Trump’s Border Czar Warns Sanctuary Cities of Legal Consequences for Noncompliance

https://saraacarter.com/trumps-border-czar-warns-sanctuary-cities-of-legal-consequences-for-noncompliance/

President-elect Donald Trump’s newly appointed border czar, Tom Homan, has issued a stark warning to sanctuary cities, pledging to pursue legal action if they refuse to cooperate with federal immigration enforcement. Homan, the former acting Director of U.S. Immigration and Customs Enforcement (ICE), said he will seek Justice Department approval to charge officials with obstruction and harboring if they shield illegal immigrants from ICE custody.

“They need to be aware… impeding a federal law enforcement officer is a crime. If you knowingly harbor or conceal an illegal alien from ICE, that’s a crime,” Homan said in a recent interview with Just the News. “So don’t cross that line!”

Homan, tasked with coordinating Trump’s border security initiatives starting Jan. 20, stated plans to prioritize deportations, particularly of individuals accused or convicted of crimes. Trump’s administration aims to address what they estimate as over 14 million illegal border crossings during the Biden presidency.

Sanctuary jurisdictions, like Los Angeles, which recently reaffirmed its sanctuary city status, have vowed resistance. However, Homan underscored that federal immigration laws take precedence over state and local policies. “Federal law trumps state and local law every time,” he said.

Homan plans to request a formal opinion from Attorney General-designate Pam Bondi on whether jails refusing to cooperate with ICE violate federal law. Additionally, he advocates cutting federal funding for sanctuary cities and states, calling it a necessary disincentive.

Trump’s team also intends to revisit the “Remain in Mexico” policy, seeking cooperation from Mexico’s government to reduce asylum claims at the U.S. border. Homan expressed optimism but warned of tough negotiations if resistance persists.

Homan also vowed to address the disappearance of 30,000 unaccompanied migrant children under the Biden administration, acknowledging the likelihood of many being victims of trafficking or forced labor. “President Trump is committed to finding these kids. It’s going to be hard, but we need to save them.”

‘Times’ Up’ For Tren de Aragua Members, Major Arrest in NYC

https://saraacarter.com/times-up-for-tren-de-aragua-members-major-arrest-in-nyc/

Two members of the vicious Venezuelan gang Tren de Aragua have been arrested in New York City in a major drug and credit card scam bust, according to the New York Post. An “arsenal of deadly assault rifles” was also found in the bust.

Denyeer Aramillo Meneses, 23, and Edison Pena Angulo, 25, were arrested in the bust during an early morning raid in the Bronx. The two were allegedly part of the apartment complex takeover in Aurora, Colorado which drew national attention as their antics were caught on camera inside the building. Warrants for their arrest were issued on October 1 by local police after the incident. Somehow, they made their way to New York City and were caught on Wednesday, November 27.

There were 15 suspected members of Tren de Aragua in total involved in the bust.

“The group was selling a variety of drugs — including heroin, fake weed and the synthetic drug Tussi — and also dabbled in credit card fraud and violence, sources said.

Cops also found a cache of semi-automatic weapons during the raid, including three assault rifles, two pistols and ammo cans packed with cartridges, sources said.”

It’s not clear yet what charges the suspects will face because their federal indictment and the offenses “remain sealed.”

One law enforcement officer told The Post, “Enough already with these guys,” adding, “[TDA’s] time is up.”

New York City has seen its share of Tren de Aragua’s activity, with some suspects being as young as teenagers caught in robberies on the streets. The illegal migrants have grown concerns for residents of the city and other states across the country where active members have been found.

The Venezuelan gang grew its presence in the United States while the Biden administration left the border wide open, making the criminals’ entry into the country possible.

US cannot destroy Texas razor-wire migrant barrier, appeals court says

https://www.reuters.com/world/us/us-cannot-destroy-texas-razor-wire-migrant-barrier-appeals-court-says-2024-11-27/

Nov 27 (Reuters) - A divided U.S. appeals court blocked the Biden administration from destroying razor-wire fencing that Texas placed along its border with Mexico to deter illegal migration.

The 2-1 decision by the 5th U.S. Circuit Court of Appeals clears the way for Republican-led Texas to pursue a lawsuit accusing the federal government of trespassing without having to remove the fencing.

It also reversed a federal judge's Nov. 2023 refusal to grant a preliminary injunction to Texas, as the state resists federal efforts to remove fencing along the Rio Grande in the vicinity of Eagle Pass, Texas.

Circuit Judge Kyle Duncan, an appointee of President-elect Donald Trump, wrote for Wednesday's majority that Texas was trying only to safeguard its own property, not "regulate" U.S. Border Patrol, and was likely to succeed on its trespass claims.

Duncan said the federal government waived its sovereign immunity, and rejected its concerns that a ruling for Texas would impede the enforcement of immigration law and undermine the government's relationship with Mexico.

He also said the public interest "supports clear protections for property rights from government intrusion and control," and ensuring that federal immigration law enforcement does not "unnecessarily intrude into the rights of countless property owners."

The U.S. Department of Justice did not immediately respond to a request for comment.

"Huge win for Texas," the state's Republican Attorney General Ken Paxton posted on social media platform X.

'VIRTUAL POWER OF REVIEW'

Duncan was joined in his opinion by Circuit Judge Don Willett, also a Trump appointee.

Circuit Judge Irma Carrillo Ramirez, an appointee of President Joe Biden, dissented, saying Texas had not shown that the federal government waived sovereign immunity or would likely prevail on the merits.

She said Texas claimed a "virtual power of review" over federal efforts to enforce immigration law, which would frustrate the government's ability to ensure faithful execution of federal law.

Many Republicans have blamed Biden for an increase in the number of migrants illegally crossing the U.S.-Mexico border.

The White House has been locked in legal battles with Texas and other states that have tried to deter and punish illegal migration. Trump's administration is likely to be more receptive to such concerns.

In May, the full 5th Circuit heard arguments in a separate case between Texas and the White House over whether the state can keep a 1,000-foot-long floating barrier in the Rio Grande.

The appeals court is also reviewing a judge's order blocking a Texas law that would let state officials arrest, prosecute and order the removal of people in the country illegally.

Based in New Orleans, the 5th Circuit is widely considered among the most conservative federal appeals courts.

Separately, the Biden administration has sued Iowa and Oklahoma for passing similar laws, which it says interfere with federal enforcement of U.S. immigration laws.
