Court asked to intervene after email tells USAID workers to destroy classified documents

WASHINGTON (AP) — A union for U.S. Agency for International Developmentcontractors asked a federal judge Tuesday to intervene in any destruction of classified documents after an email ordered staffers to help burn and shred agency records.

 

Judge Carl Nichols set a Wednesday morning deadline for the plaintiffs and the government to brief him on the issue. A person familiar with the email who spoke on the condition of anonymity for fear of reprisal verified that it was sent to at least some essential personnel.

 

It comes as the Trump administration has been dismantling USAID, cutting off most federal funding and terminating 83% of humanitarian and development programs abroad,pulling all but a few hundred staffers off the job, and shutting down the agency’s Washington headquarters.

 

Lawsuits are mounting over the abrupt shutdown of most U.S. foreign assistance and the targeting of the aid agency. In the latest court challenge, Personal Services Contractor Association, representing thousands of contractors now furloughed or fired from USAID, asked the judge to stop any document destruction to preserve evidence.

 

The email was sent under the name of Erica Carr — the acting executive secretary at USAID — and bears a USAID logo.

 

“Thank you for your assistance in clearing our classified safes and personnel documents” at USAID headquarters in Washington, it begins.

 

It directed staffers to report to work starting Tuesday. “Shred as many documents first,” then stuff remaining classified material into designated bags for burning if the demand on the shredder becomes too great, the email instructed.

 

Staffers were told to write “secret” on the bag with a marker.

 

The State Department did not immediately respond to questions about the email, including whether officials were following the legally required procedures in any destruction of documents.

 

The collection, retention and disposal of classified material and federal records are closely regulated by federal law. Improper handling or disposal can be charged as a crime.

 

Rep. Gregory Meeks, the ranking Democrat on the House Foreign Affairs Committee, accused the Trump administration of not complying with federal records law.

 

“Haphazardly shredding and burning USAID documents and personnel files seems like a great way to get rid of evidence of wrongdoing when you’re illegally dismantling the agency,” Meeks said in a statement.

 

A group representing USAID workers, the American Foreign Service Association, said in a statement that it feared documents being destroyed could be relevant to the ongoing lawsuits over USAID’s firings and program terminations.

 

The classified documents at USAID emerged last month when the Trump administration put the agency’s top two security officials on leaveafter they refused to grant members of Elon Musk’s government-cutting teams access to classified material.

 

The Associated Press reported that the classified material included intelligence reports.Kate Miller, who serves on an advisory board for DOGE, said at the time that no classified material was accessed “without proper security clearances.”

 

The wide firings at USAID have left relatively few staffers with access to agency systems.

ICE, DEA arrest criminal illegal aliens on idyllic New England island

U.S. Immigration and Customs Enforcement (ICE) and Drug Enforcement Administration (DEA) agents in New England executed a joint operation on Nantucket, Massachusetts, to arrest "illegal criminal aliens" on Tuesday.

 

In a post on X, the DEA New England division said its agents assisted ICE and ICE Enforcement and Removal Operations (ERO) Boston with the arrests on the idyllic and posh summer vacation destination island situated 30 miles south of Cape Cod.

 

The Nantucket Current reported that the DEA confirmed it had arrested a man previously charged with kidnapping and domestic assault and battery, as well as a woman.

 

Authorities did not identify the suspects’ names or countries of origin.

 

Fox News Digital has reached out to the DEA for additional information.

 

In a statement to the publication, the acting special agent in charge of the DEA’s New England Field Division would only say it worked with its federal partners on immigration enforcement efforts.

 

Also assisting with the operation was the U.S. Coast Guard, which reportedly took federal agents to Nantucket and back to the mainland with a suspect in tow.

 

The Town of Nantucket said in a press release that the Nantucket Police Department was contacted by the Department of Justice (DOJ) and DEA about their plans to arrive at the island to serve an arrest warrant for a "violent offender."

 

The federal agencies also requested assistance from Nantucket police, given their local geographical knowledge of the area.

 

The department’s detective unit assisted federal agents in identifying requested addresses, while also providing the DEA with transportation.

 

The DEA released two photos of the operation. In one photo, DEA agents were seen on a U.S. Coast Guard vessel with their backs to the camera, while in the other photo, the two suspects appeared in custody.

