Brazil in last-ditch lobbying push to avert US sanctions on top judge

Trump administration sympathetic to conservative arguments that free speech is under threat in South American country May 27, 2025

Brazil’s leftwing government is fighting a last-ditch diplomatic battle to stop the US imposing sanctions on a Brazilian supreme court judge overseeing a case in which ex-president Jair Bolsonaro is being prosecuted on coup-plotting charges.

US secretary of state Marco Rubio said last week that Washington was eyeing sanctions on leading justice Alexandre de Moraes, but Brazilian officials fear the threat of visa and financial sanctionswill put the two most populous nations in the Americas on a collision course.

“We are trying to stop the blood from reaching the river,” one official said, adding that foreign minister Mauro Vieira was co-ordinating the diplomatic push.

He said pressure on the White House from Big Tech companies, which have faced curbs imposed by Brazil’s top court, appeared to be helping sway the argument against the court in Washington.

Another said Brazil’s embassy in Washington was trying to explain “our reading of the facts”, arguing that freedom of expression and democracy were safe in Brazil.

The US government is increasingly sympathetic to arguments from Bolsonaro’s family and Brazilian conservativesthat former president Jair Bolsonaro, a Donald Trump ally, is a victim of political persecution and that free speech in Brazil is threatened.

Progressives in Brazil credit de Moraes with saving Brazil’s democracy while conservatives loathe him as an out-of-control censor.

Rubio said last week that sanctions on de Moraes under the Magnitsky Act, which targets foreign officials over corruption or human rights abuses, were “under review now”, adding=: “It’s a great possibility that will happen.”

Rubio’s remarks came after a lobbying campaign in the US by Bolsonaro’s congressman son Eduardo.

“I would say there is an 85 per cent chance of sanctions on Alexandre de Moraes,”Eduardo told the Financial Times in Washington. “If I had to bet my house on it, I would.”

Escalating the conflict further, de Moraes on Monday opened a criminal probe into Eduardoto investigate allegations of obstruction of justice and attempts to overthrow the rule of law, following a request from the attorney-general’s office.

“The actions of the [attorney-general’s office] and Alexandre de Moraes (again supposedly both victim and judge) just help corroborate exactly what we have been exposing here,” Eduardo Bolsonaro told the FT.

“It’s a nonsense which can only happen in a dictatorship with figures who are completely out of control.”

Maria Elvira Salazar, a Republican congresswoman from Florida, saidshe was in talks with the Trump administration about sanctions on the judge and “without doubt they are receptive”.

This confirms what Eduardo Bolsonaro’s said on Bannon

De Moraes launched a crackdown on fake news before the last election in 2022, bringing him into conflict with X owner and Trump ally Elon Musk.

Musk and other allies of Bolsonaro, a hard-right former army captain who governed between 2019 and 2022, argue de Moraes unfairly targets conservatives. They hope US sanctions will force concessions from Brazil’s supreme court.

“We are talking about saving freedom of expression, stopping persecution and retaining due process,” said conservative journalist Paulo Figueiredo, who moved to Miami after his social media accounts were blocked, and works with Eduardo.

Video-sharing platformRumbleand the US president’s Trump Media & Technology Group thisyear launched a Florida lawsuit against de Moraes, accusing him of “extraterritorial censorship” by ordering the suspension of the account of a Brazilian citizen in the US.

Martin De Luca, a partner at law firm Boies Schiller Flexner who worked on the case, accused Moraes of trying “to slip in through the back door by repeatedly sending secret court orders to American companies and targeting American citizens while bypassing the US government”.

De Moraes declined to comment on possible sanctions and accusations by critics.

A US state department senior Latin America adviser, Ricardo Pita, surprised officials during a visit to Brazil this month by meeting Jair Bolsonaro at his home.

The American embassy in Brasília said Pita visited as part of adelegation on fighting organised crime.

The state department declined to comment on potential sanctions.

Bolsonaro, 70, is standing trial on charges of plotting a military-backed coup to remain in power but denies wrongdoing. He has been banned from running for office until 2030 over campaign offences.

The Magnitsky Law and Its Potential Impact on Alexandre de Moraes and Brazil

Amsterdam, March 23rd, 2025 –The Magnitsky Act, originally enacted in the United States in 2012, is a powerful tool designed to sanction individuals accused of human rights violations and corruption. If President Donald Trump were to push for its application against Brazil’s Supreme CourtJustice Alexandre de Moraes, the consequences could ripple through both Moraes’ personal life and Brazil’s international standing.

