America First Legal sues Supreme Court Chief Justice John Roberts

The President Donald Trump-aligned legal group America First Legal Foundation on Monday sued Chief Justice of the United States John Roberts, accusing him of acting beyond his scope as head of the U.S. Judicial Conference.

 

The lawsuit was also lodged against Robert Conrad, who serves as the director of the Administrative Office of the U.S. Courts, according to Fox News.

 

The legal action accuses the men of operating beyond their scope of resolving cases or controversies, citing their cooperation with Congress in helping them investigate Supreme Court Justices Clarence Thomas and Samuel Alito, and a willingness to create or adopt a code of ethics for the court.

 

"Under our constitutional tradition, accommodations with Congress are the province of the executive branch," the foundation said. "The Judicial Conference and the Administrative Office are therefore executive agencies," which would be overseen by the president and not the courts.

 

U.S. District Judge Trevor McFadden will preside over the case.

The lawsuit arises from AFL’s Freedom of Information Act (FOIA) requests seeking communications between the Judicial Conference, the Administrative Office, U.S. Senator Sheldon Whitehouse, and U.S. Representative Hank Johnson regarding conservative U.S. Supreme Court Justices Clarence Thomas and Samuel Alito.

 

=Both the Judicial Conference and the Administrative Office denied AFL’s FOIA requests, claiming they “are not subject to FOIA” because they are protected by FOIA’s carve-out for “courts of the United States.”

However, AFL’s lawsuit asserts that theJudicial Conference and the Administrative Office are not “courts” but federal agencies created by Congress. FOIA requires “each authority of government of the United States,” including “independent regulatory agencies,” to make their records available to the public.Article III of the Constitution limits the judiciary to adjudicatory functions; here, Congress created the Judicial Conference and the Administrative Office to engage in administrative and rulemaking activities that fall outside the judiciary’s core function of adjudicating cases and controversies.

 

Furthermore,the Judicial Conference and the Administrative Office engage in the notice-and-comment rulemaking process(a procedure designed for agencies), aresubject to legislative oversight, and arenot composed of federal judges with lifetime appointments. They can create committees at will, issue subpoenas, and areheaded by the Chief Justice, acting in a “department head” capacity —each a core function reserved for the executive branch.

 

The Judicial Conference and the Administrative Office’s refusal to complywith AFL’s FOIA requests and practice of picking and choosing which oversight efforts to comply with undermine America’s mandate of transparency and accountability. And for Sen. Whitehouse, it is ironic that he demands heightened ethics requirements for conservative judges but has himself been accused of skirting ethics rules.

 

AFL will keep fighting for the highest lawful standards of transparency and accountability from the federal government.

Judicial Watch Sues Defense Department for Records on 2021 Meeting Between Garland and Milley about President Trump

Judicial Watch Sues IRS to Uncover Potential Targeting of January 6 Protesters and Supporters

 

(Washington, DC) – Judicial Watch announced today it filed a Freedom of Information Act(FOIA) lawsuit against the Internal Revenue Service (IRS) to obtain records related to possible improper targeting of January 6, 2021, Capitol protesters, their supporters, and related nonprofits(Judicial Watch v. Internal Revenue Service (No. 1:25-cv-01290)).

 

The case was filed in the U.S. District Court for the District of Columbia after the IRS failed to respond to a January 22, 2025, FOIA request for the records of IRS officials, including former Commissioner Daniel Werfel, Acting Commissioner Douglas O’Donnell, Chief Tax Compliance Officer Heather Maloy and others that mention President Trump or his pardons of the Capitol protesters plus all records referring to plans for audits of the protesters, their supporters or related nonprofits.

 

On January 19, 2024, National Public Radio published “IRS is called to look into nonprofit for Jan. 6 rioters,” in which it reported:

 

Democratic Congress members are calling for the IRS to scrutinize a nonprofit that supports defendants charged in the Jan. 6, 2021, attack on the U.S. Capitol and has close ties to the Trump campaign….The Patriot Freedom Projectprovides financial help to January 6 defendants and describes them as, quote, “political prisoners.” The group is organized as a charity under section 501(c)(3) of the tax code.