 

In September, ICE made at least six arrests between the islands of Nantucket and Martha’s Vineyard. The arrests were part of a larger operationto detain illegal immigrant suspects accused of egregious crimesin the beach towns favored by the Biden and Obama families.(so that’s where Bidan is hiding out)

 

One of those arrests was on Sept. 10, when ICE ERO Boston arrested a 28-year-old Salvadoran illegal immigrant named Bryan Daniel Aldana-Arevalo, who was charged with one count of rape of a child with a 10-year age difference and two counts of indecent assault and battery on a child under 14.

Trump proposes cutting ACA enrollment period, ending ‘Dreamer’ coverage

The Trump administration is proposing to shorten ObamaCare’s annual open enrollment period by a month, a move the administration said is aimed at helping consumers pick the right plan.

 

According to a proposed rule released Monday, open enrollment would run from Nov. 1 through Dec. 15, instead of through Jan. 15.

 

“This proposal aims to reduce consumer confusion, streamline the enrollment process, align more closely with open enrollment dates for many employer-based health plans, encourage continuous coverage, and reduce the risk of adverse selection from consumers who otherwise may wait to enroll until they need health care services,” the Centers for Medicare and Medicaid Services (CMS) said in a fact sheet.

 

The sweeping rule gives a glimpse of how the Trump administration will handlethe signaturehealth law. (Why does the Hill lie about everything Americans hate? It’s neither “signature or healthcare”!)

 

The move mirrors one made during President Trump’s first term, when he shortened open enrollment to seven weeks.He also slashed funding for advertising and outreach and allowed “skimpy” short-term planson the market after he tried and failed to repeal the law. Under former President Biden, there were a record number of people enrolling in Affordable Care Act plans. Last year, 24 million people chose plans during the most recent open enrollment period, mainly due to expanded tax credits that made plans available to people for little or no monthly premiums. A federal judge blocked the rule from being enforced in 19 states, and it is still being litigated.

Department of Education staff will receive "reduction in force" notices Tuesday before nearly half of the department's workforce is terminated, Fox News Digital has learned.

 

Earlier Tuesday, a memo was sent to all Education Department employees informing them that Department of Education offices will be closed Tuesday evening through Wednesday due to "security reasons." Employees were instructed to leave the offices by 6 p.m. ET Tuesday.

 

"Today's reduction in force reflects the Department of Education's commitment to efficiency, accountability, and ensuring that resources are directed where they matter most: to students, parents, and teachers," Education Secretary Linda McMahon said in a statement.

 

McMahon called the move a "significant step toward restoring the greatness" of the American education system.

 

All divisions within the Department of Education will be impacted by the staffing cuts. Some will require "significant reorganization."

 

President Donald Trump has repeatedly said he would like states to control education. He campaigned on the issue ahead of the 2024 election.

 

"I want to close up Department of Education, move education back to the states," Trump said in August 2024, while noting left-wing states such as California could struggle if he does eliminate the Department of Education. "Of the 50 (states), I would bet that 35 would do great. And 15 of them, or, you know, 20 of them, will be as good as Norway. You know, Norway is considered great."

 

When Trump took office, the agency's workforce numbered 4,133 employees. That will shrink to around 2,183 workers, the department said in a news release.

 

About 259 employees were accepted into the deferred resignation program and another 313 accepted buyouts. Remaining workers impacted by the reductions will be placed on administrative leave beginning March 21.

 

The workers being let go will receive their full pay and benefits through June 9, as well as "substantial severance pay or retirement benefits" based on the length of their employment, the agency said.

 

The expected "reduction in force" notices come after reports spread in recent days that Trump was readying to sign an executive order to abolish the federal agency.

 

The Wall Street Journal recently reported it had reviewed a copy of a draft executive order that would order McMahon to "take all necessary steps to facilitate the closure of the Education Department" based on "the maximum extent appropriate and permitted by law."

 

"The experiment of controlling American education through Federal programs and dollars — and the unaccountable bureaucrats those programs and dollars support — has failed our children, our teachers, and our families," the draft order said, according to the Journal.

 

McMahon additionally sent a letter to all staff on her first day on the job in March saying she will lead a "momentous final mission" to send education back to the states.

 

"Our job is to respect the will of the American people and the President they elected, who has tasked us with accomplishing the elimination of bureaucratic bloat here at the Department of Education — a momentous final mission — quickly and responsibly," McMahon wrote to employees in a letter shared first with Fox News Digital.

