they need a case that can make the prima facie precedent. don't know about that one, but disappointing. can only assume something was amiss with it. just because a good case gets bumped up doesn't mean it was done by good people. it might be to set a bad precedent with a loophole and make it harder to fill later. smart judges and lawyers need to be at their best. the legal process and procedure are one of the biggest battlefields for the derps that exist.