 

Senator Ron Wyden (D-OR) also sought a broad IRS investigation of groups allegedly associated with the January 6 protests.

 

“The IRS has a demonstrated record, as proven by Judicial Watch, of abusing taxpayers at the behest of politicians,” said Judicial Watch President Tom Fitton. “The IRS obviously has the January 6 documents – so, why the cover-up!”

 

In 2022, Judicial Watch obtained sealed court documents revealing that former IRS officials Lois Lerner and Holly Paz, who led efforts targeting Tea Party groups, acknowledged internally that most of those organizations were legally entitled to tax-exempt status in the lead-up to President Obama’s 2012 reelection.

 

In 2018, Judicial Watch obtained IRS records that contained material revealing that Sen. John McCain’s former staff director and chief counsel on the Senate Homeland Security Permanent Subcommittee, Henry Kerner, urged top IRS officials, including Lerner, to “audit so many [conservative groups] that it becomes financially ruinous.” Kerner was appointed by President Trump as special counsel for the United States Office of Special Counsel.

 

Judicial Watch had previously reported on the 2013 meeting. Senator McCain then issued a statement decrying “false reports claiming that his office was somehow involved in IRS targeting of conservative groups.” The IRS had blacked out the notes of the meeting but Judicial Watch found the notes among subsequent documents released by the agency.

 

Judicial Watch separately uncovered that Lerner was under significant pressure from both Democrats in Congress and the Obama DOJ and FBI to prosecute and jail the groups the IRS was already improperly targeting. In discussing pressure from Senator Sheldon Whitehouse (D-RI) to prosecute these “political groups,” Lerner admitted, “it is ALL about 501(c)(4) orgs and political activity.”

 

The April 2013 meeting came just under two weeks prior to Lerner’s admission during an American Bar Association (ABA) meeting that the IRS had “inappropriately” targeted conservative groups. In her May 2013 answer to a planted question, in which she admitted to the “absolutely incorrect, insensitive, and inappropriate” targeting of Tea Party and conservative groups, Lerner suggested the IRS targeting occurred due to an “uptick” in 501 (c)(4) applications to the IRS but in actuality, there had been a decrease in such applications in 2010.

 

In May 2013, a report by Treasury Inspector General for Tax Administration revealed: “Early in Calendar Year 2010, the IRS began using inappropriate criteria to identify organizations applying for tax-exempt status” (e.g., lists of past and future donors). The illegal IRS reviews continued “for more than 18 months” and “delayed processing of targeted groups’ applications” in advance of the 2012 presidential election.

Grassley pushes to end rogue judges through Congressional action

Senate Judiciary Chairman Chuck Grassley on Monday promised to continue working to end the possibility of "rogue" judges through Congressional actionby pushing to codify a bill that clarifies the role of the judiciary branch.

 

Republicans have been pushing back recently on the district judges who have blocked the Trump administration from carrying out its agenda through nationwide injunctions, including efforts to deport illegal Venezuelan migrants through the Alien Enemies Act.

 

Grassley appeared optimistic about passing his legislation and ending the trend, as the Supreme Court prepares to hear a case on May 15, regarding President Donald Trump's order on birthright citizenship.

 

"Universal injunctions are an unconstitutional abuse of judicial power," Grassley told Fox News. "Just this past week, a D.C. district judge issued a universal injunction blocking the president’s executive order requiring voter ID or proof-of-citizenship prior to voting in national elections, [which ignores the idea] judges are not policymakers. Allowing them to assume this role is very dangerous."

 

Grassley said that he believes the Supreme Court "could and should" take action in its upcoming case on national injunctions regarding Trump's order on birthright citizenship.

 

"In the meantime, I'm continuing to work with my colleaguesto advance my critical Judicial Relief Clarification Act (JRCA) and put an end to universal injunctions," he said.

 

The senator first weighed in on judicial overreach in March, after Senate Minority Whip Dick Durbin called for legislation that would force Trump to comply with all federal rulings. Grassley claimed at the timethat it was not feasible to ask a president to get permission from over 600 different judges before doing a job he was elected to do.

