The Constitution covers it all, and gives you due process. How it works:
YOU vote in the legislators.
YOU tell your legislators what laws you want, and call them up and tell them to vote nor or yes on laws others want.
Legislators make the laws.
–That's the role of the LEGISLATIVE branch under the Constitution, and the extent of your checks and balances on the legislators.
Now that you and your legislators have made the laws, Police enforce those laws you and your legislators made.
Police aren't the law makers. They also aren't judge or juries to argue with. All they are there for under the EXECUTIVE branch of the Constitution is executing the laws you and your legislators made.
And so the Cop enforces the laws of the legislative branch, and arrests you.

You get to tell your story to attorney first so they can protect your rights, and later to the judge and/or jury.
Judges are in the JUDICIAL branch under the Constitution. The judge judges your story against the laws you and your legislator made, and to the acts of the police officers in enforcing those laws you and your legislators made. Hence the phrase 'tell it to the judge' because no one else can do a legal thing with 'your side of the story'.
It doesn't always work perfectly, and 'rules for radicals' spins it so you think the Constitutional system doesn't work at all..because they'll fix all your problems (that they created) with Communism! But that's really beside the point.
Because when you get found NOT GUILTY, Constitutional checks and balances burst into action then too. The judge can rule the law was unconstitutional. or rule the cops' acts were unconstitutional. That's how the JUDICIAL BRANCH checks and balances the LEGISLATIVE branch and the EXECUTIVE branch. Working as intended.
And you think somehow you can change any step of this Constitutional process or force it, by laying on the ground handcuffed and shouting and kicking till you get tasered. Because Rules for Radicals told you in the 1960s that it would totally work if you did that.
Nobody reads the TOS for anything, but really come on, you should read the Constitution.
