If it is in a military state then the constitution is set a side for a period of time is the issue. This where when it is taken back up it will force them however to look at war crimes. This is partly why war crimes or trials exist. This where they or some people may be given more power then miss used it. I think they gave people power outside a more structured command that was installed. This is why the military although at few times may work outside is it if this is going on it is still needing approval likely any case or anytime reported is the thing.
