Despite New York Post Phone Call, Question and Answer, Donald Trump Companies Do Not Use H1B Visas

1/2

December 29, 2024 | Sundance |

When I read the New York Post article proclaiming that President Trump supports the fraudulent system known as H1B visa hiring, I knew something was amiss because we previously looked at Trump’s various business hires and use of the visa process.

Apparently, the NY Post called President Trump to get him to weigh in on the controversial subject that has been triggered by Elon Musk saying he would “go to war on this issue” to maintain the H1B visa system -and subsequent foreign employment for tech skilled workers- his various companies depend upon.

Here’s the topline takeaway from the article that has triggered many:

(NY POST) President-elect Trump told The Post Saturday he supports immigration visas for highly skilled workers, appearing to side with Elon Musk in the roiling intra-MAGA debate on the issue.

“I’ve always liked the visas, I have always been in favor of the visas. That’s why we have them,” Trump said by phone, referring to the H-1B program, which permits companies to hire foreign workers in specialty occupations.

“I have many H-1B visas on my properties. I’ve been a believer in H-1B. I have used it many times. It’s a great program,” added Trump, who restricted access to foreign worker visas in his first administration and has been critical of the program in the past. (more)

However, if you go to the Dept of Labor website, search or download the database of H1B employment, specifically filtering to Trump’s various companies, what you will discover is that Trump Inc doesn’t use the H1B visa system at all. [Check for Yourself Here]

How does this reconcile? Well, having previously looked at the visa use by President Trump in his various companies {SEE HERE}, I can confidently assert (Occam’s Razor) that within the interview President Trump conflated H2B temporary worker visas, which he does use in his service industry, with H1B visas which he does not use.

The H-1B program applies to employers seeking to hire nonimmigrant aliens as workers in specialty occupations of distinguished merit and ability. At least that was the intent of the program before it was abused by companies who saw the opportunity to avoid domestic market wages and find alternative cheap sources of skilled labor in the tech sector. That abusive ‘labor diversion’ process has now expanded to find H1B claims in other sectors. So much so, there are now a myriad of companies requesting H1B status employees for their various interests.

The H2B program applies to employers seeking to hire nonimmigrant aliens as “temporary workers” mostly in the service industrywhere extreme seasonal fluctuations in business make it challenging to hire from a very limited market base. H2B workers are found in hotels, resorts, restaurants and service companies anywhere you find big seasonal shifts in service businesses, like Trump resorts.

As previously noted, Does the word “Snowbird” ring a bell? Florida has a “tourist season” which runs from (generally speaking) just after Thanksgiving to Easter annually. January, February and March are the peak. The first Monday in February is the absolute peak as almost every time-share and hotel unit flips that week.

The volume of work within the service and hospitality industry doubles during the tourist season, and those businesses who hire within the general labor market struggle to increase their labor in relationship to the increase in business. In addition, local workers looking for employment are reluctant to take temporary or “seasonal” jobs, and prefer longer term -more stable- employment.

Many businesses need to double, or in some cases triple, their workforce in order to meet the business demand. As a consequence, many companies, including Trump owned resorts, have used H-2B visa workers to fill the gap between large fluctuations in business and the needed staffing shortfalls. From my own experience, many of the workers are students from South America (Argentina, Brazil, etc) who take the seasonal jobs Nov/Dec – March/April between their college seasons – and then return home.

Bottom line – President Trump is referencing H2B visas which he does use, and not H1B visas which he does not use.Whether President Trump conflated the issue, or whether the Murdoch owned New York Post intentionally constructed their questioning to create a clickbait controversy, is entirely up to the reader to determine. I think it’s likely a combination.

♦ All of that said, the issue of H1B replacement workers displacing American workers is not going away regardless of how uncomfortable it makes the Silicon Valley crowd. Many highly skilled Americans have been impacted by the issue of H1B replacement, and the inherent fraud within the special interest employment system is a critical issue for a large percentage of the MAGA base.

In fact, for context you might remember the 2017 Trump suspension of visas from Muslim countries. In response to that suspension, the state of Washington filed a lawsuit against President Trump seeking an injunction to continue the visas. The main subject of their opposition was the financial impact to Microsoft and the H1B visa use.

