AN ACT Relating to preserving the ability of public officials to
address communicable diseases using scientifically proven measures to
control the spread of such diseases; adding a new section to chapter
70.54 RCW; and declaring an emergency.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec. 1. A new section is added to chapter 70.546
RCW to read as follows:
(1) It is the policy of the state that public health responses to
address communicable diseases be guided by the best available science
on the safety and efficacy of evidence-based measures to control the
spread of such diseases, including immunizations and vaccines.
(2) Consistent with the policy in subsection (1) '''of this section,
the state and local health officials must, within available
resources, implement and promote evidence-based, appropriate measures
to control the spread of communicable diseases, including vaccines.'''
The state and its political subdivisions may not enact statutes,
ordinances, rules, or policies that prohibit the implementation and
promotion of such measures. Any such statute, ordinance, rule, or
policy in place on the effective date of this section is hereby
declared null and void.
