North Dakota jury finds Greenpeace liable for hundreds of millions of dollars in damages
While Greenpeace denied it played more than a peripheral role in the 2016 protests against the Dakota Access Pipeline, the pipeline owner claimed the group organized a campaign of misinformation and direct training to the protesters.
North Dakota jury on Wednesday found Greenpeace liable for hundreds of millions of dollars in damages over its role in months-long protests against the Dakota Access Pipeline in 2016 and 2017.
After two days of deliberation, the New York Times reported, the jury returned the verdict. Energy Transfer, the owner and operator of the pipeline, filed the lawsuit in North Dakota state court against Greenpeace and Red Warrior Camp, which Energy Transfer claimed was a front for Greenpeace, and three individuals.
The lawsuit alleges that Greenpeace had engaged in a misinformation campaign with mass emails falsely claiming that the Dakota Access Pipeline would cross the sovereign land of the Standing Rock Sioux Tribe. In court filings, Energy Transfer claimed protesters engaged in a campaign of “militant direct action,” including trespassing on the company’s property, vandalizing construction equipment, and assaulting employees and contractors.
In testimony at the trial, Greenpeace maintained that it played only a minor role in what were protests led by indigenous groups. The organization argues, CNN reported, that the lawsuit is an effort on the part of the company to violate Greenpeace’s free speech rights.
“This is a test on our First Amendment rights during a very, very dangerous time in this country’s history,” Deepa Padmanabha, senior legal advisor for Greenpeace USA, told CNN. Padmanabha told the Associated Press, when asked if Greenpeace plans to appeal, that "this fight is not over."

ED searches eight premises linked to George Soros funding agency

THE Enforcement Directorate (ED) on Tuesday conducted searches at eight locations in Bengaluru linked to the Open Society Foundations (OSF) founded by US billionaire George Soros and its investment arm, the Soros Economic Development Fund (SEDF), as part of its probe into alleged foreign exchange violations.
The OSF did not respond to an email sent by The Indian Express.
The premises of some of the beneficiaries of OSF and SEDF, including those linked to some international human rights bodies, and a company named Aspada Investments Pvt Ltd were searched under the Foreign Exchange Management Act (FEMA), sources said.
ED sources called Aspada Investments the investment advisor or fund manager of SEDF in India. According to sources, Aspada Investment Company was set up by the OSF in Mauritius to channelise funding in India. “Aspada Investment Advisors Pvt Ltd (AIAPL) was established in Bengaluru on February 4, 2013, to manage/ advise SEDF’s investment in India. It is learnt that SEDF funded more than 12 companies in India to the tune of Rs 300 crore, and ED is collecting evidence,” said sources.
According to sources, a preliminary investigation showed that OSF was placed under ‘Prior Reference Category’ (PRC) by the Union Ministry of Home Affairs (MHA) on May 30, 2016. “Since then, OSF needs prior sanction of MHA for sending money to FCRA registered organisations in India. SEDF is the social impact investment arm of the OSF,” said sources.
In order to bypass such restrictions, “the OSF had subsidiaries in India and brought in funds in the form of FDI and consultancy fees, and these funds have been used to fund activities of the NGOs, which is a FEMA contravention”, ED sources said.
The ED is probing the end use of the FDI funds.
Sources said SEDF was found to have provided funds for “various activities linked to the NGO sector in the garb of FDI or consultancy/ service fee” to three Indian companies, which together got around Rs 25 crore from 2020-21 to 2023-24.
According to the OSF, it is one of the world’s largest private funding agencies of groups supporting human rights, justice and accountable government, with an annual budget of over US$1 billion in 2020.
“The Open Society’s Soros Economic Development Fund is also an active social impact investor in India. Its goals include helping smallholder farmers and small businesses boost their incomes, and making healthcare, schooling and financial services more available and affordable to a broader range of people. Since 2008, Open Society has invested over $90 million in start-up and early funding projects managed by Bangalore-based Aspada Investments,” it says on its website.
In the past, the ruling BJP has accused Soros of acting against India’s interests. In December last year, it had alleged in Lok Sabha that a “dangerous triangle”, comprising Soros, news portal OCCRP (Organized Crime and Corruption Reporting Project), and the Congress with its leader Rahul Gandhi, were trying “to derail India’s success story”.

Trump DOJ considers invoking state secrets privilege against judge who vetoed deportation flights
Bondi says 21-hour timeframe demanded by Obama nominee to decide whether to invoke state secrets is too fast.
Attorney General Pam Bondi is losing her patience with U.S. District Judge James Boasberg for first blocking the Trump administration's deportation of alleged gang members under the 1789 Alien Enemies Act and then ordering her to explain, on short notice, how it didn't violate his order to turn around planes already in the air.
DOJ is considering whether to invoke state secrets in regard to some information sought by Boasberg but his 21-hour turnaround time is too short, says a filing signed by Bondi, Deputy AG Todd Blanche and others.
They accused the President Obama nominee of "digressive micromanagement" and "derail[ing]" the case through "distraction of the specific facts surrounding the movements of an airplane," demanding Boasberg back off until a federal appeals court intervenes, Fox News reports.
"The Court has now spent more time trying to ferret out information about the Government’s flight schedules and relations with foreign countries than it did in investigating the facts before certifying the class action in this case," the filing says.
The judge had given DOJ until noon Wednesday to answer under seal when the plane took off and where, when it left U.S. airspace, when it landed "in which foreign country" and if it made "more than one stop," when individuals subject "solely" to President Trump's order were transferred out of U.S. custody and how many people were aboard solely on the basis of that order.
"The underlying premise of these orders … is that the Judicial Branch is superior to the Executive Branch, particularly on non-legal matters involving foreign affairs and national security … and the Court’s continued intrusions into the prerogatives of the Executive Branch, especially on a non-legal and factually irrelevant matter, should end," DOJ's filing says.
Boasberg responded that DOJ's argument was "at first blush … not persuasive" but gave the feds an extra day to answer his questions or invoke state secrets. He rebuked DOJ for how it characterized his questions, saying he's trying to "determine if the Government deliberately flouted" his orders "and, if so, what the consequences should be."
President Trump ramped up his calls to impeach Boasberg after Chief Justice John Roberts rebuked the proposal.