BYRON YORK, 2017 – “Why is Washington State mounting such a vigorous challenge to President Trump’s executive order temporarily suspending non-American entry from seven terrorism-plagued countries? Of course there are several lawsuits against the president, and there are lots of motives among the various litigants. But Washington State’s is the suit that stopped the order, at least temporarily. And a look at the state’s case suggests that, behind high-minded rhetoric about religious liberty and constitutional protections, there is a lot of money at stake.

Judging by the briefs filed by Washington State, as well as statements made by its representatives, some of the state’s top priorities in challenging Trump are: 1) To ensure an uninterrupted supply of relatively low-wage H-1B foreign workers for Microsoft and other state businesses; 2) To ensure a continuing flow of high-tuition-paying foreign student visa holders; and 3) To preserve the flow of tax revenues that results from those and other sources.

[…] Washington State argued that its residents have suffered from the Trump order, or might suffer in the future, because some of the state’s biggest businesses rely on H-1B visas, which are often used to bring foreign workers to U.S. companies at lower wages than their American counterparts.

“The technology industry relies heavily on the H-1B visa program,” the Washington State lawsuit said. “Microsoft, a corporation headquartered in Redmond, Washington, is the state’s top employer of high-tech — or H-1B visa holders and employs nearly 5,000 people through the program. Other Washington-based companies, including Amazon, Expedia, and Starbucks, employ thousands of H-1B visa holders.” (link)

Vivek Ramaswamy, David Sacks, Elon Musk (with his influencers) and the tribe in/around Silicon Valley, have placed their flag of influence on this H1B hill. They are willing to do whatever it takes to retain this system, much to the angst of the MAGA supporters who have been victimized by it.

When a system has been so thoroughly corrupted as to now create harm, there should not be a great deal of controversy in suspending that system until the market can correct itself. However, losing control of the H1B visa system is viewed by the Silicon Valley tech group as a non-starter position.

It will be interesting to watch how Silicon Valley’s ally, JD Vance – a political entity wrapped in the cover of Hillbilly values, reacts to this H1B visa and immigration debate.

As we watch the arguments inside the H1B debate, it is worth remembering the =group who promoted, pushed and ultimately influenced the JD Vance nomination consisted of: Charlie Kirk, Tucker Carlson, Elon Musk, Peter Thiel, Bill Ackman, David Sacks, Chamath Palihapitiya, Jacob Helberg and of course, Vivek Ramaswamy.== On the inside of the Trump orbit, the network had Donald Trump Jr also promoting JD Vance.

JD Vance was then invited to be an attendee at the June 6th San Francisco fundraiser for President Trump, hosted by Sacks and Palihapitiya, and that’s likely when the first one-on-one running mate discussion between President Trump and Senator Vance took place.

Usha Chilukuri Vance, the wife of Ohio Senator J.D. Vance, quit her job as a corporate litigator at DNC-affiliated Munger, Tolles & Olson, within minutes of hearing that JD had been selected as President Trump’s Vice-President nominee and running mate. Usha Chilukuri-Vance worked in Washington DC for the firm.

The American workers who Silicon Valley advocate for replacing with foreign workers, are the proverbial “Saxons, with nothing to lose.”

The Big Tech group may not have initiated the background; in fact, the offshoring and replacement cycle was started many years before. However, when you strip a group of Americans of their value, label them, ostracize them, ridicule them, belittle them and then denigrate them for failing to support your abuse, think “rust belt”, you create a group of Americans with nothing left to lose.

Calling people “racist” and “nativist” who voted for President Trump specifically on this issue is not going to work. Musk et al should be very aware that this H1B debate is targeting the “nothing left to lose” American team.

If they think their immigration position is both zero-sum and survivable, think again. There is much for them to lose. The true zero-sum position is already held by a much bigger tribe of American workers who truly do have nothing left to lose.

Silicon Valley ends up fighting an army that will never concede because they have already been stripped of everything they hold dear.

Beware the wrath of the angry Saxon. This immigration topic is Musk, Ramaswamy and Sacks’ first trip into what they call ‘flyover country.’ They are experiencing strong MAGA pushback, something very new and uncomfortable for them, likely for the first time; hence, their emotional reactions.

We understand the UniParty is smiling as they see us debating this issue;however, if Making America Great Again doesn’t benefit working Americans, then what exactly is the point.

