At least that's what my movie script would have contained in the plot line.

There is no "cannot indict a sitting senator or congressman," only language that prevents detaining one of them to prevent their timely attendance to cast their votes.

 

If there is sufficient evidence, Liddle Schitt can be arrested anytime they want. It had better be a slam-dunk case, or there will be hell to pay.

 

Only problems are the media schitt storm it will create and calls to impeach Trump before he even takes the oath again.

The usual procedure to deal with misconduct by a sitting senator or congressman is to start with an ethics investigation. If the investigation finds cause, then they can vote to expel the offending member. Then, stripped of power, the justice system can take big swings at 'em. The ethics investigation and expulsion are not necessary to facilitate an arrest - just helpful to strip power from the perp, and to turn public opinion away from them.
