More Background on Judge James Boasberg – The Fight Continues

When you understand how Washington DC Judges view their roleand responsibility, then you understandthe scale of opposition that President Trump is facing. The false media framework of our “government” only makes the issues worse. So, here’s an explanation of Boasberg v Trump. (Pic 1, PDJT)

 

In 2016 the DOJ-NSD headed byMary McCordfiled a FISA application seeking a Title-1 search (full and unlimited) surveillance warrant againstthe leading presidential candidate,Donald Trump. The method to gain the surveillance authority was to use CIA informant Carter Page who had met with the Trump campaign and call Page an “agent of a foreign power.”

 

TheFISA Court knowinglyand with specific intent approved the Title-1 surveillance warrant which was filed using false evidence (Clinesmith) and sketchy supporting documents (Steele Dossier), no Woods File was attached.

 

At the time of the application, Mary McCord was acting head of the DOJ National Security Division. McCord was responsible for filing the warrant application.The DOJ-NSD had no inspector general oversight. The targeting of candidate Donald Trump was entirely for political purposes and intents.

 

AfterPresident Trumpwon the 2016 election, hegave DOJ Inspector General Michael Horowitz authorityto conduct oversight over the DOJ-NSD. IG Horowitz started investigating the FISA application.This is where things get interesting.

 

TheFISA Court (FISC) was exposedby their willful blindness in allowing the Title-1 targeting of Donald Trump.

 

Justice JohnRoberts is in charge of the FISC.

Judge Boasberg thenselected Mary McCord to be an amicusor advisor to the court as Horowitz was investigating the fraudulent FISA application.

 

Boasberg put theperson who was in charge of submitting the false FISAapplication in a position to filter the results of the Horowitz investigation of that same FISA application.

 

In essence, think of this as protecting the Judicial Branch. Justice Roberts appointed Boasberg to defend the FISC from scrutiny. Boasberg then moves Mary McCord into position to defend the FISC from scrutiny (McCord also protects herself).

 

At the time, Mary McCord’s husband Sheldon Snook was working within Justice Robert’s office.

 

That’s how John Roberts, James Boasberg and Mary McCord all connect. All the motives and intentsgo back to that original Title-1 FISA application.

 

Remember,this was a huge scandal all by itself. The FISA Court permitted a full-throated surveillance warrant against the leading presidential candidate, Donald Trump.The Judicial Branch was intentionally influencing the 2016 election. These are not stupid people; they were not duped, conned or fooled, they knew exactly what they were doing.

 

After appointing Mary McCord to take up a defensive position for herself and the FISA Court (cover),Judge Boasbergthen becomes thepresiding judgein the case against the FBI agent who falsified the FISA application,Kevin Clinesmith.

 

Boasberg gives Clinesmith a slap on the wrist and a few months’ probation (more cover).

 

This is thesame JudgeBoasberggave J6 FBI agent provocateur Ray Epps a sentence of probation. This is the same judge who, on his vacation, went to sit in the DC courtroom to observe defendant President Trump who was forced to appear in DC court. This is the same Boasberg who established a horrible precedent by forcing Vice-President Mike Pence to testify before a DC grand jury about his conversations with President Trump (breaking executive privilege).

 

♦Now we go back to the John Durham investigation,because Bill Barr had to ask Presiding Judge Boasbergfor guidance and direction as the Durham team looked at the FISA application (Title-1 surveillance warrant) against the backdrop of the Obama government targeting Donald Trump.

This is June of 2020,Bill Barr (who was running another cover-up angle) asked Judge Boasberg for guidance on five very specific issuescentering around the Carter Page FISA application. Barr asked for legal guidance to assist John Durham in disclosing information in the FISA file & evidence attached to the FISA file.

III. DOJ requests guidance for distribution of material to internal investigative units from the FBI inspectors division (INSD). FISC gives opinion and advice.

 

IV. DOJ requests guidance for distribution of non-minimized information, and/or, minimized information as part of the ongoing Office of Inspector General oversight. FISC gives opinion and guidance.