Thx, I feel exceptionally concerned for Europeans, as your states elevate and smash the illegal and legal migrants in your face, and treat them in a much more kind way. The illegals rarely get punished for crimes, while the citizens get punished for normal speech, anything to the EU is a threat, but not migrants. And the EU is limiting free speech when the public addresses how unfair, and truthfully financially stupid, aiding and abetting non citizens is. It's disgusting really, and the US is close to that, but Thank God, PDJT got elected.

Hopefully when Trump and the American citizens save America, it will spread like fire over the world.

Good comments, but if they want to being in the best and brightest, the companies should be required to pay them equal to an American, then we'll see if "the best and brightest" is really what they want.

I had a tech company owned by American Citizens. They hired almost 80% of their workforce.

I asked them how the H1B system worked, they said the Dept of Labor required to pay them at a minimum $60,000, so that's what they did regardless of their skillsets, but it was true all the Indians brought in their family only to work for their green card.

So all the people that apply to be citizens without H1B, wait in line and go through a long process, 8-10+ years. So the Visas have been used to skirt around legal citizenship requirement.

I has an Private School that imported at least 1/2 their employees from Turkey, they did something worse on salary. They also were required a minimum pay, I think $40,000. But the school required them to give them back some of the money, because it was mostly set up to get them citizenship. That was obvious because as teachers, the had little skills to speak the English language. That boggled my mind until I found out the trick.

So their be tests on all who bring in the H1B visas, that they are at least more qualified; but they don't because its all about cheap labor. Not so for O1B visas, if they are truly the Best and Brightest.

Musk admitted it, bottom line, saving money by lower salaries. As far as "super motivated" he's expecting Americans to be happy receiving less pay than the economy gives. He's saying "be happy you've got a job when I pay less then the going rate.

A big reason why Tesla is built in China, he has slave wages workers. Same with Apple.

"But hell, be happy and super motivated, at least you've got a job!"

This whole fight will come to a head soon, it will piss off a lot of MAGA if not rectified. So one thing is sure, the corrupt VISA system and the criminals that abuse it, needs to be fixed, for good!

The coloring outside of the lines that the Indian and Chinese at the companies, if what they did is found out, they'll blame it on the foreigners and deport them, is my guess.

If truly the best and brightest I also can see the need, but the system has to be fixed and educational systems should be accelerating it in all schools. Stem learning is actually producing some excellent students. Unless our schools go back to teaching the basic and accelerated learning, and kick out ideology, children will be intentionally under educated. Our school systems used to produce the best and brightest, but the Marxist/Communists took over fully in the early 70s. They actually started doing this in the 40s. The president that set up public schools in the early 1900s, was only to educate them for manufacturing, physical labor. But they found out the low class was too smart so they started dumbing down America. And the Marxists took it from there.

If there was a #1 goal for this Admin, it would work on the Education System, and go back to the extensive course taught in the 1880s. The requirements for education in all courses were much higher than.

Now we have states that eliminate math and science and other courses, making victims and permanent social welfare. Schools are implementing how to train students to be victims of the systems, and to become

revolutionaries to fight against American values.

This is really a good discussion to have, because its not only tech that manipulates the system, but every other large company.

Also the Admin should eliminate competing laws on the same subject. Then there's opposite federal laws and state laws. Congress in states and fed shouldn't make more laws but go back in history and remove the ones that are shit, they'll find out probably 50% are useless or haven't been applicable for years.

One last thing; at the very least congressmen should have a better education. A lot if them are shockingly stupid!

So true, they've been at this for decades, where it's different, two people very close to Trump showed their disdain for American citizens; and stupidly tried to lecture us that tech is too complex for Americans and they had to import them. That can be true at times, but not always. Musk made it clear, a major motivation was paying less money.

Both of them addressed this in such a barbarian way, that to me at least, I'm back thinking Musk is not a benevolent guy, and Vivek's arrogance, just shows, that he as an Indian, is better educated and we are not. Vivek made the biggest mistake, that he would arrogantly condemn American Culture. And neither addressed the H1B visa is never the "best and brightest", this system just lets more in. The O1B is for the best and brightest and I bet they get equal wages as Americans.

The stupidest thing they did is reveal paying lower wages was the most compelling reason. "Super Motivated and Super Worker" Americans are when they love their job, but the foreigners only have that because they are making more money in their poor countries, and they'll do it for the green card. Plus back in India they work longer hours. So Vivek showed he has very little diplomacy or social skills in a fraught situation.

