Victor Davis Hanson Flags Possible Error That Could ‘Be Cause For Reversal’ In Trump’s E. Jean Carroll Case

 

Hoover Institution Senior Fellow Victor Davis Hanson said Friday on his podcast that President-elect Donald Trump could have a “cause for reversal” in the E. Jean Carroll case, citing the language used by the presiding judge.

 

In May 2023, a New York jury found Trump liable for sexual battery and defamation, but stopped short of convicting him of rape in the case brought by former Elle magazine writer E. Jean Carroll. On “The Victor Davis Hanson Show,” Hanson discussed ABC’s settlement in Trump’s defamation case against the network, following host George Stephanopoulos’ claim during a live segment of his show that Trump was “liable for rape.

“Well George Stephanopoulos gave an interview and I think on 11 occasions he said Donald Trump committed rape. In the E. Jean Carroll civil suit, she alleged that she was sexually attacked by him. The jury found that he did not commit rape but that he had committed, there was a likelihood he’d committed sexual assault,” Hanson said.

 

Court records filed on Dec. 14 show that ABC has been ordered to pay $15 million by Dec. 24 as a “charitable contribution” to Trump’s “presidential foundation and museum.” The former president filed a defamation suit against the network and Stephanopoulos. This, following a March segment in which Stephanopoulos repeatedly questioned Republican South Carolina Rep. Nancy Mace about her support of Trump, while claiming the former president was “liable for rape.”

“And the judge [Kaplan], as I remember his name, had misspoken and said, ‘Well’ somebody had corrected him or reminded him that he had never been convicted of rape and he said, ‘What’s the difference?’ something along that line and that I think will be cause for reversal because that’s up on appeal,” Hanson added.

 

“The judge basically … show[ed] pre-existing prejudice that if the judge knew that the jury had not found or was not considering rape and yet he said publicly that they were indistinguishable, then that’s going to be appealed,” Hanson said.

 

Following the verdict from Carroll’s May win against Trump, the former president’s team argued to presiding Judge Lewis Kapalan for a new trial, noting how the term “sexual abuse” could be limited by definition, according to The Washington Post. However, Kaplan responded in a filing that while Carroll was unable to prove she was “raped,” the term may not be commonly understood, according to the outlet.

 

“The finding that Ms. Carroll failed to prove that she was ‘raped’ within the meaning of the New York Penal Law does not mean that she failed to prove that Mr. Trump ‘raped’ her as many people commonly understand the word ‘rape,'” Kaplan wrote.

 

“Indeed, as the evidence at trial recounted below makes clear, the jury found that Mr. Trump in fact did exactly that,” Kaplan said.

‘Don’t You All Have Jobs?’: JD Vance Calls On Protesters Demonstrating Against His Event To Get ‘Back To Work’

Vice President J.D. Vance told workers during a speech Friday in Bay City, Michigan, that demonstrators outside the event should “get off the streets and back to work.”

 

Vance and U.S. Small Business Administration chief Kelly Loeffler toured Vantage Plastics, a plastic manufacturer located in Michigan, and delivered remarks on “highlighting America’s industrial resurgence.” The vice president, during a speech at the facility, said the protesters outside of the event are proof that President Donald Trump’s administration needs to bring back manufacturing to the U.S. in order for them to have less time on their hands.

 

“We’ve got this great event, this great facility, great business and of course, great workers and I’m sure all of us saw there were a few protesters outside and I can’t be the only person wondering, you know, it’s a little after noon on a Friday, and don’t you all have jobs?” Vance said. “I mean, who are the people? And I think that’s one of the reasons why we’ve got to rebuild American manufacturing and support great companies like Vantage Plastics because we want these people to get off the streets and back to work. It’d be good for them and it’s be good for everybody else too.”

 

Vantage Plastics received a $1.2 million grant from Michigan in 2023 to be based in the state and create 93 new jobs, according to Bridge Michigan. The event, attended by Vance and Loeffler, addressed the “future of American manufacturing,” which the Trump administration has strived to improve.

 

Trump plans to impose tariffs on Mexico, Canada and China, including 50% tariffs on Canadian aluminum and steel imported to the U.S., with the intent of returning manufacturing to the U.S. from overseas. The president also announced the creation of the “Office of Shipbuilding” with the intent to revive both commercial and military shipbuilding at a time where China has outpaced the U.S. in maritime manufacturing.

 

The White House celebrated the creation of 10,000 manufacturing jobs in February, particularly in the automobile industry, where 9,000 jobs were created.

 

Hecklers shouted at Vance during his Monday speech at the National League of Cities in Washington, D.C. for calling out the negative consequences of illegal immigration. The vice president fired back, stating that some people want the U.S. to suffer from economic consequences due to illegal immigration.

 

The vice president also laughed off attendees who booed him inside the John F. Kennedy Center by casually waving and sipping his beverage during a symphony orchestra performance Thursday.