 

V. DOJ requests guidance for distribution of material to John Durham probe, both for criminal prosecution and possible evidence gathering attached to other ongoing investigative needs. FISC gives opinion and guidance.”

 

Now, keep in mind, with hindsight we know the DOJ (BillBarr) was essentially walking a fine linebetween uncovering information and trying to protect the DOJ as an institution.John Durham was never approved to investigate the government sideof the Trump-Russia collusion nonsense.

 

At the same time, Judge Boasberg is trying to protect the FISC from their culpability and also protect the FISA Court as an institution.Everyone has an agenda here, and none of them are good.

 

That leads to Boasberg outlining a cautious approach toward distribution and/or sunlight on what took place. On this issue the court says allowing a target to escape prosecution is part of the penalty upon the DOJ for wrongful assembly; a nice way to cover the issue.

 

Judge Boasberg does not consider the DOJ is targeting the “assemblers” for their criminal conduct. Rather his response is general toward criminals who were targets of a FISA application assembled with corrupt intent. It seemed a little weird at the time, now notsomuch.

 

Pages #11 and #12 hit the topic of FOIA production. Boasberg says “some” FOIA requests might warrant document distribution, but not all. However, on the topic of Carter Page getting his FOIA fulfilled, the court supports expansive distribution to Mr. Page alone.

 

I find thearguments and issues in/around page #14 to be especially noteworthy. In this segment Judge Boasberg is responding to the underlying raw evidence that wouldnormally be used to assemble a “woods file”.The court notes the FBI Sentinel system would contain the minimized outcomes (redacted evidence) and this points to a bigger issue.

 

In response to this inquiry Judge Boasberg notes FBI investigators would have access to the minimized information within the Sentinel system; however, insofar as there was additional inquiry into the raw and non-minimized intelligence, a review and distribution would be permissible so long as there was a strong filter team in place to ensure statutes surrounding FISA securities (minimization requirements) were not violated. Overall, Judge Boasberg gives permission and approval for all six aspects Bill Barr requested. However, he does so with several legal qualifiers and distinctionswhich the DOJ was told to observe. Thosequalifiers were intended to protect the interests of both Main Justice and the FISA Court from sunlight upon their prior conduct in 2016.

 

SUMMARY –Judge Boasberg has been demonstrably political in all his determinations going all the way backto his position on the FISC when the FISA application was approved. Boasberg was then moved into position to protect the FISC from the outcome of their Title-1 search warrant approval.

 

Boasberg then used his position as Presiding FISC judge to protect the apparatus, while using his position as DC Circuit Court Judge to diminish, obfuscate and cloud the severe ramifications from all of the DC effort, including his rulings on the Kevin Clinesmith (FBI Agent) and Ray Epps (FBI Source) cases.

 

Judge Boasberg sits at the epicenter of a thoroughly corrupt and compromised DC court system.

The Russian military has said that it had to shoot down its own drones to fulfill President Vladimir Putin’s order to halt strikes on Ukraine’s energy infrastructure. The president gave the order as a result of discussions with his US counterpart Donald Trump on Tuesday.

 

During their phone call, Putin accepted a proposal by Trump for the sides in the Ukraine conflict to refrain from striking each other’s energy infrastructure for 30 days, the Kremlin said later on Tuesday. The Russian leader “immediately” instructed the country’s military to comply, it added.

 

The Defense Ministry confirmed in a statement on Wednesday that it had “received an order from the Supreme Commander-in-Chief to halt strikes on Ukraine’s energy infrastructure.”

 

According to the ministry, when Putin’s order came in “seven Russian attack drones were in the air, targeting Ukrainian energy infrastructure facilities related to the country’s military-industrial complex in Nikolaev region.”

To fulfill the command, the Russian air defenses had to “neutralize” the UAVs. Six drones were shot down by a Pantsir missile system and another by a fighter jet, it added.

 

The defense ministry also claimed that “just several” hours after the call between Putin and Trump, “the Kiev regime carried out a deliberate attack with three fixed-wing drones on an energy infrastructure facility in the village of Kavkazskaya in Russia’s Krasnodar Region.”

 

The strike damaged an on-site oil reservoir and caused a blaze, which is yet to be extinguished, the statement added.