So Sundance is right the Uni Party is enjoying this, hoping it fractures the base. BTW, I think it!/ clear Loomer got into this because she does not have a seat at the table, she turned it into a fight at higher decibels. She should not be involved at all. She's got a serious mental illness, but she's influential. Her rage machine is tiresome.

This is definitely a war against the American worker by these tech and large company's and both of them basically admitted it.

They both worry me they are around and influential on Trump, the biggest problem in the last Admin, many close to Trump lied to him and manipulated him, causing real problems.I hope Ben Carlson is consulting Trump on this, because he would be the only one I'd trust to give him sound and enlightening counsel.

‘Yellowstone’ Actor Sees Shift in Hollywood ‘There’s a Tide of Change Going on Right Now’ (Video)

by Margaret Flavin Dec. 29, 2024

Yellowstone’ actor Neal McDonough joined Fox News to talk about his new film with Angel Studios and the shifting tides in Hollywood.

The father of five credits his faith for helping him navigate tough times as an actor after he claims he was blacklisted from the industry in 2010 for refusing to agree to on-screen sex scenes.

During a recent the importance of storytelling with Will Cain of ‘Jesse Watters Primetime,’ he had hopeful words for those who have been turned off by Hollywood’s constant and exhausting push of the woke agenda.

Will Cain: Actor Neal McDonough joins me now. Neil, great to see you. Of course, ‘Yellowstone’ is a Taylor Sheridan show. Another one, ‘Landman,’ out right now. There’s a scene in ‘Landman,’ Neal, a speech where he gives about the power of oil and gas versus wind and how everything in our world revolves around the production of oil. If nothing, Neal it’s unique.

Neal McDonough: Well, there’s something about what Taylor Sheridan is doing, and Will, you hit on something. It’s just being pro-American in our approach to our filmmaking. I think Taylor has done it better than anyone. Even on ‘Tulsa King,’ we had such a great time talking about the heartland of America this year. But what I do miss, I have to admit on a side note, I miss you sparring with Stephen A. Smith so much, I can’t even tell you. Those were the days I loved watching you on ESPN. It was great. But if you’re right, though.

Will Cain: I watched Tulsa King. To know that the guy in Tulsa King is telling me that he used to watch me on first take. That’s very flattering. Thank you, Neal.

Neal McDonough: That’s right. No, exactly. But It just seems like there’s a tide of change going on right now in Hollywood. I’m fortunate because my wife, Ruvé and I, we get to produce all of our films for Angel Studios, which is just an incredible machine that they have. Our film, ‘Homestead,’ came out this last weekend. It’s doing very, very so thank you everyone for your support.

The more you support films like this that actually talk about the family, talk about issues that the whole family can sit around the theater and watch and have a discussion after. If you like those types of films, please keep supporting what the Ewrin Brothers are doing, the Kendricks are doing, Dallas Jenkins doing, everyone at Angel is doing. There’s a movement going on, and I’m just so blessed that we get to be part of it.

Will Cain: I haven’t had a chance to see yet, but I’ve heard great things, by the way, about Homestead. The thing about it is, if you’re interested in being a storyteller, how rich What a rich environment to mine stories from, Americana, America.

Neal McDonough: Well, it’s funny. Five years ago, they just came up with a list of all the wants that all the networks want. I want a show like this. I want to show like that. But I would say eight out of ten of them on the list that I just read at the bottom, it says,’ If you have anything with faith-based, we’re very interested this year.’

There’s just a change that’s going on that I love because these films are turning profits. We keep the prices down. The advertising isn’t as much as you have with a big studio film, but the word of mouth through our Angel Films has really just caught on so well, and it’s building such a fan base that I just love that we’re part of it and Ruvé get to keep on making, the two of us get to keep making for Angel Studios. We have our next one, The Last Rodeo, which comes out in May that we’re very proud of that I wrote.

According to their website, “Angel Studios is a free, community-supported streaming platform offering exceptional movies, shows, and documentaries for all ages. Enjoy unlimited access to our award-winning, viewer-supported entertainment designed to inspire, uplift, and unite through meaningful storytelling. Each Angel Studios title is voted for and refined by the Angel Guild, our body of members that decides which films and shows are distributed by Angel Studios. Because of the Angel Guild, our films are produced and seen for free by millions of people.”
