House Oversight to Probe Census Integrity

https://www.newsmax.com/politics/house-oversight-miscount/2024/11/27/id/1189577/

The House Committee on Oversight and Accountability chair has scheduled a hearing as part of its investigation into the U.S. Census Bureau.

Chair Rep. James Comer, R-Ky., on Wednesday announced that the panel will hold a Dec. 5 hearing to examine the Census Bureau's activities, including significant miscounts in the 2020 census in 14 states.

"The Census Bureau's review of the 2020 census revealed substantial miscounts and discrepancies tending to benefit Democrat-run states," Comer said in a statement. "Congress has a responsibility to conduct oversight of these massive errors to ensure they are not repeated in the 2030 census."

Comer added that "current integrity issues with the census" also "must be addressed."

"The Biden-Harris Administration facilitated the worst border crisis in American history, allowing millions of illegal aliens to enter and reside in our country unlawfully. To ensure only U.S. citizens are counted for the apportionment of congressional seats and electoral college votes, Congress must pass the Equal Representation Act to add a straightforward citizenship question to the Census," Comer said.

"We look forward to hearing Director [Robert] Santos' testimony and ensuring the Census Bureau takes the necessary steps to deliver a fair and accurate 2030 census."

In September, Comer sent a letter to Santos and requested documents and communications concerning the 2020 census.

The chair said "the Census Bureau's 2020 Post-Enumeration Survey (PES) — designed to 'measure the accuracy of' the decennial census — identified significant errors in the counts of numerous states."

"Significantly, these errors likely led to an erroneous apportionment of representatives among the states," Comer wrote.

"Even relatively small differences in population count can affect congressional representation, as a single congressional seat cannot be divided among multiple states," Comer wrote to Santos. "Undercounts or overcounts can be the deciding factor between a state gaining or losing an additional representative in its delegation."

Comer said the 2020 PES identified statistically significant overcounts in Delaware, Hawaii, Massachusetts, Minnesota, New York, Ohio, Rhode Island, and Utah. Undercounts were found in states such as Arkansas, Florida, Illinois, Mississippi, Tennessee, and Texas.

"Because of the 2020 Census' failure to accurately count, Colorado gained a seat it did not deserve, Rhode Island and Minnesota kept seats they should have lost, and Texas and Florida were not awarded seats they should have gained," Comer wrote.

The Constitution requires that a census be taken every 10 years to determine how U.S. House seats are apportioned.

Ohio Gov. Signs Bill on Trans Students' Bathroom Use

https://www.newsmax.com/newsfront/transgender-students-bathroom-ohio/2024/11/27/id/1189580/

Transgender students from kindergarten through college at Ohio public and private schools will be banned from using multiperson bathrooms that fit their gender identities under a measure signed by Republican Gov. Mike DeWine on Wednesday.

DeWine signed the bill over the objections of Democrats, teachers' unions, and civil-rights groups, which had hoped that his objections to a ban on gender-affirming care for minors last year would carry through and prompt another veto.

The Republican-backed measure — labeled the "Protect All Students Act" — requires public and private schools, colleges and universities to designate separate bathrooms, locker rooms, and overnight accommodations "for the exclusive use" of either males and females, based on one's gender assigned at or near birth, in school buildings, and other facilities used for school-sponsored events. It contains no enforcement mechanism.

"It revolves around safety, security, and, I think, common sense. It protects our children and grandchildren in private spaces where they are most vulnerable," said Republican Ohio state Sen. Jerry Cirino, the bill's sponsor.

The ACLU of Ohio was among the groups that had lobbied for a veto, condemning the measure as a violation of the right of privacy of LGBTQ+ Ohioans that will make them less safe.

With DeWine's signature, Ohio adds to the pushback that's cropped up nationally among many Republican politicians, including President-elect Donald Trump.

Twenty-six states have now adopted laws restarting or banning gender-affirming care for transgender minors. The U.S. Supreme Court is scheduled to hear arguments Dec. 4 on whether Tennessee's ban on such treatments can continue to be enforced; any ruling is likely to impact policies in other states, too.

At least 11 states have adopted laws, like Ohio's, barring transgender girls and women from girls and women's bathrooms at public schools – and in some cases, in other government facilities.

