Biden Judge Revises Restrictions on Access to Treasury Payment System – Keeps Ban on DOGE in Place; Treasury Leadership Exempted
A federal judge on Tuesday revised the restrictions on access to the Treasury’s payment system.
As previously reported, corrupt Obama Judge Paul Englemayer on Saturday issued an ex parte Temporary Restraining Order (TRO) forbidding all of Trump appointees, including Treasury Secretary Scott Bessent, from accessing Department of Treasury data in response to a lawsuit filed by 19 Democrat state attorneys general.
The case was ultimately assigned to a Biden judge for a decision.
US District Judge Jeannette Vargas, a Biden appointee, responded to the Trump Admin’s emergency motion to dissolve, clarify or modify Englemayer’s ex parte TRO.
The Trump Admin argued in their motion papers that “the TRO contravenes Article II of the Constitution to the extent it applies to political appointees, in particular the Secretary of Treasury and other senior Treasury leadership.”
Judge Vargas kept most of the restrictions in place, but she allowed Secretary Bessent and other in Treasury leadership to access the payment system.
As if a judge is allowed to restrict the Treasury Secretary from accessing treasury data.
“There is nothing in the record to indicate that, prior to January 20, 2025, any statute, regulation, or agency policy prohibited the Secretary of Treasury or any other Senate-confirmed officer within the Treasury Department’s senior leadership from accessing any Treasury Department payment record, payment systems, or any other data systems maintained by the Treasury Department containing personally identifiable information and/or confidential financial information of payees,” Judge Vargas wrote in an 8-page order reviewed by The Gateway Pundit.
Judge Vargas however, kept intact the ban on DOGE workers from accessing the Treasury Department’s payment system and data.
“However, to the extent that Defendants seek to eliminate the TRO’s restriction on access by “political appointees” more broadly, Defs. Mem. at 5-6, the Court denies the motion,” Judge Vargas wrote.

Vargas was recommended to the Biden administration by Senator Kirsten Gillibrand.[4] On March 20, 2024, President Joe Biden announced his intent to nominate Vargas to serve as a United States district judge of the United States District Court for the Southern District of New York.[3] On March 21, 2024, her nomination was sent to the Senate. President Biden nominated Vargas to the seat vacated by Judge Paul G. Gardephe, who assumed senior status on August 9, 2023.[5] On April 17, 2024, a hearing on her nomination was held before the Senate Judiciary Committee.[6] On May 9, 2024, her nomination was reported out of committee by an 11–10 party-line vote.[7] On September 10, 2024, the United States Senate invoked cloture on her nomination by a 52–43 vote.[8] Later that day, her nomination was confirmed by a 51–43 vote.[9] She received her judicial commission on November 6, 2024.[10]
