Pattern or Practice of Knowingly Hiring: If an employer engages in a “pattern or practice” of knowingly hiring or continuing to employ undocumented workers, they face:

 

  • Fines: Up to $3,000 per unauthorized worker (This is as high as $20,000 per illegal in some areas)

  • Jail Time: Up to 6 months in prison for the entire pattern or practice.

  • This applies when hiring, recruiting, or referring for a fee someone known to be unauthorized, or continuing their employment after learning they’re undocumented. The key is intent—isolated mistakes don’t count; it’s about regular, intentional acts.

 

Hiring 10 or More with Knowledge: Under 8 U.S.C. § 1324(a)(3)(A), added in 1996, if someone knowingly hires at least 10 undocumented individuals within a 12-month period, with actual knowledge they’re unauthorized:

 

  • Penalty: Up to 5 years in prison, a fine under Title 18, or both.

  • This is a felony, aimed at large-scale violators, often tied to smuggling or trafficking.

  • Harboring or Smuggling: Under 8 U.S.C. § 1324(a), if hiring involves concealing, shielding, or transporting undocumented immigrants to evade detection (e.g., for financial gain), penalties escalate:

  • Up to 10 years in prison if done for commercial advantage or private gain.

  • Up to 5 years for basic harboring or aiding entry.

returned my investigative reporting files.

 

Today, I am releasing photos of the records for the first time so you can see the sheer volume involved.

 

Four large moving boxes, weighing over 100 lbs in total.

immediately stood up for journalism when CBS News executives seized my reporting files, including confidential source information, after my job as a senior investigative correspondent was terminated, citing cost cutting.

 

At the time, a Paramount lawyer pushed back, insisting "CBS acted to secure and protect the material in Ms. Herridge’s office.” The lawyer went further arguing the files were run of the mill work product.

 

My records included sensitive reporting about COVID-19 origins, Hunter Biden, and Trump Mar-A-Lago documents among others.

 

In April, I testified before Congress that the seizure of my reporting files was a "journalistic rape” and an attack on investigative journalism.

 

Without SAG-AFTRA, my files would never have been returned. Thank you, SAG-AFTRA for standing up for free speech and a free press.
