Well that is a good argument and it could be correct, because of the word "any" person, but remember, they just gave the definition of All persons in the 14th born or naturalized in the US, so any in this case denotes those persons.
But regardless of it all, if you read the 5th entitled to a presentment or Grand Jury is negated when there is "public danger". And on that point, it is easily provable for most of those that are being captured because they already have a record. So Trump can win on this point alone.