And at least 24 states have laws dictating which sports competitions transgender girls and women can join.

Ohio's bathroom bill was debated for 19 months before finally clearing the GOP-led Legislature on Nov. 13, during Transgender Awareness Week. It was tacked onto a separate piece of legislation by the Ohio House that related to the state's College Credit Plus program, which allows high schoolers to earn college credit.

Trump's campaign leaned heavily into opposing transgender rights in the last weeks of his race against Vice President Kamala Harris, including Trump's vow at a Madison Square Garden rally that "we will keep men out of women's sports" and campaign ads saying, "Kamala's for they/them. President Trump is for you."

It's not clear what policies Trump might adopt once he takes office in January. But bills relating to gender issues are already being queued up in state legislatures that come into session early in 2025.

In Texas, there are proposed measures to bar using state money to pay for "gender reassignment," to use state money to pay to reverse gender transitions, and to give people who receive gender-affirming care before they turn 15 until they turn 25 to sue their doctors for malpractice, among others.

Democrats in the Republican-dominated legislature there have also introduced some bills intended to protect people from discrimination on the basis of "gender identity or expression."

In Ohio, a law that bars gender-affirming care for minors and blocks transgender girls and women from participating in girls and women's sports competitions took effect in August. It took a rocky path, though. The measure became law only after the legislature overrode DeWine's veto. And after that, a judge put enforcement on hold for about four months before allowing it.

Axios Admits Trump Prosecutions 'Backfired'

https://www.newsmax.com/newsfront/axios-donald-trump-jack-smith/2024/11/26/id/1189507/

Efforts to prosecute President-elect Donald Trump during and after his presidency have unintentionally fortified his legal position, raising concerns about the broader implications for presidential accountability.

The legal cases initially aimed to hold Trump accountable for alleged misconduct during his first term have largely faltered. As Trump enters a second term, experts suggest these developments could shield him and future presidents from legal consequences for actions taken in office.

Special counsel Jack Smith announced Monday the dismissal of two high-profile cases against Trump: one involving allegations of attempting to subvert the 2020 election results and another concerning alleged mishandling of classified documents.

Meanwhile, the New York business records case, in which Trump faced 34 fraud-related charges, has postponed its sentencing indefinitely, casting doubt on its eventual resolution.

The election interference case remains unresolved in Georgia but has shown little movement.

A pivotal Supreme Court ruling diminished the cumulative impact of these cases. The court determined that former presidents are immune from prosecution for "official acts," which will limit future efforts to hold former presidents accountable for actions taken while in office.

While the exact boundaries of the ruling remain undefined, its implications are profound. Legal analysts believe it protects future presidents from prosecution for their conduct in office, making it exceedingly difficult to hold them accountable after leaving the White House.

Critics argue the Justice Department may have mishandled its approach by moving too slowly to prosecute Trump. Smith was not appointed until late 2022, nearly two years after President Joe Biden took office. His first indictment came just over six months later.

"If they had acted sooner, they might have been able to secure a precedent-setting ruling clarifying the definition of an 'official act,'" some Democrats and liberal legal analysts contend. Without such legal groundwork, they argue, prosecutors struggled to make charges stick, particularly those related to Trump's actions surrounding the Jan. 6 Capitol riot.

As a result, Trump returns to office on solid legal footing. Despite being the first former president convicted of a felony, the cumulative victorious outcome of four trials and dozens of charges has dampened future liberal lawfare.

The backfiring of these prosecutorial efforts has sparked debate among legal experts and political observers. While some argue the cases reflect the challenges of pursuing accountability at the highest levels of government, others view them as a cautionary tale of missed opportunities and strategic missteps.

The truth always remains. Under Biden, the criminal justice system cannot deliver justice, protect democracy, or even earn voters' trust by engaging in the pretense of lawfare.

NY Elementary School Found Teaching ‘Gender Identity’ Course to Kindergartners

https://saraacarter.com/ny-elementary-school-found-teaching-gender-identity-course-to-kindergartners/

An elementary school in the suburbs of New York City has been teaching a “gender curriculum” to kindergarten children in an effort to promote “inclusion” in the school. Hillside Elementary School, part of the Hastings-on-Hudson Union Free District, uses photos of children to introduce “different identities.”

