters receiving their absentee ballots late can return them by Nov. 8, three days after Election Day, as long as they're postmarked by Tuesday, The Atlanta Journal-Constitution reported.

 

The ruling came after the American Civil Liberties Union and the Southern Poverty Law Center filed a lawsuit seeking to extend the deadline.

 

Georgia voters have shattered early turnout records since advance voting began Oct. 15. As of Friday afternoon, more than 3.8 million ballots, reflecting more than half the state's active voters, had been cast, according to Georgia Secretary of State Brad Raffensperger's office. The tally includes more than 238,000 absentees.

 

In Cobb County, election officials said voters whose awaiting absentee ballots were late could still vote in-person on the final day of early voting Friday or on Tuesday. The county's election headquarters planned to stay open to accept hand-delivered absentees through the weekend and on Monday.

 

However, the Board of Elections said that more than 1,000 of the absentee ballots being mailed late were being sent to people outside of Georgia.

 

A county spokesperson, Ross Cavitt, declined to comment Friday on what number, if any, of the late ballots still needed to be mailed, citing pending litigation.

 

The civil rights groups' lawsuit was filed on behalf of three Cobb County voters who said they still had not received absentee ballots by mail as of Friday. The lawsuit said that although county election officials โ€œhave taken some steps to help alleviate the problem, those actions are not nearly enough to safeguard their right to vote.โ€

Judge Rejects Musk's Court Move, Trial to Resume Monday

A U.S. District Judge rejected Elon Musk's bid to move a pending lawsuit challenging his $1 million daily voter registration giveaways to federal court.

 

Judge Gerald Pappert ruled that the lawsuit filed by Philadelphia District Attorney Larry Krasner will return to state court thereby ensuring a prompt hearing before Election Day. On Thursday, Pennsylvania state judge Angelo Foglietta said that he would not move forward with the lawsuit that seeks to stop Musk and his $1 million voter giveaways.

 

By trying to move courts, Musk succeeded in pausing a Thursday state court hearing that required his attendance. Krasner, a Democrat, has accused Musk of running an "illegal lottery scheme to influence voters." On Monday, he sued Musk and his super PAC asking the court to halt the sweepstakes. In October, the Musk financed America PAC initiated giveaways to registered voters in seven swing states, including Pennsylvania, who have signed the PAC's petition supporting free speech and the right to bear arms.

 

Attorneys for the Tesla CEO have accused Krasner of trying to rush a court-ordered stop to the giveaways. "The District Attorney wants this litigation to be a rushed stage play, and the attendant spectacle and attention that go with it. But this lawsuit belongs in federal court, where it can be decided soberly and in a deliberate fashion," Musk's attorneys wrote in court filings.

 

Musk had requested the case be moved to federal court on Wednesday evening, saying that it had "little to do with state-law claims of nuisance and consumer protection," which had been cited by Krasner's initial complaint. The DA's office immediately pushed back saying, "Viewed properly, the Notice of Removal is a stunt to obtain a procedural advantage to avoid a ruling on the Preliminary Injunction and run the clock until election day."

 

Thus far, fourteen swing state residents have received checks from the America PAC sweepstakes. The PAC announced that the remaining four check swill go to registered voters in Wisconsin, Arizona, and Michigan, a move that could complicate court proceedings in Pennsylvania.
