A court ruling has paved the way for President Donald Trump’s lawsuit against CBS and its parent company, Paramount Global, to move forward.
U.S. District Judge Matthew J. Kacsmaryk dismissed CBS and Paramount’s motion to throw out the case as “moot,” following significant updates to the original complaint. The updates include adding Paramount Global as a co-defendant, introducing Representative Ronny Jackson (R-TX) as a co-plaintiff, and boosting the damages sought to a staggering $20 billion.
The court cited precedent stating that an amended complaint supersedes the original complaint, rendering prior motions to dismiss ineffective. The amended complaint introduces additional parties and expands the factual and legal claims.
The lawsuit stems from the controversial “60 Minutes” interview with then-Vice President Kamala Harris that aired in October. Trump’s legal team accuses CBS of “news distortion,” alleging the network edited Harris’s responses to unfairly tilt public perception in her favor during the 2024 Presidential Election.
CBS has countered these claims, insisting that all edits were purely for clarity and brevity, consistent with established journalistic practices. In an effort to address the accusations and an ongoing investigation by the Federal Communications Commission (FCC), CBS made the unedited transcripts and footage of the Harris interview publicly available.
The FCC is currently analyzing these materials to assess whether CBS breached its “news distortion” policy. Reports suggest that Paramount Global is contemplating a settlement to sidestep further regulatory fallout, particularly concerning its anticipated merger with Skydance Media.
News distortion involves manipulating or misrepresenting information in news reporting, leading to public misinformation. This manipulation can occur through various methods, such as selective editing, where context is removed or footage is selectively edited to mislead viewers or alter the narrative.
Factual errors, whether unintentional or deliberate, biased reporting that unfairly favors one side of an argument, and the omission of important facts or perspectives can all distort news. These practices can undermine trust in the media and affect public perception of significant issues, making adherence to ethical standards and guidelines crucial for news organizations to maintain credibility.
The raw footage of the 60 Minutes segment showed that many of Harris’s detailed answers were heavily trimmed for the televised segment. For example, a comprehensive 179-word response about Israel was cut down to a mere 20 words.
CBS justified these edits by explaining that it is standard practice for journalists to condense interviews to save time, manage space, or enhance clarity. Interviewer Bill Whitaker asked whether Israeli Prime Minister Netanyahu is “listening” to the Biden-Harris administration.
“Well, Bill, the work that we have done has resulted in a number of movements in that region by Israel that were very much prompted by, or a result of, many things including our advocacy for what needs to happen in the region,” Harris said in a preview for the “60 Minutes” interview.
In the interview that aired, the vice president said, “We are not gonna stop pursuing what is necessary for the United States to be clear about where we stand on the need for this war to end.”
