Trump could be sworn in by anybody. Supreme Court Justice is not necessary it just looks pretty for us and makes them feel important in the process. Trump could be sworn in and We The People have spoken. All States have done their final duty and sent the certificates addressed to the President of the Senate ( Kamala) Jan 3rd Grassley will become President Pro Tem and if Kamala doesn't open a joint session with a full quorum of both chambers, Grassley can. It doesn't even have to wait until Jan 6. They start the 3rd in a Joint session, it can be done then.

Bottom line is, the Military has to take orders from a duly elected President and at 12:01 Jan 20th it is Trump not Bidden. Trump can decide if he wants to continue Biden's national emergency. Any military personnel doing otherwise would face court martial for treason
