unfortunately it takes a medical opinion and a Judge to rule on someone's mental competency. Until that is done, he is presumed competent. Had they used the 25th on him then it would be resolved by either him proving he is competent by a Doctor ( he would have had 21 days to do it) or him allowing it to remove him from office
