This is a breakdown of multiple excerpts from Joint Publications and Directives for Military-Civil Operations.

 

This more than outlines that it is NOT unconstitutional for Military to Operate with Civil Matters.

 

Joint Publication 3-28 titled: Defense Support of Civil Authorities.

 

b. DSCA is DOD support rendered only in the homeland, which relies on the ability of the military commander to integrate DOD capabilities with other resources and capabilities to achieve objectives identified by the requesting civil authorities. Military forces are required to coordinate, integrate, and synchronize their support with other government and nongovernment agencies and organizations. A range of domestic responses is provided by the Active Component (AC) and Reserve Component (RC), which includes the NG.

 

The terms homeland security (HS), HD, and DSCA are distinct operations.

 

a. HS is a concerted national effort to prevent terrorist attacks within the US; reduce America’s vulnerability to terrorism, major disasters, and other emergencies; and minimize the damage and recover from attacks, major disasters, and other emergencies that occur. HS is an integral element of a broader US national security and domestic policy. Protecting the US from terrorism is the cornerstone of HS.

 

(1) HS describes the intersection of evolving threats and hazards with traditional governmental and civic responsibilities for civil defense, emergency response, law enforcement, customs, border control, and immigration (see Figure I-1).

 

(3) The President of the United States is uniquely responsible for the safety and security of the nation. The President leads the overall HS policy direction and coordination. United States Government (USG) departments and agencies, in turn, are empowered by law and policy to fulfill various aspects of the HS mission. DHS has the mission to:

 

(a) Prevent terrorism and enhance security,

(b) Secure and manage US borders,

(c) Enforce and administer immigration laws,

(d) Safeguard and secure cyberspace,

(e) Ensure resilience to disasters, and

(f) Mature and strengthen the HS enterprise.

 

Joint Publication 3-27 titled: Homeland Defense.

 

(1) Posse Comitatus Act (PCA). The PCA prohibits the use of the United States Army (USA) and United States Air Force (USAF) to participate in civilian LE within the homeland. Title 10, USC, also directs SecDef to promulgate regulations prohibiting members of the USA, United States Navy (USN), USAF, and United States Marine Corps (USMC) from providing direct assistance to civilian LE, which was accomplished in Department of Defense Instruction (DODI) 3025.21, Defense Support of Civilian Law Enforcement Agencies. HD is a Constitutional exception to the PCA. Military operations conducted as HD are not LE activities, and thus, Title 10, USC, forces are not subject to the restriction of the PCA. Additionally, several Act-of-Congress exceptions to the PCA permit the Armed Forces to support LE activities under other conditions. The PCA does not apply to NG forces under Title 32, USC, or state active duty status.

 

Read that again:

 

HD is a Constitutional exception to the PCA. Military operations conducted as HD are not LE activities, and thus, Title 10, USC, forces are not subject to the restriction of the PCA. Additionally, several Act-of-Congress exceptions to the PCA permit the Armed Forces to support LE activities under other conditions.

 

Homeland Defense is a Constitutional EXCEPTION to the Posse Comitatus Act.

 

Homeland Defense are NOT Law Enforcement activities, and thus, Title 10, United States Code, forces are NOT subject to the restriction of the Posse Comitatus Act.

 

JP 3-28 again:

 

The military response to events that require DSCA will be a coordinated effort between the NG in state active duty or Title 32, USC, status and Titles 10 and 14, USC, USCG forces.

 

b. Applies to the Army National Guard and the Air National Guard (hereafter referred to collectively as the “National Guard”) personnel when under Federal command and control.

t. DoD personnel and National Guard personnel in Title 32 status will not conduct operations at polling places and must strictly refrain from activities similar to those prohibited by sections 592-594 of Reference (ac).

 

Since 2018, the National Guard has reported the Cybersecurity teams have conducted operations with the 2018, 2020, 2022, and 2024 Elections.

d. Psychological Operations and Public Affairs

 

(1) PSYOP are used to influence the attitudes, opinions, and behavior of foreign TAs in a manner favorable to US objectives.

 

(a) PA and PSYOP activities are separate and distinct, but they must support and reinforce each other, which requires coordination, synchronization, and occasionally deconfliction.