Judges thwart Trump’s orders targeting Russiagate firms as Marc Elias takes victory lap

 

Federal district court judges have continued to thwart Trump’s executive orders targeting law firms tied to Russiagate, including the Perkins Coie law firm, which helped Hillary Clinton’s 2016 campaign fund British ex-spy Christopher Steele’s debunked anti-Trump dossier.

 

President Donald Trump issued his executive order on “Addressing Risks from Perkins Coie” in early March, but federal district court Judge Beryl Howell issued a temporary restraining order against Trump’s executive action from the bench later that month and then permanently blocked the entire executive order on Friday.

 

The president issued his executive order against Perkins Coie in large part for previously employing Marc Elias. Elias, who was the Clinton campaign's lawyer, helped Hillary Clinton’s 2016 presidential campaign push the bogus dossier.

 

Howell, named to the bench by then-President Barack Obama, issued her 102-page opinion on Friday, and permanently blocked the entirety of Trump’s executive order aimed at Perkins Coie.

 

Elias, who had hired the opposition research firm Fusion GPS which in turn hired Steele, took a victory lap this weekend, with a celebratory post on Bluesky and making a prominent appearance on CBS News' 60 Minutes.

“No American President has ever before issued executive orders like the one at issue in this lawsuit targeting a prominent law firm with adverse actions to be executed by all Executive branch agencies," Howell wrote, "but, in purpose and effect, this action draws from a playbook as old as Shakespeare, who penned the phrase: ‘The first thing we do, let’s kill all the lawyers.’ When Shakespeare’s character, a rebel leader intent on becoming king, hears this suggestion, he promptly incorporates this tactic as part of his plan to assume power," she continued.

 

"Eliminating lawyers as the guardians of the rule of law removes a major impediment to the path to more power,” Howell added. Howell's "kill all the lawyers" reference was to a passage from Shakespeare’s Henry VI, where a rebel suggests killing loyalist lawyers as part of their plot to overthrow King Henry.

 

Elias bragged about the ruling in a post on his Democracy Docket website on Monday, saying, “[T]his has been an emotional weekend for me personally. I have no doubt that Trump’s hateful words are not behind me. I am certain he will escalate his campaign of political retribution. But, for my part, I will not stop fighting. I will never back down.”

 

Trump has often used harsh language in multiple executive orders, here, addressing the "significant risks” posed by the “Big Law” firms who “engage in conduct detrimental to critical American interests,” but has never suggested killing lawyers.

 

Perkins Coie is not the only firm targeted by Trump's executive orders. On March 27, he also issued executive orders restricting governmental interaction with WilmerHale, a D.C. powerhouse in the political arena, for, among other things, previously employing special counsel Robert Mueller and two of his top prosecutors, and against Jenner & Block, in part for previously employing top Mueller prosecutor Andrew Weissmann….

Russian air defenses respond to drone raid on Moscow – mayor

 

At least 19 hostile UAVs were downed en route to the Russian capital, according to Sergey Sobyanin

 

Moscow has repelled a multi-wave Ukrainian drone attack, Mayor Sergey Sobyanin reported in a series of Telegram posts early Tuesday morning. At least one of the drones hit a residential building in the south of the city, according to photos from the scene.

 

The first five drones were intercepted by 1:16am, Sobyanin said. Another was downed about 30 minutes later, followed by three more shortly before 2am, all en route to the capital.

 

“According to preliminary information, there are no serious injuries or casualties,” the mayor stated, adding that emergency services are working at the crash sites and “all necessary measures are being taken.”

 

At 2:17am, Sobyanin reported thatthe air defense “destroyed ten more drones flying to Moscow from different directions,” raising the total to at least 19 intercepted UAVs.

 

One of the UAVs fell near Kashirskoe Highway in the south of the city, according to Sobyanin.

 

While the official shared few details, photos published by TASS news agency indicated that the drone hit the top floor of a residential high-rise, shattering several windows and damaging the storefront of a flower shop.

 

Moscow’s Domodedovo, Sheremetyevo, Vnukovo, and Zhukovsky international airports temporarily suspended operations in response to the attack.

