Help us write a bill to ban the shots. I’ve had multiple legislators asking for a model to work off. Here’s a start:
Section 1: Title
This Act shall be known as the “COVID-19 Vaccine Ban & Accountability with Justice Act (VBAJA).”
Section 2: Congress finds the following:
-
COVID-19 vaccines authorized under Emergency Use Authorizations (EUAs) were distributed without sufficient long-term safety testing, resulting in documented adverse effects.
-
The Public Readiness and Emergency Preparedness (PREP) Act provided blanket immunity to vaccine manufacturers, shielding them from liability despite reports of harm to individuals.
-
Existing programs, such as the Vaccine Injury Compensation Program and Countermeasures Injury Compensation Program, have proven inadequate to address claims arising from COVID-19 vaccine injuries.
-
There is a compelling interest to revoke EUAs, prohibit future use of these vaccines, and establish a robust, transparent fund to ensure victims and survivors are adequately compensated.
-
All existing stores of experimental vaccines must be destroyed in a manner that protects public safety, ensures compliance, and is subject to strict oversight.
Section 3: Revocation of Liability Protections
-
Repeal of PREP Act Protections:
• Section 319F-3 of the Public Health Service Act (PREP Act) is amended to revoke liability protections for manufacturers, distributors, and administrators of COVID-19 vaccines.
• Retroactive Application: This repeal applies to all claims arising from injuries or deaths caused by COVID-19 vaccines, regardless of the date of administration.
-
Restoration of Civil Actions:
• Injured parties are granted the right to bring civil lawsuits against manufacturers, distributors, and other responsible entities for damages resulting from the production, distribution, or administration of COVID-19 vaccines.
Section 4: Revocation of EUAs and FDA Approvals
-
Immediate Revocation:
• The Emergency Use Authorizations (EUAs) for all COVID-19 vaccines are revoked upon enactment of VBAJA.
• Any full approvals granted under the Federal Food, Drug, and Cosmetic Act for COVID-19 vaccines are hereby rescinded.
-
Prohibition:
• The manufacture, distribution, sale, or administration of COVID-19 vaccines is prohibited nationwide.
• Exceptions: Exceptions may be granted strictly for scientific research purposes under comprehensive regulatory oversight.
-
Destruction of Vaccine Stores:
• All existing stores of experimental COVID-19 vaccines must be destroyed using proper methods to ensure public safety.
• The destruction process shall be supervised by: The Food and Drug Administration (FDA).
- A qualified, approved ombudsman committee appointed for this purpose.
• Certificates of compliance for the destruction of vaccine stores must be issued under joint supervision by the FDA and the ombudsman committee.
• All protocols for vaccine destruction must:
-
Be submitted in writing to the FDA, Centers for Disease Control and Prevention (CDC), and the ombudsman committee within 30 days of VBAJA’s enactment.
-
Adhere to standards ensuring environmental and public health safety.
-
Enforcement:
•Violations of these requirements shall result in penalties, including fines of up to $10 million per infraction and potential criminal liability for corporate executives.
Section 5: Creation of the COVID-19 Victims and Survivors Fund
(This section remains unchanged from the previous draft, including the establishment of a $5 billion perpetual fund, eligibility criteria, administration, and reporting requirements.)
Section 6: Public Transparency and Reporting
1.Adverse Event Disclosure:
•Vaccine manufacturers must publicly disclose all adverse event data related to COVID-19 vaccines within 90 days of VBAJA’s enactment.
2.Government Accountability:
•The Department of Health and Human Services shall provide quarterly reports to Congress on the implementation and operation of VBAJA.