Department of Defense (DoD) policy makes available timely and accurate information to the public, Congress, and the news media to assess and understand the facts about national security and defense strategy. DoD Directive (DoDD) 5122.055 delineates principles of information that apply in supporting the DoD policy. In the context of military activities and operations across the competition continuum, PA provides an essential capability to commanders. Specifically, PA provides commanders with the means to leverage an understanding of how information impacts relevant actors' perceptions, attitudes, and decision-making processes to affect their behaviors in ways favorable to mission objectives. This capability mainly occurs through inform activities which include releasing accurate information to put activities and operations in context, facilitating informed perceptions about those operations, and countering adversarial misinformation, disinformation, propaganda, and other influences. These activities aid the understanding, trust, and support of the US, allies, and partners while also acting to deter, dissuade, and otherwise influence adversaries and relevant actors. PA facilitates an honest, transparent, and candid dialogue between military leaders and their personnel and between the DAF and the American public.

IAW DOD policy, unless specifically authorized by law, no DOD personnel in a Title 10, USC, status will become involved in direct civilian law enforcement activities, including, but not limited to, search, seizure, arrest, apprehension, stop and frisk, surveillance, pursuit, interrogation, investigation, evidence collection, security functions, traffic or crowd control, or similar activities, except in cases and under circumstances expressly authorized by the President, Constitution, or act of Congress.

 

  1. Direct Assistance to Civilian Law Enforcement Agencies a. Permissible Direct Assistance

 

(1) Military Purpose.

 

There are several forms of direct assistance to civilian law enforcement by military personnel that are permitted under the Military Purpose Doctrine. The Military Purpose Doctrine provides that law enforcement actions that are performed primarily for a military purpose, even when incidentally assisting civil authorities, will not violate the PCA. The Military Purpose Doctrine requires a legitimate, independent military purpose for participating in law enforcement activities against civilians.

 

Use of the Armed Forces for Domestic Law Enforcement:

 

The PCA only prevents use of the Armed Forces to execute civilian laws. It does not limit the authority to perform military duties and has no impact on a commander’s ability to ensure good order and discipline of the commander’s unit or installation.

39 Time and time again, courts have determined that as long as the primary purpose of an activity is to address a military purpose, the PCA is not violated, even if civilian law enforcement incidentally benefits. This is referred to as the “military purpose doctrine.

 

The PCA: “Expressly Authorized by the Constitution”

 

The PCA does not prohibit direct assistance to civilian law enforcement if such assistance is “expressly authorized by the Constitution.”

 

If the Constitution authorizes the use of military force, the PCA cannot prohibit its use. This type of authorization is extremely limited and can be somewhat controversial since, as discussed above, the authority to use military forces in a domestic setting is based upon competing powers granted by the Constitution to the President and to Congress.

 

(1) Such activities are necessary to prevent significant loss of life or wanton destruction of property and are necessary to restore governmental function and public order; or,

 

(2) When duly constituted Federal, State, or local authorities are unable or decline to provide adequate protection for Federal property or Federal governmental functions.

 

Federal action, including the use of Federal military forces, is authorized when necessary to protect the Federal property or functions.50 Presidential approval is required prior to providing this type of support unless the extraordinary circumstances preclude obtaining prior authorization.

 

The PCA does not prohibit direct assistance to civilian law enforcement if such assistance is “expressly authorized by an Act of Congress.

 

All it requires is some sort of concerted effort, such as an “unlawful combination, or conspiracy,” that makes it “impracticable to enforce the laws of the United States in any State by the ordinary course of judicial proceedings” (§332), or deprives any part of the citizenry of a “right, privilege, immunity, or protection named in the Constitution” or “opposes or obstructs the execution of the laws of the United States” (§333).

 

Before the President uses any of the authority delegated to him by the Insurrection Acts, Section 334 requires him to issue a proclamation ordering the insurgents to “disperse and retire peaceably to their abodes within a limited time.”

When acting pursuant to any of these exceptions, military personnel are allowed to engage in direct law enforcement, essentially serving as a national police force.

 

Examples of other exceptions where Congress has authorized the use of military forces include emergency situations involving chemical or biological weapons of mass destruction, removal of trespassers from Indian treaty lands, removal of unlawful enclosures from the public lands, and the execution of state quarantines and health laws.

 

True to this tradition, during the past several decades the Armed Forces have not participated significantly in civil law enforcement other than the counter-drug and border security missions.

