Disciplinary hearings have wrapped up for an Ontario doctor who had her medical license suspended for prescribing ivermectin and hydroxychloroquine and giving patients medical exemptions from COVID-19 vaccines.
In 2021, Dr. Rochagné Kilian raised the alarm about symptoms she was seeing in vaxxed patients. She got in trouble with the College of Physicians and Surgeons of Ontario (CPSO) for providing medical exemptions for the COVID-19 shot, citing the lack of long-term safety data as a critical concern.
The CPSO investigated her and demanded all of Kilian's patient records that had anything to do with exemptions or the prescribing of Ivermectin or Hydroxychloroquine.
Kilian offered to give redacted versions of the records to preserve patient privacy. However, CPSO took her to court to get the full records.
The patients whose files were going to be handed over to the college applied to the court to be an intervenor in the case. They spent their own money to tell the court they did not want their private documents handed over.
After going through multiple levels of court hearings, Kilian recently had her leave to appeal to the Supreme Court of Canada denied. She had to surrender 519 patient records.
The college was stymied in their original investigation by the court cases, so they started a second investigation for failure to comply with the first investigation.
At her hearing on January 22, Kilian based her testimony on the CanMEDS framework, a document outlining the educational and practice standards of Canadian physicians. She used it to argue that her actions as a physician in protecting her patients' privacy and autonomy were completely in line with this document.
Kilian was cross examined by the College's lawyer. According to an email blast by former MP Derek Sloan, this lasted only about 10 minutes. The college gave its closing arguments. On January 23, Kilian's lawyer offered closing arguments.
In an online interview with Sloan posted January 21, Kilian said, "At the end of the day. It doesn't really matter what happens. All I can do is speak the truth and just try to act in integrity…[T]he truth doesn't need defending…."
Kilian says the college ignoring her lawyer's request for a date for a license reinstatement motion for months. When the conflict in Israel and Palestine started, she appealed to the CPSO to reinstate her license so she could travel to the affected areas and provide emergency medical care. This request was denied.
The CPSO suspended Kilian's license three years ago, and refused a filing by her lawyer to overturn this. The lawyer filed for a judicial review of that decision, and the decision awaits until next month.
"If they were willing to cooperate, right in the beginning, this would have been over a long time ago," Kilian said of the CPSO.
Even if her licence is reinstated, Kilian will need to pay $119,000 to the college for their court costs before she gets her license back.
Kilian was born in South Africa and was recruited to work in Canada over 15 years ago. She says Donald Trump's words at his recent inauguration reminded her it's time for truth to prevail.
"For so long, the good guys have not been willing to stand up for principles and truth. There's a shift happening in the world where we're saying, 'No, if we don't do it now, what is going to happen to our children?' Because at the end of the day, it takes each and every single one of us to say we are brave enough. Doesn't matter what the cost, doesn't matter what the sacrifice is," Kilian said.
"Our Savior made the biggest sacrifice already. All of these things that we're going through at this moment is just a minute blip on the radar, but we're standing up for truth, and the truth is worth it at this stage."