 

The Kavkazskaya facility is used to transfer crude from rail-transported tanks to a pipeline operated by the Caspian Pipeline Consortium (CPC), an international firm that lists US energy giants Chevron and Mobil among its partners.

 

“Clearly, this was a premeditated provocation by the Kiev regime aimed at derailing the US president’s peace initiative,” the statement read.

Russia thwarts new Ukrainian incursion attempt(VIDEO)

Kiev launched cross-border attackson Tuesday to sabotage the talks between the Russian and US presidents, according to Moscow

 

Ukrainian troopslaunched multiple cross-border attacks on Belgorod Region on Tuesday, according to the Russian Ministry of Defense, which linked the new incursion attempt to the phone call between President Donald Trump and his counterpart, Vladimir Putin.

 

During the day, the Ukrainian military mounted five attacks on the Russian region, targeting the border villages of Demidovka and Prilesye.

 

The operation involved 200 soldiers and 29 pieces of military hardware, including five tanks, the MOD stated.

 

All the attacks were repelled, with the invading force losing up to 60 servicemen, at least one tank, three military breacher vehicles, and seven other armored units, according to the MOD.

 

The Defense Ministry claimed that Ukraine had wanted to generate “a negative background” for the long-anticipated Trump-Putin talks.

 

Footage circulating onlinepurports to show Ukrainian armor, including several US-madeBradley infantry fighting vehicles, breaching through concrete anti-tank obstacles installed on the border. The armor comes under artillery fire, with some vehicles hitting landmines, as well as getting attacked by multiple fiber optics-guided FPV drones.

 

The vehicles involved in the attack feature the distinctive white triangle tacticalmarking used by the Ukrainian invasion force operating in Russia’s Kursk Region since last August.

 

Kiev had planned to use its occupation of parts of the Kursk Region as leverage during negotiations with Moscow. In recent weeks, however, Russian troops have liberated Sudzha, the largest town occupied by Ukrainians during their incursion, as well as the vast majority of the territory.

Russian flamethrowers pound Ukrainian positions (MOD VIDEO)

Russian troops have used the TOS-1A thermobaric system to destroy a Ukrainian platoon-level entrenchment

 

The Russian Defense Ministry on Tuesday released a new video showing heavy thermobaric TOS-1A Solntsepyok systems striking alleged Ukrainian positions at an unspecified location on the frontline.

 

The system, belonging to Russia’s ‘West’ troop grouping,apparently obliterated a Ukrainian platoon-sized entrenchment, the military has said. Thenighttime videoshows the launcher firing multiple projectiles, with the strike observed by a surveillance drone. The strike appeared to be very accurate with multiple explosions concentrated in a relatively small area, footage shows. (Platoon is approximately 26 to 50 soldiers)

 

TOS-1A systems aredesignated as heavy flamethrowers and operated primarily by the Russia’s Radiological, Chemical, and Biological Defense Forces (RKhBZ). Despite its designation, the system is effectively a conventional multiple rocket launcher system, mounted on a tank chassis and designed to fire heavy 220mm thermobaric projectiles.

 

The munitions, colloquially known as vacuum bombs, disperse a cloudof highly explosive liquid or gas that is then ignited, producing a powerful air blast with extreme pressure and temperatures. The projectiles areextremely effective in targeting personnel, including soldiers taking cover in trenches, pillboxes, or light armor.

 

The systems have seen extensive action during the Ukraine conflict, proving to be an important heavy-hitting, albeit arguably short-range, tool. A lighter, wheeled version of the system, known as TOS-2 Tosochka, has also been introduced during the conflict and used against Kiev’s troops on numerous instances.

Pentagon confirms resumption of US aid to Ukraine

Assistance was resumed after Kiev accepted Washington’s proposed 30-day ceasefire with Russia

 

Pentagon officials have confirmed that the US has fully restored military aid and intelligence sharing with Ukraine.

 

Earlier this month, Washington announced its decision to lift restrictions on assistance after Kiev announced that it would agree to a 30-day ceasefire with Russia.

