HOW TO FIX POTHOLES

 

Hertfordshire County Council has been forced to fix three pothole-ridden roads after a motorist took it to court using a little-known law.

 

D B, 68, secured the win at St Albans Crown Court last week after researching road maintenance laws and finding section 56 of the Highways Act 1980.

 

It allowed him to make an application demanding the authority fill potholes in six roads across Hemel Hempstead and Berkhamsted, which progressed to court when it did not respond in the proper manner.

 

The council had already fixed three of the roads but the judge ordered it to repair the remaining trio within 20 working days, the BBC and Daily Mail reported.

 

These were London Road and Ivy House Lane in Berkhamsted as well as Redbourn Road in Hemel.

 

Council bosses have consented to the order, but encouraged reporting potholes via the council’s online system as the best way to alert officers.

 

A spokesperson highlighted that the roads which had not already been repaired have been scheduled and told the BBC: “We're disappointed that this routine maintenance issue has resulted in legal proceedings being issued.”

 

Having represented himself in court, Bennet was also awarded £1,650 in costs, according to the Mail.

 

The retired construction project manager told the Mail: "I don't know why we put up with this. It's so easy to deal with. If everyone did it we'd have lovely roads within six months."

 

He has now reportedly filed submissions for other roads in the county and nearby.