The New York Post reports that the course includes showing kindergarten students photos of other children which are used to “introduce vocabulary to describe characters of different identities,” including teaching them about the terms “cisgender, transgender, and non-binary,” according to a message to parents regarding the curriculum.

“Our gender curriculum focuses on Hillside’s core value of respect and aims to center discussions on gender identity. The students will learn and discuss that there is a lot you can’t tell about a person by simply looking at them,” the kindergarten level course description reads.

“The students will look at pictures of children and talk about what they notice and what they think they know about the children just from the pictures. Using their observations, we will then take the opportunity to introduce vocabulary to describe characters of different identities,” the school writes.

The “identity” being taught to children includes discussing “gender and the pronouns that you use,” and that “as we learn and grow, the words we use to describe our gender identity can grow too,” as described by the school.

Fox News Digital reached out to the school about the curriculum, to which the Hastings-on-Hudson Union Free District communications team said that the lessons have been in place for several years and are rooted in “Hillside’s core values of respect and fostering dignity for all students.”

“One 30-minute gender lesson is taught in each class one time per year. The classes are led by a certified educator, following a specific set of lessons designed to help students value the full diversity of their classmates,” Superintendent William S. McKersie said in a message to faculty and parents.

“The lessons have been created in alignment with the NYS Culturally Responsive-Sustaining Education Framework,” he wrote. The school noted that the lessons do not address sex education or sexuality. The school district said that while they usually have the courses posted publicly online, the gender lesson description has been taken off the website since going viral.

Border Enforcer Tom Homan Details ‘Mass Deportation’ Plan

https://saraacarter.com/border-enforcer-tom-homan-details-mass-deportation-plan/

President-elect Donald Trump’s new border enforcer Tom Homan recently spoke with the Center Square about his extensive deportation plan that will be put in place after Trump and he are sworn into office in January. Homan made the case for a “mass deportation program,” citing the fact that Vice President Kamala Harris let in millions upon millions of illegal immigrants, nine out of ten of whom would be getting orders for removal because they would not qualify for asylum, he said. Homan argued that allowing all of the illegal immigrants to just stay in the United States would nullify immigration law and the immigration court system.

“‘The removal process will prioritize individuals based on their threat to society,’ [Homan] said. ‘The priorities will focus on public safety threats, national security threats and fugitives,’ those who ‘got due process at great taxpayer expense and the federal judge ordered them removed, but they didn’t leave, and they became a fugitive.’”

“Individuals who are on the federal Terrorist Watch List and ‘Special Interest Aliens’ (SIAs), those from countries of foreign concern (COFC), are all priorities.”

Homan has been adamantly sounding the alarm that the United States is facing the greatest national security threat since 9/11 because of the wide-open border. It is well known that individuals on the terrorist watch list have crossed the border into the United States, and Homan said he will work closely with the FBI to identify and find them.

Center Square reported that under Biden’s watch, “the greatest number of known or suspected terrorists were apprehended, with the majority caught at the northern border.”

According to The Post, “Under the Biden administration, more than 660,000 criminal foreign nationals were recently identified to be deported by ICE, including 435,719 convicted criminals, the Center Square reported. ICE agents arrested more than 387,000 criminals in fiscal years 2021 through 2023, the Center Square reported. The majority were citizens of Mexico, Nicaragua, Colombia and Venezuela.”

Homan recognized that finding and removing the millions of “SIAs, those from COFC, criminals released into the US through the CHNV parole program (for Cubans, Haitians, Nicaraguans and Venezuelans) — including members of Tren de Aragua, a violent Venezuelan prison gang — and those identified in national security cases,” will take a long time given the excessiveness of the problem.

As part of his plan, Homan plans to use the US military to assist in the efforts, including providing transportation assistance and “intelligence targeting.” The military will not make arrests as that process remains with immigration authorities like HSI and ICE agents.

Including the military in this effort is not new as the Department of Defense has been used in every administration to assist with border security. However, Homan is expanding the military’s assistance given the enormous number of illegal immigrants that have made their way into the country.

While Homan is focused on making America safe, he warned anyone living in America illegally that this is not their home so long as they are committing the crime. Allowing illegal immigrants to stay in America violates federal law, Homan argued, suggesting that America must be a nation of laws and the Trump administration will see them through.