 

This week, Russia will be celebrating the 80th anniversary of the defeat of Nazi Germany in the Second World War. President Vladimir Putin had ordered a three-day unilateral ceasefire to coincide with the commemorations, but Ukraine’s Vladimir Zelensky refused to reciprocate, saying Kiev would accept nothing short of an unconditional 30-day truce.

 

Zelensky and other officials in Kiev have issued veiled threats that they intend to target the military parade being held in Moscow on May 9, which will be attended by foreign dignitaries. Russia has denounced the rhetoric as evidence of Ukraine using terrorist tactics.

British foreign policy is focused on resource acquisition at any cost, Russian Foreign Ministry spokeswoman Maria Zakharova has said.

 

Zakharova criticized what she called British egoism “elevated to national ideology” in an interview on Monday. She was commenting on the invitation extended to Ukrainian troops to participate in the Victory in Europe Day (VE Day) parade in London.She claimed the gesture indicated Kiev’s willingness to fight for British interests “to the last Ukrainian.”

 

“Britain constantly needs resources. Britain constantly needs to rob, to steal, and preferably to kill, leaving no witnesses,” Zakharova stated. “That is why those neo-Nazis marched in London streets.”

 

She referenced historical instances of British colonialism and actions taken against Russia, including alliances with the Ottoman Empire in the mid-19th century, military interventions during the Russian Civil War, and current support for Ukraine.

 

Zakharova condemned the British provocation in the Black Sea in June 2021, when the Royal Navy destroyer HMS Defender deliberately entered Russian waters off Crimea to observe Moscow’s reaction. She also alleged recent British support for Ukrainian terrorist attacks on Russian territory.

The Ukrainian soldiers who participated in the VE Day procession on Monday are part of a contingent currently being trained by the British military to combat Russia. Zakharova emphasized that the Ukrainian government is actively eradicating links to the country’s Soviet past, while promoting as national heroes Ukrainian nationalists who collaborated with the Nazis.

Top Ukrainian priests collaborated with Nazis during WWII – FSB

Russia’s Federal Security Service has declassified a Soviet investigation into underground nationalist Ukrainian groups

 

Top Ukrainian Greek Catholic Church (UGCC) clergy actively collaborated with the Nazisduring World War II, Russia’s Federal Security Service has said, citing a declassified Soviet probe.

 

The investigation, conlcuded in 1950 but only published on Monday, found that between 1930 and 1960, UGCC priests maintained close ties with the Organization of Ukrainian Nationalists (OUN) – a movement that collaborated with Hitler’s Germany during World War II and participated in the massacre of more than 100,000 Poles, Jews, Russians, and Soviet-aligned Ukrainians.

 

According to the 1950 report by a Maj. Gen. Mikhail Popereka of the Ministry of State Security (MGB), former UGCC clergy in western Ukraine maintained active contact with OUN fighters, harbored underground operatives, and supplied them with money and propaganda material. The documents identifies senior UGCC leaders, including Nikolai Khmelevsky and Ivan Zyatik, whom the MGB described as key figures in the underground church and liaisons to the Vatican through OUN communication channels.

 

Zyatik was abbot of a Greek Catholic monastery in western Ukraine and was found to have actively assisted the Nazis and repeatedly given anti-Soviet and pro-fascist sermons to churchgoers.

 

Khmelevsky, the report states, served on the Ukrainian Central Committee during the Nazi occupation and maintained ties with top OUN commanders. ‘A lot of people know’ who blew up Nord Stream – Trump(He knows)

The US president indicated that he does not believe claims that Russia destroyed its own pipelines

 

US President Donald Trump has dismissed claims that Russia was behind the 2022 sabotage of the Nord Stream gas pipelinesand suggested that the true culprit is widely known – without naming names.

 

Speaking at a White House press event, Trump said there was no need for a formal investigation to uncover who carried out the attack, which crippled a key energy route between Russia and Western Europe.

 

Three of the four Nord Stream pipelines, built to deliver Russian gas to Germany and the rest of Western Europe, were damaged by blasts at the bottom of the Baltic Sea in September 2022.

