All States have done their final duty and sent the certificates addressed to the President of the Senate ( Kamala) Jan 3rd Grassley will become President Pro Tem and if Kamala doesn't open a joint session with a full quorum of both chambers, Grassley can. It doesn't even have to wait until Jan 6. They start the 3rd in a Joint session, it can be done then.
Bottom line is, the Military has to take orders from a duly elected President and at 12:01 Jan 20th it is Trump not Bidden. Trump can decide if he wants to continue Biden's national emergency. Any military personnel doing otherwise would face court martial for treason