 

The secretary said that the reconstruction of the department will "profoundly" alter staff, budgets and agency operations.

Rashida Tlaib Casts Lone Vote Against the Subterranean Border Defense Act as Bill Passes 402 to 1

ichigan Democratic Rep. Rashida Tlaib was the sole vote against the Subterranean Border Defense Act, a bill that would combat cross-border tunnels made by Mexican drug cartels.

 

Crane said during a brief floor debate, during which no lawmakers rose in opposition to his bill,that “since 1990, officials have discovered more than 140 tunnels that have breached the U.S. border with an 80 percent increase in tunnel activity occurring since 2008.”

 

“With border crossings thankfully going down since January, I think it’s safe to assume this will drive threats to our border underground through these tunnels,” Crane added, according to Fox.

 

The lawmaker said in a statement after the passage of theSubterranean Border Defense Act that the move was “a massive win for our security.”

 

“This legislation will ensure Congress has sufficient knowledge and oversight in regard to this dynamic threat,” Crane said.

 

The vote marks a rare show of bipartisanship in today’s Congress, with an increasing number of Democrats feeling pressure on border security from their constituents.

 

Tlaib is often against the side of common sense in her votes. But this particular move was especially brazen.

 

This bill would not even have allocated resources or set forth a specific strategy for combating drug cartel tunnel activity at the border.

 

It would merely recognize that tunnels are a problem and set forth a tool for Congress to receive basic information about the issue.

 

The vast majority of House Democrats recognized that such a bill marked an obvious move toward preventing illicit activity at the border.

 

To be clear, there are many Democrats who are still terrible on the border and immigration issue.

 

Most of the Democrats in the House and the Senate voted against the Laken Riley Act, which requires the Department of Homeland Security to detain illegal aliens charged with crimes like theft and assault of a police officer, or any offense that results in death or serious bodily harm.

 

But Tlaib stood alone in this particular vote.

 

It’s absolutely inexcusable for a lawmaker to be so malicious or moronic that she votes to keep cartel tunnels open at the southern border.

 

Tlaib, for whatever reason, categorically refuses to vote in the interests of the American people, and therefore has no business remaining in government. (She’s here to destroy America with Muslim Terrorists)

Democrats in the chamber have a choice: pass on a chance to stand up to Trump or allow a government shutdown.

House Republicans passed their stopgap funding bill Tuesday evening,which means Senate Democrats can now no longer delay their long-dreaded decision: Do they give up a chance to stand up to Donald Trump or let the government shut down in three days?

 

Democrats plan to huddle around lunchtime to try and hash out their strategy for confronting the government funding fight. They have already held one “vigorous discussion,”and even the chattiest senators emerged from their Tuesday meeting tight-lipped about their strategy. Many declined to say if they were unified in their approach.

 

They don’t appear to be. Republicans need at least eight Democrats to vote in favor of the six-month stopgap, given GOP Sen. Rand Paul’s expected opposition. Sen. John Fetterman is expected to cross party lines. But most of the 20 Democrats we surveyed in the minutes after the continuing resolution passed the House were noncommittal — particularly among the swing-state set.

 

A few are varying shades of “no.” Sen. Jeff Merkley said he will oppose it, while Sen. Richard Blumenthal is a “likely no.” Sen. Alex Padilla said he would not be in favor unless it offered California disaster aid after the Los Angeles wildfires.

 

Senate Minority Leader Chuck Schumer hasn’t said a word publicly since the House vote. Sen. Elizabeth Warren issued a charge of her own: “Democrats in the House have shown us they are united,” she told reporters after all but one House Democrat voted against the stopgap. “Why should it be different in the Senate?”

 

But Senate Democrats are agonizing over a few things: Getting blamed for the shutdown, especially after House GOP leaders sent members home for recess, is a big consideration. And they’re worried it would give Trump — who’s set to be on the Hill today for the annual Friends of Ireland luncheon — unchecked authority to shutter even more parts of the federal government. That’s an especially fresh concern after his administration moved Tuesday to gut the Education Department.

 

“A shutdown is uncharted territory when you've got an administration that, at least in some ways, probably would welcome a shutdown because that would give the president almost unlimited power in deciding who’s essential, who’s nonessential, holding up agencies,” Sen. Angus King, an independent who caucuses with Democrats, told reporters. “That’s the dilemma that’s being discussed.”