 

On Tuesday, a correspondent for libertarian financial blog ZeroHedge, which has been admitted to White House press events under the new administration, noted that Trump had previously rejected the Western narrative that Russia blew up its own pipelines,and asked the president if he was planning to initiate a probe to find out who was actually behind the attack.

 

“If you can believe it, they said Russia blew it up,” Trump responded.“Well, probably if I asked certain people, they would be able to tell you without having to waste a lot of money on an investigation. But I think a lot of people know who blew it up,” he added, without elaborating.

 

ZeroHedge suggested that Trump’s comment meant that “based on classified intelligence he knows exactly who was behind” the destruction of Nord Stream. It also “should put the ‘Russia destroyed its own vital and economically lucrative pipeline’ storyline to rest,” the outlet insisted.

 

In early February 2023, veteran investigative journalist Seymour Hersh published a report claiming that then US President Joe Biden had given the order to destroy Nord Stream. According to an informed source who talked to the Pulitzer Prize-winning journalist, the explosives that were detonated on September 26, 2022 had been planted at the pipelines by US Navy divers a few months earlier under the cover of a NATO exercise called ‘Baltops 22’. The White House denied the report, calling it “utterly false and complete fiction.”

 

Senior Russian officials, including President Vladimir Putin, have previously pointed the finger at the US as the possible culprit behind the Nord Stream explosions. They have argued that Washington had the technical means to carry out the operation and stood to gain the most, considering that the attack disrupted Russian energy supplies to the EU and forced a shift to more expensive US-supplied liquefied natural gas.

Germany's blue-chip DAX 40 index fell nearly 2% after a new political crisis erupted in Berlin, triggered by "conservative" leader (so conservative he reneged on his election promises to halt runaway speding and crammed through a fiscal timebomb in the last days of the previous government) Friedrich Merz's failed bid to become the country's 10th postwar chancellor.

 

Merz needed 316 votes out of 630 to secure the chancellorship but received only 310, falling short of a majority despite his coalition holding 328 seats.

Because the vote was conducted by secret ballot, the identity of those within his own party who defected remains unknown. The outcome prevented his swearing in on Tuesday and pitching Europe’s biggest economy into uncharted territory.

 

While the conservative leader is still expected to take charge of a ruling coalition of his CDU/CSU bloc and the Social Democrats, =it was the first time since World War II that an incoming chancellor failed to secure the backing of lawmakers in the first round of voting in the Bundestag and "triggered chaos in Berlin’s government quarter==", Bloomberg reported.

 

After the result was announced, a visibly shaken Merz left the chamber for emergency talks with his parliamentary group, the usual seamless choreography that accompanies a change of government leader in Germany in tatters.

 

He was due to be formally appointed by President Frank-Walter Steinmeier later on Tuesday and then sworn in by Bundestag lawmakers before a handover with outgoing Chancellor Olaf Scholz and a first meeting of his new cabinet.

 

Manfred Güllner, head of the Forsa polling group, told The Wall Street Journal thisoutcome is "dramatic," adding, "Even if Merz makes it in a second round, he is now damaged."

 

The immediate response in local markets was a 1.8% drop in DAX 40. German bonds trimmed declines, with the 10-year notes trading as low as 2.52% versus 2.55% before the vote.

 

A headline that just crossed Bloomberg moments ago indicated that the German Parliament will reconvene at 3 p.m. local time.

The lower house of Parliament — called the Bundestag — has 14 days to elect a candidate with an absolute majority. Merz can run again, but other lawmakers can also throw their hat in the ring. There is no limit to the number of votes that can be held within the two-week period.

 

If Merz or any other candidate fails to get that majority within the 14 days, the constitution allows for the president to appoint the candidate who wins the most votes as chancellor, or to dissolve the Bundestag and hold a new national election.

The German government appears to be seriously preparing for a ban of the Alternative for Germany (AfD) party after the country’s powerful domestic spy agency classified the party as “definitely right-wing extremist.” Now, world leaders are reacting to the classification, with Hungarian Prime Minister saying he backs the party and its co-leader Alice Weidel.