 

This article does not advocate for more military involvement in domestic law enforcement. However, since it is an official mission of the Armed Forces, supported by historical precedence and authorized by the Constitution, Soldiers, Sailors, Marines, and Airmen must be trained and ready to support domestic law enforcement just as they would any other mission assigned to the DOD. But they must do so with the additional caveat that such missions can be controversial and politically sensitive.

 

Conclusion

 

The Armed Forces have always engaged in domestic law enforcement. Providing support to civil law enforcement is a legitimate, lawful mission authorized by the Constitution and supported by precedent. Leaders must embrace it, understand it, and when called upon, execute it correctly. A key part of understanding it is understanding the PCA. The PCA does not prohibit all use of military forces for domestic law enforcement.

This oversight includes incident awareness and assessment (IAA) activities and products. No intelligence activities should take place while conducting DSCA unless authorized by appropriate authorities IAW EO 12333, United States Intelligence Activities; DODD 5240.01, Defense Intelligence Activities; DODM 5240.01, Procedures Governing the Conduct of DOD Intelligence Activities; DODI 3025.21, Defense Support of Civilian Law Enforcement Agencies; and DOD 5240.1-R, Procedures Governing the Activities of DOD Intelligence Components that Affect United States Persons.

a. The District of Columbia, a federal district, is unique. Although the District of Columbia has an NG, the District of Columbia has no governor. Instead, the District of Columbia NG reports to the President of the United States.

The most recent amendment to Title 50 is from December 20, 2019, Chapter 33 Section 1550 which has the clause about the first 180-days after Dec. 20, 2019.

 

Who was the President on December 20, 2019, again?

 

In that first 180-days: Executive Orders 13912, 13913, and 13919 were signed plus Proclamation 9994 which was a verbal National Emergency that invoked the Stafford Act.

 

These publications also talk about Biological Weapons (which is what Covid was used as - a retaliation move by the deep state hence how Fauci knew for sure per his speech on January 12, 2017, that the next administration would experience a pandemic).

 

EO 13913 ties into EO 12333.

 

EO 12333 about Assassinations, ties into President Trump's Supreme Court filing 23-939 filed March 19, 2024, on the docket.

 

EO 13912 Federalized up to 1 Million Reserve Components to Active-Duty.

 

EO 13919 authorized equal authority for the Secretary of Defense to Federalize Selected Reserves to active-duty.

 

Both of those are still active and have not been revoked.

The continuation orders by "Biden" are not posted on the Federal Register where they're supposed to be published.

Also in Title 50, it mentions Regular AND Irregular Forces. Irregular Forces is Title 50.

 

Executive Order 13919 mentions the Counternarcotics Operation in the Western Hemisphere which was launched on April 1, 2020, in the same first 180-days, alone, which I guess explains Russia busting cartels trafficking drugs as recently as December 2024, from Colombia.

 

On the United States Southern Command who is the command of that war on trafficking, the website says Colombia is a partner (one of 22), but also says, 50% of the trafficking comes from partner forces territory.

 

Remember President Trump's tweet and comments on January 6, 2021, to the crowd, about going back home?

EO 13912 Federalized up to 1 Million Reserve Components to Active-Duty. It's also the EO that invoked 4 sections of Title 14, the USCG.

 

In EO 13912 and 13919, Title 10 were invoked, 12302 and 12304, which are Reserve Components. Reserves only serve ONE mission: Federal not state.

 

Those Orders have not been revoked, terminated, or resolved which means they're still active. But just because people think "Joe" is real does not mean "he's" president. A Presidential Emergency Action Document allows a President to extend his power which means term(s).

 

A PEAD = Executive Orders, National Emergencies, and Proclamations.

 

"Biden" has continued 11 Executive Orders with 11 National Emergencies signed and declared by President Trump 2 years in a row and has continued 8 Executive Orders with 8 National Emergencies signed and declared by President Trump 4 years in a row… but none of them are published on the Federal Register dot Gov where they're supposed to be publicly posted, by LAW.

 

I guess that also explains why there's no White House Military Office for "Joe" which also explains why the most recent WHMO Archives that pulls up on SEO Google is Obama's. Where's the President Trump Archive site for the WHMO?

 

And on January 20, 2021:

What took place on January 20, 2021, more than proves J6 is not a concern, it's all part of the whole Military Operation. It will be unveiled and accounted for in History.

 

It does NOT matter that every "Inauguration" has the Wreath Laying Ceremony at Arlington. Every other President before "Biden" was given 4 Cannons 21 Rounds which is the 21-Gun Salute by definition.
