An O-1 visa is a non-immigrant visa that allows individuals with extraordinary ability or achievement in specific fields to work temporarily in the United States. The O-1 visa is divided into two main categories:
-
O-1A Visa – For Individuals with Extraordinary Ability in the Sciences, Education, Business, or Athletics
This visa is for individuals who have demonstrated extraordinary ability in fields such as science, business, education, or athletics, typically through sustained national or international acclaim.
Examples of O-1A applicants include scientists, researchers, business leaders, athletes, and educators.
-
O-1B Visa – For Individuals with Extraordinary Ability in the Arts, Motion Picture, or Television Industry
This visa is for individuals with extraordinary ability in the arts (such as visual arts, performing arts, music, etc.) or in the motion picture or television industry.
Examples of O-1B applicants include artists, musicians, actors, directors, producers, and other professionals in the entertainment industry.
Key Requirements for the O-1 Visa
Extraordinary Ability: To qualify for an O-1 visa, applicants must show that they possess extraordinary ability in their field, demonstrated through sustained national or international acclaim. This can include evidence of major awards (like a Nobel Prize or an Academy Award) or meeting at least three of the following criteria:
Receipt of major internationally recognized awards.
Published material about you in professional or trade publications.
Original contributions of major significance in the field.
Authorship of scholarly articles or research.
Employment in a critical or essential capacity for distinguished organizations.
A high salary or remuneration compared to others in the field.
A record of leading or critical roles in distinguished organizations or productions.
Temporary Nature of Work: The O-1 visa is for temporary employment, typically granted for the duration of the event, performance, or project, up to a maximum of 3 years. Extensions are possible in one-year increments if the individual continues to meet the criteria.
Employer Sponsorship: To apply for the O-1 visa, the applicant must have an employer in the U.S. (or an agent or sponsor) who will file the petition on their behalf. The employer needs to demonstrate that the applicant’s extraordinary ability will be used in a specific project, event, or performance.
Consultation Requirement: The applicant must provide a written advisory opinion from a peer group or labor organization related to their field, confirming the individual’s extraordinary ability. This is typically part of the application process.