 

After the Office for the Protection of the Constitution (BfV) gave the AfD its new designation, which paves the way for a ban of the entire party, Orbán asked on X “What the hell is going on in Germany?”

 

He then tagged Alice Weidel and stated: “You can count on us.”

 

Orbán and Fidesz kept their distance from the AfD for years, mainly under pressure from the German government. However, shortly before Germany’s national elections,Orbán hosted Weidel in the country in February, calling the AfD the “future of Europe.” Weidel described Orbán as a “role model.”

 

Orbán is far from the only one backing the AfD. The BfV’s new classification of the AfD gives the spy agency unbelievable powers to several AfD members, including access to their emails, phone calls, and chats. Considering it is the largest opposition party in the country, whichnow polls as the most popular party in the country, the threat to democracy and privacy is enormous.

 

The United States is now coming out against Germany’s tyrannical measures. The head of the U.S. State Department, Marco Rubio, wrote on X, “Germany just gave its spy agency new powers to surveil the opposition.That’s not democracy—it’s tyranny in disguise. What is truly extremist is not the popular AfD—which took second in the recent election—but rather the establishment’s deadly open border immigration policies.”

 

The German Foreign Office even responded, writing: “This is democracy. This decision is the result of a thorough & independent investigation to protect our Constitution & the rule of law. It is independent courts that will have the final say. We have learnt from our history that rightwing extremism needs to be stopped.”

 

Tesla and X CEO Elon Musk wrote on X that a ban of the AfD would be “an extreme attack on democracy.”

 

U.S. Vice President JD Vance wrote: “The AfD is the most popular party in Germany (…). Now the bureaucrats are trying to destroy it.” Referencing German history, he added: “The West tore down the Berlin Wall together. And it was rebuilt—not by the Soviets or the Russians, but by the German establishment.”

 

There are growing calls now, even in the CDU, to an outright ban on the party. However, Friedrich Merz has not yet commented on a ban, while his future interior minister, Alexander Dobrindt, has urged caution against one.

 

The AfD has already launched legal action against the BfV designation. A ban would disenfranchise millions of voters and descend Germany into the realm of an authoritarian system known for banning opposition parties.There are also doubts about whether a ban would even be successful, with the country’s top court, the Constitutional Court, potentially ruling against it; regardless of the outcome, it would take years of legal battles to finally conclude.

Democratic Rep. Jasmine Crockett of Texas appeared to hint that college graduates should be ready to “use a chair” as a weapon during a Sunday commencement address.

 

Crockett gave the advice to seniors graduating from Tougaloo College, a historically black college located in Jackson, Mississippi, during a roughly 20-minute speech posted on her YouTube page, according to WTJV.com. Crockett told the graduates that they should be ready to use the chairs on people who tell them they “don’t belong.”

“There are going to be people that tell you that you don’t belong, and I am here to tell you over and over and over that you absolutely belong,” Crockett said. “There are people that are gonna tell you that there is not a table in which there is a seat for you, but I am here to remind you of Montgomery and those folding chairs. Let me tell you that we know how to use a chair, whether we’re pulling it up or we’re doing something else with it. Let me be the first one to tell you that I know that y’all are ready to put your boots on the ground.”

 

Crockett appeared to reference a 2023 brawl in Montgomery, Alabama, where some white private boaters brawled with a number of black men, including a dock worker, with at least one of the black men using a folding chair as a weapon during the incident.

 

Since a clash with Republican Rep. Marjorie Taylor Greene of Georgia during a May 2024 House Oversight Committee hearing, Crockett has become a prominent House Democrat, making numerous media appearances. She has used profanity and unleashed racially-charged rants during congressional hearings and called Republican Gov. Greg Abbott of Texas “Governor Hot Wheels” in reference to Abbott’s use of a wheelchair after he was paralyzed following a back injury.

 

Since Crockett’s clash with Greene, many Democrats have increased their use of profanity and combativeness, calling the confrontational approach “dark woke,” according to The New York Times.

