U.S. Lawmakers Push FAA for Timely BVLOS Rule Implementation

As you know, the FAA Reauthorization Act of 2024 became law on May 16, 2024.

Section 930 of the Act directed the FAA to establish a performance-based framework for BVLOS

operations of unmanned aircraft systems (UAS). This section requires the publication of a

notice of proposed rulemaking (NPRM) within four months of enactment and a final rule within

twenty months of enactment. The deadline to issue an NPRM has passed, and it is now our

understanding that the proposed rule may not be issued until January 2025, at the earliest.

It is concerning the failure to comply with statutory instructions may also result in the delay of a final

rule.

2024 FAA Reauthorization Act of 2024. In 2024, the FAA Reauthorization Act mandated the creation of a Part 108 rule to address BVLOS operations. This legislative push reflects the urgency and importance of establishing standardized regulations for the safe and effective integration of drones into the national airspace system. The Act sets a deadline for the FAA to issue a final rule by the end of 2024.

Part 108 is expected to introduce a standardized framework for BVLOS, enabling more complex and far-reaching drone missions.

Very simply put, there is a provision in the new law that directs the FAA to issue a proposed rule enabling BVLOS drone operations in four months; in other words, the federal agency has until September 16, 2024, to publish something.

How very topical. The FAA is late with mandated BVLOS regulation and scary drones (visible by their navigational lights) have seized the public's imagination somehow and created a demand for regulation.

The public panic is being promoted to create an outcry for legislation and regulation and additional funding. Why else would 'hostile' drones have their lights on?