 

Speaking to reporters on Tuesday, PentagonPress Secretary Sean Parnell said that “US military aid to Ukraine has been turned back on, as well as intelligence sharing.”

 

Echoing Parnell’s remarks, Alexus Grynkewich, Commander of the US Air Forces Central Command (CENTCOM) reaffirmed that US military aid has resumed. “We’ve got confirmed reports that it is continuing or is flowing back into Ukraine and, of course, daily reports on the outcome of the intelligence sharing and those efforts,” he said. “So, all of that is as it was previously.”

 

The US had earlier halted the delivery of billions of dollars’ worth of military aid to Kiev and restricted intelligence sharing following last month’s quarrel at the White House between Vladimir Zelensky and US President Donald Trump, who was joined by Vice President J.D. Vance. During the exchange, Trump accused Zelensky of ingratitude and “gambling with World War III” by refusing to seek peace with Russia. The Ukrainian leader was asked to leave the US capital and only return when he was ready for serious negotiations.

 

Pentagon’s announcement came the same day that Trump and his Russian counterpart Vladimir Putin had a phone conversation to discuss efforts to achieve a peaceful resolution to the Ukraine conflict. The much-anticipated phone call lasted two and a half hours, with both the White House and the Kremlin describing it as positive.

 

The two leaders confirmed a month-long mutual suspension of strikes on energy infrastructure and discussed Trump’s proposal for a 30-day ceasefire, with the Russian side outlining several key issues that would need to be addressed before implementation.

 

Kiev, however, swiftly violated the agreement when its military allegedly targeted an energy facility deep inside Russia on Wednesday, despite having announced a pause on long-range strikes.

 

Putin also emphasized the necessity of establishing a reliable monitoring mechanism for the ceasefire, halting forced mobilization, and preventing further rearmament in Ukraine.

 

The Russian president also insisted that a key condition for preventing further escalation and a diplomatic resolution of the conflict is the complete cessation of foreign military aid and intelligence sharing with Ukraine.

Judge says dismantling of USAID was unconstitutional, orders Musk to restore access for employees

Elon Musk's attempt to unilaterally dismantlethe U.S. Agency for International Development likely violated the United States Constitution, a federal judge ruled on Tuesday.

 

U.S. District Judge Theodore Chuangordered Musk and his Department of Government Efficiency to immediately give USAID employees access to their "email, payment, security notification, and all other electronic systems," and ordered a pause on any efforts to shut down USAID.

 

Judge Chuang wrote that Musk's takeover "usurped the authority of the public's elected representatives in Congress to make decisions on whether, when, and how to eliminate a federal government agency, and ofOfficers of the United States duly appointed under the Constitution to exercise the authority entrusted to them." (The asshole is saying Congress has more power than the President.)

 

While Judge Chuang rebuked Musk's role within the Trump administration, the exact implications of the decision on the operations of USAIDare unclear.

(It was stated save America wasteful money spending and cut the Workforce.Congress should immediately ban and close the USAID agency. And transfer the few remaining that are worthy to DOS, now)

 

DOGE and Muskwere also ordered to submit a written agreement within two weeks that ensures USAID can reoccupy its former headquartersin the Ronald Reagan Building in Washington, D.C.

 

The foreign aid agency was among the first government agencies DOGE slashed in its effort to scale back or dismantle much of the federal government. The Trump administration has laid off thousands of employees, revoked funding for more than 80% of its programs, and shed its Washington, D.C. headquarters.

 

Critics of the Trump administration sayits efforts to nullify the agency will cripple American influence overseasand carry devastating effects for some of the most vulnerable populations in the world, which relied on U.S. funding for health care, food, and other basic needs.

In 'very abnormal' development, longtime sponsors bail on San Francisco Pride

The companies cited a lack of funds, but SF Pride's director called the developments 'very abnormal' By Timothy Karoff, March 17, 2025

 

Several longtime corporate sponsors of San Francisco’s Pride celebrations are pulling their funding for the festivities, leaving Pride organizers searching for another way to raise $300,000. (Make the rich Gay people pay for it)

 

In the past four weeks,multiple companies told San Francisco Pride, the nonprofit behind San Francisco’s annual Pride Parade and Civic Center celebration,that they would not support the 2025 Pride celebrations. In an interview with SFGATE, San Francisco Pride’s executive director, Suzanne Ford, said she was “really disappointed” by the developments.