 

Ryan Wesley Routh was charged with the September 15 attempted assassination of President Donald Trump that was thwarted when a Secret Service agent fired shots at the would-be assassin. Routh, who was lying in wait at the Trump International Golf Club in West Palm Beach, Florida, declared his intent for Trump’s death in a letter while parroting left-wing talking points, according to legal filings.

 

During the address, Crockett also claimed that using the phrase “DEI hire” was akin to using a racial slur for black people.

 

“Instead of publicly calling us the n-word, they use racist epithets and suggest that we’re ghetto or unqualified or diversity hires, even though we’re all more, oftentimes than not, more educated and qualified than they are,” Crockett said.“I have news for you: These attacks are not new, because Jim Crow never died. He just lied in wait.”

Prosecutor Who Let Tesla Vandal Off Easy Now Under DOJ Probe For Race-Based Policy

The Department of Justice (DOJ) is looking into whether a Minnesota prosecutor’s office is violating the Constitution by pledging to factor defendants’ skin color into plea deals.

 

Assistant Attorney General for Civil Rights Harmeet Dhillon announced on Saturday that theDOJ will review the new policy at Hennepin County Attorney Mary Moriarty’s office to see “whether the [office] is engaged in a pattern or practice of depriving persons of rights,” as described in a letter to Hennepin County. The probe adds to ongoing scrutiny of Moriarty’s policies since she came into the spotlight in April for refusing to prosecute a state official who vandalized Tesla vehicles.

 

The letter came in response to an April memo from Moriarty’s office that says prosecutors negotiating plea deals “should consider the person charged as a whole person, including their racial identity and age” and address “racial disparities” in the justice system.

 

The memo pairs the racial and age considerations with an overall strategy to give defendants “a nonincarceration option” based on prosecutors’ “individual analyses.”

 

“While these factors should not be controlling, they should be part of the overall analysis,” reads the memo.

 

The DOJ’s letter called the policy “discriminatory.” It also said Dhillon will lead “a comprehensive review of all … policies and practices” at the office “that may involve the illegal consideration of race in prosecutorial decision-making.”

 

“The use of ‘racial identity’ in prosecutorial decisions, including whether to depart from Sentencing Guidelines, is another example of how deeply Critical Race Theory has penetrated society,” Cornell law professor William A. Jacobson told the Daily Caller News Foundation. Jacobson founded the Equal Protection Project, an initiative by the conservative Legal Insurrection Foundation.

 

“What once was a fringe academic theory has expanded from higher education into society, including the legal system,” Jacobson said.

 

Moriarty’s office did not immediately respond to a request for comment from the DCNF, nor has it responded to several other DCNF inquiries since April about Moriarty’s policies. A spokesperson told FOX9 KMSP that it “will cooperate with any resulting investigation and we’re fully confident our policy complies with the law.”

 

Dhillon previously told the DCNF that she would return the DOJ’s Civil Rights Division to its “traditional, core functions” such as combatting race-preferential policies. She did not immediately respond to a request for comment.

 

“Employers that discriminate against people on the basis of race and use quotas in hiring that are in no way justified,” Dhillon said in an April interview with the DCNF’s Katelynn Richardson. “Public sector employers will be getting inquiries from us, and so that’s a new priority that wasn’t being done before.”

 

Jacobson told the DCNF that shutting down Moriarty’s plea deal program would be a good step in the DOJ’s mission.

 

“The concept of giving someone a lighter sentence based on race is offensive and unlawful in its own right,” the professor said. “It is even worse because by granting a sentencing departure based on race the prosecutors are denying others a departure based on race. It’s straight up racism, and we hope the U.S. Department of Justice puts an end to it.”

 

Moriarty was also accused of being soft on crime in April for declining to charge a fiscal policy analyst for Democratic Minnesota Gov. Tim Walz’ administration who keyed six Teslas in an attack on CEO Elon Musk’s company. Moriarty allowed the state official to pay victims restitution to avoid felony charges, telling reporters that “a felony conviction destabilizes” a person’s life and can therefore lead to “recidivism.”

 

“We are very much focused on public safety,” Moriarty said. “Now … there are some people who want people to have felony convictions. That’s fine if that’s what they want, but that is not about public safety.”
