Those who had control of the autopen did not want to surrender their illegally seized power to anybody, especially the "Kackle." She would have wanted to actually BE in charge!!!

The supreme court is slow walking all the appeals of federal judges tramping on the executive branch. To solve the problem, they would have to make a ruling that only a co-equal branch of the federal government (that is, the Supreme Court, itself!) would have the power to suspend or stay any executive action. Problem is, the SC justices came up through the system (and as such have a personal and professional interest in the way they rule on these appeals). They don't want to limit the power of inferior courts, so they will not make the blanket ruling limiting the power of any federal judge, even if they are infringing on the rights and power of the executive branch. Therefore, Congress, and the President, together, need to put together such a limitation on the inferior courts, or the States will have to call for a constitutional convention for the purpose of limiting such power.
