There’s a reason for Gitmo.
It’s not on US soil.
US law applies (has jurisdiction over) to place, that being US soil. THE constitution applies nowhere else other than US soil. Gitmo was necessary for war and enemy combatants because if you brought them onto US soil suddenly civil jurisprudence applies and you’d be bogged down in a criminal ststem not capable of adjudicating war enemies.
They are not criminals. That is a legal definition for violators of statutory laws. So civil jurisprudence does not apply .
They are enemies. The military describes the regulations under which enemies are treated and tried. Gitmo is necessary so that can be done.