 

In their communications with San Francisco Pride, the sponsors all cited a lack of funds. None of them mentioned the political climate. But Ford noted that it was “very abnormal” for several multiyear sponsors to suddenly drop their support for the event. A few sponsors pull their support every year, she said, but they typically do so after a series of conversations with the nonprofit.

 

“I just interpreted that companies are making decisions that at this time it’s not good to be sponsoring Pride,” Ford told SFGATE. “I think in this political environment that they thought that was a risky decision. But that’s just me reading the tea leaves. I think for a long-term sponsor not to sponsor us, they are responding to what we are.”

 

Ford told KTVU-TV that those sponsors included Comcast; Anheuser-Busch, the company behind Budweiser and Beck’s beer; wine company La Crema; and Diageo, the beverage company that produces Guinness, Smirnoff and other alcoholic drink brands. Aside from Comcast, all of those companies specialize in alcoholic beverages, a market that has become more volatile as Americans’ drinking preferences shift.

 

Janel Lubanski, a spokesperson for La Crema’s parent company, Jackson Family Wines, told SFGATE thatthe wine company still hopes to partner with San Francisco Pride but will not be able to do so in the same capacity as in previous years.

 

“We’re not stepping away from our support of the LGBTQ+ community,” she wrote in an email to SFGATE, noting that the wine industry is facing challenges and listing a series of Pride events in California that the company is still supporting, including Sonoma Pride, Windsor Pride and Palm Springs Pride.

 

Comcast, Anheuser-Busch and Diageo did not return requests for comment in time for publication.

 

San Francisco Pride has budgeted $3.2 million for its events on the weekend of June 28-29, Ford said, and of that sum, corporate sponsorships are meant to cover $2.3 million. The companies that withdrew represented a combined $300,000 in funding.

 

Earlier this month, Ford announced that San Francisco Pride was ending its relationship with Meta, the parent company of Facebook.The social media giant recently ended its major diversity, equity and inclusion programs and scaled back its content moderation policies. In an interview with KGO-TV, Ford noted that the nonprofit was pausing its relationships with sponsors that don’t align with San Francisco Pride’s values. So, at this moment, and I don’t see it being rectified, Meta will not be included.”

 

Ford didn’t hesitate when asked whether the Pride festivities June 28-29 would still go as planned. “We have no choice,” she told SFGATE. “There are too many people depending on us. We will find a way to find the funds.”

 

“I want to say to everyone,if you’re feeling helplessand that you have not had a way to stand up to what’s happening to the LGBTQ community right now, here’s your chance,” Ford said. “Come out on Pride weekend and make this the largest attended Pride ever, andthat will send a clear statement to the federal government that here in San Francisco, we believe in inclusion and authenticity.”

Now is the moment, finally, to cut off all federal funding to activist legal-aid lawyers.

 

As Elon Musk and his DOGE team throw open the books to uncover corrupt and wasteful spending across the massive federal bureaucracy,they must not overlook the obscure Legal Services Corporation (LSC), a quasi-federal agency which doles out hundreds of millions of taxpayer dollarsto a country-wide network of activist “poverty” lawyers, LSC is an anachronism of Great Society radicalism that Congress should have zeroed out decades ago,but lobbyists from the poverty industry and legal profession have skillfully kept Uncle Sam’s money flowing. Today, forcing American taxpayers to continue financing LSC is the equivalent of making them pay for something as outdated as the Rural Electrification Administration.

 

LSC is something more troubling than a simple waste of taxpayer dollars—it’s a pass-through for money to go to a network of left-wing legal activists. Back in the early 1980s, the Reagan administration made the first valiant, but unsuccessful, effort to defund LSC. Ronald Reagan himself was personally energized for the cause because, while California governor, he had battled constantly with federally funded legal-aid lawyers who sued the state government for their radical agenda.

