I remember a documentary one time that showed it had actually been ratified by enough states, but they used the flimsy excuse that it "wasn't done in time", despite there being no such time limit. The timing of the war of 1812 was "purely coincidental", as was it's lack of later recognition. I have no sauce, but I also recall burying the amendment being part of the war ending negotiations. Despite that, many pre civil war textbooks did recognize it. After the Civil War, the reconstruction amendments were the final nail in the coffin.
But much like the alien enemies act, if someone did the leg work, it's waiting there to be used.