 

President Reagan’s unsuccessful effort todefund LSC put the spotlight on a prominent legal-aid activist, then anunknown young lawyer and wife of the governor of Arkansas. Hillary Rodham Clinton served on the LSC boardand fought bitterly to save the agency’s bacon, knowing its budget brought in hundreds of millions of taxpayer dollars for left-wing causes.Hillary joined with the usual suspects—big-spenders in Congress and the liberal news media—who mobilized to defend “legal assistance for the poor.” Although Reagan managed to persuade Congress to trim LSC’s budget, federal dollars continued to flow.

 

The strong case Reagan laid out against LSC a generation ago is still fully valid. Across the country exists aloosely networked hodge-podge of legal-aid groups and associations=, of which some 130—called “grantees”—receive federal funds from LSC. In many cases, theemployees of these groups are operatives of the self-interested, and permanent, federal bureaucracy. To be fair,someof their individual efforts do assist some indigents, but the “legal assistance to the poor” strategy is cover for guerrilla social activism, pioneered by Edgar S. Cahn. He passed the covert mission to Hillary Clinton, who passed it on to another generation.President Donald Trump and Musk must finally extinguish that dangerous torch.

 

This legal-aid network, substantially funded byLSC, has a 50-year history of advancing a radical agendaon controversial subjects such as racial preferences, transgenderism, homelessness, illegal immigration, and the growth of the welfare state. Where possible, legal-aid attorneys have sued in court; on other occasions, they have used advocacy tools outside the courthouse. Their efforts,in league with activist judges, have radicalized American society and institutions, undermining values and interests of the vast middle class.

As Trump looks to eliminate wasteful and politicized spending, he needs to pick up where Reagan left off a generation ago, and this time the White House and Congress need to get the job done.While LSC’s total level of federal money is relatively small—about $560 million in 2024—these funds act as invaluable seed and replenishment financing that continually nurtures the network. These groups have many other spigots of funding, it is true, but no other money sources match what comes from the taxpayers.

 

Non-federal money comes from left-wing state and local governments and from big institutional foundations, including those run by George Soros. Like lawyers everywhere, legal-aid attorneys bill their work hours to specific funding accounts. Thus, while federal money may not be used for certain individual lawsuits,Uncle Sam is paying for the infrastructure platformof office rent, clerical staff, and ancillary costs.

 

The answer to this follow-the-money deception is thatCongress must end all federal funding to all legal aid. If some individual states seek to fund legal-aid services, then let the legislatures in places like California, New York, and Illinois have at it. Similarly, if attorney and bar associations want to encourage private lawyers and other donors to give financial contributions to legal aid, it is a free country.What is certain is that there are vast sums of private financingavailable to replace the long-suffering taxpayers. America’s large charities and grant-giving foundations hand out over $600 billion each year.Just the Gates Foundation alone is sitting on more than $50 billion.

 

It is no surprisethat the American Bar Association (ABA) for years has been abig booster of more federal money going to LSC. The more lawsuits the better. When LSC grantees file complaints, the whole lawyering class has more work.

 

It is a magnificent hidden subsidy. In our lumbering legal system, cases drag on for years, and attorney fees pile up. Other professions, for example the American Dental Association, no doubt wish they had an equivalent option to spread around such federal largesse.

 

LSC is part of the Washington poverty industry that expects to never put itself out of business. In FY2024, LSC officials asked that their budget be tripled to $1.5 billion (Congress refused). Budget-cutters should call on the token Republicans who sit on the LSC board to invite DOGE to come investigate all the money going to grantees. It is long past time that Uncle Sam declared victory and got out of the business of financing radical legal aid.

Today, Chief Justice Roberts issued a statement:

 

For more than two centuries, it has been established that impeachment is not an appropriate response to disagreement concerning a judicial decision. The normal appellate review process exists for that purpose.

This statement follows on the heels of the Judicial Conference meeting last week, in which Judges Sutton and Sullivan raised similar alarms about impeachment:

 

"Impeachment shouldn't be a short circuiting of that process," Sullivan said. "And so it is concerning if impeachment is used in a way that is designed to do just that."

 

U.S. Circuit Judge Jeffrey Sutton, an appointee of Republican President George W. Bush on the Cincinnati-based 6th U.S. Circuit Court of Appeals who chairs the Judicial Conference's executive committee, echoed those comments.

 

"One thing worth keeping in mind isif we dilute the standards for impeachment, that's not just a problem for judges," Sutton said. "That's a problem for all three branches of government."

 

I think we need a sense of perspective.

 

Last year Representative AOC and other members of Congressintroduced articles of impeachment against Justices Thomas and Alito. As best as I can recall,Roberts said nothing about this. Likewise, the Federal Judges Association and the American Bar Association said not a word about the never-ending crusade against two members of the Supreme Court.These attacks were never about disclosures. These critics were trying to delegitimize the Court. Yet, everyone was silent.

 

Likewise, in 2023, Senator RonWyden told President Biden to "ignore" any ruling from Judge Matt Kacsmarykconcerning mifepristone. Wearen't talking about turning planes aroundover international waters. This would be a ruling that could be timely appealed in the normal course.Yet Roberts did not say a word about thisin his end-of-year address or anywhere else. The FJA, the ABA, and all the usual suspects were silent. To the contrary, the Judicial Conference acceded to the criticism of Judge Kacsmaryk by trying to force down a rule to take cases away from him! I realize thatChief Justice Roberts is hitting the panic button, but his protest has started a bit too late.

 

Taking a step back, I think the standard for the impeachment process has indeed been diluted. At least with regard to the presidency, the firstTrump Administration demonstrated that nebulous offenses that are untethered to any actual crimewere impeachable offenses. Remember "abuse of power"?

 

I think the lesson of the Samuel Chase impeachment is the right one. But I'm also someone who has carefully studied the two-century history of the Court.What do you do with a President who was subject to two impeachments, where countless norms were blown past to resist him?During the first trial, Roberts admonished members of Congress to not use harsh language! And

 

Roberts couldn't even be bothered to preside over the second trial.

The Constitutional Crisis is a coin with two sides. Trump causes judges to overact, and judges cause Trump to overreact. Any resolution must be bilateral, not unilateral. Roberts could de-escalate the situation by promptly reversing some of these out-of-control lower court rulings. But instead, he would rather sit on his hands and pontificate. I've long said that the Chief Justice is living in a different reality than the rest of us. This episode proves it. There are three co-equal branches of government; the judiciary is not supreme.

 

Chief Justice Marshall had the good sense to avoid a confrontation with Presidents Jefferson and Jackson. ButRoberts apparently thinks this sort of statement will make everything better. But every timeRoberts puts pen to paper to avoid some perceived catastrophe, he usually invites an even greater one down the road. This is a lesson he has not learned during his tenure.

 

Update: A few people wrote to distinguish the AOC Articles of Impeachment from the more recent articles. They claimed that AOC and her colleagues charged Thomas and Alito with failing to disclose certain gifts, not recusing on certain cases, and violating other ethical standards.

 

Does anyone think that AOC and her colleagues would have filed these articles if Justices Thomas and Alito were liberals? No, they would not. How do I know that? Because Justice Ginsburg took trips and failed to disclose that hospitality.Justice Ginsburg wore a dissent collaron the bench to protest Trump's election. She made comments to the press about Trump, and then refused to recuse.Where was the outrage? Silence. More recently, Justice Sotomayor “accidentally” did not recuse from a case that involved her publisher. Justice Jackson also failed to properly file her disclosures. The world turns.

 

Is there a difference between impeaching a judge for his judgment in a particular case, and for his judgment about how to follow a recusal statute? I don't see much difference.In both cases, judges are exercising their discretion. If there is an actual crime, such as bribery, let an indictment be brought. But no one has even suggested this offense was committed.

 

I see the gravamen of the AOC resolution as a pretext. To the extent that AOC and others are citing alleged violations of ethical rules,they are in fact objecting to Thomas and Alito's substantive rulings. Any prosecutor, or indicter, can gin up charges to justify punishment. But the motivation to bring those charges is very different.

 

Trump is unique in that he says exactly what he is thinking. Other politicians engage in similar acts through locutions and workarounds. But Trump tells you exactly what he is thinking.