Personal Consequences for Alexandre de Moraes

For Moraes, the application of the Magnitsky Act would be a significant blow.Sanctions under this law typically include freezing assets held in U.S. jurisdictions, barring entry into the United States, and restricting access to the U.S. financial system. Such measures could isolate Moraes from international networks and tarnish his reputation globally. Given his prominent role in Brazil’s judiciary, thesesanctions would also cast a shadow over his judicial decisions and his legacy.

National Implications for Brazil

On a national level, the application of the Magnitsky Act against a sitting Supreme Court justicewould be unprecedented and could strain Brazil-U.S. relations. It would likely ignite debates about judicial independence and the balance of power within Brazil. Domestically, it could polarize public opinion, with some viewing it as an overreach by foreign powers and others as a necessary step to uphold human rights and freedom of speech.

Brazil’s International Reputation

Brazil’s international reputation could face significant challenges. The country has long sought to position itself as a leader in Latin America and a key player on the global stage.Sanctions against a high-ranking official could raise questions about Brazil’s commitment to democratic principles and human rights. This could impact Brazil’s diplomatic relationships, trade negotiations, and its broader image as a stable and democratic nation.

Outlook: A Test for Brazil’s Global Standing

The potential application of the Magnitsky Actagainst Alexandre de Moraes would serve as alitmus test for Brazil’s judiciary and its adherence to international norms. While it could prompt introspection and reforms, it also risks deepening divisions within the country and complicating its foreign relations. For Brazil to navigate this challenge effectively,it will need to demonstrate a commitment to transparency, accountability, and the rule of law, ensuring that its actions align with its aspirations for global leadership.

Did Brazilian Justice Moraes just move his money out of the US? Musk responds

Source Cryptopolitan

Feb 25, 2025 08:40

Reports circulating on social media claim that Brazilian Supreme Court Justice Alexandre de Moraes has moved all his assets out of the United States. The allegations follow comments from the Department of Government Efficiency (DOGE) co-founderElon Musk asking if Moraes, currently facing two lawsuits in the US, owned property within the country’s jurisdiction.

On Wednesday, Trump Media & Technology Group (TMTG), which owns Truth Social, filed a lawsuit against Moraes in a US federal court in Tampa, Florida. The suit accuses the Brazilian justice of unlawfully censoring right-wing voices alongside the video-sharing social platform Rumble.

The legal action could force the Brazilian Supreme Court minister to appear physically in court. Owing to his ongoing feud with President Trump’s “First Buddy,” Elon Musk, netizens are now speculating that Moraes transferred his assets for fear of being penalized if found guilty.

“Sounds like he’s trying to hide his assets,” Musk shared on X.

Musk complains of censorship, Moraes cries fascism

On February 20, the Brazilian justice system ordered Musk’s social media platform X to pay 8.1 million reais ($1.42 million) for failing to comply with judicial orders. The fine stemmed from a legal case in which X was directed to remove one account accused of “spreading misinformation.”

Elon Musk shut down X’s Brazilian office in late August after firing all the social platform’s staff in the country, but X is still up and running in the country. At the time, he called the decision “difficult” but ridiculed Moraes’ orders as an abuse of power.

Moraes had previously demanded the removal of dozens of accounts accused of spreading hate speech, which Musk viewed as violating free speech principles.

Shortly after X’s closure in Brazil, Moraes escalated the standoff by ordering a nationwide block on the platform. This led to a surge in demand for VPNs as users sought to bypass restrictions, while some migrated to alternative social media platforms like Bluesky.

X began complying with court orders by September, which forced the hand of the Brazilian Court to lift the country-wide ban it had imposed on X.

According to local news publication Folha,Justice Moraes accused tech companies and social media platforms of using algorithms to spread a “fascist ideology,” manipulate political discourse, and amass wealth by focusing more “on engagements than truth.”

🇧🇷 ALEXANDRE DE MORAES: BIG TECH ARE A ‘FASCIST MACHINE’ FOR POWER AND PROFIT

Brazil’s Supreme Court Justice Alexandre de Moraes claims tech giants are using algorithms to push a “fascist ideology,” influence politics, and rake in massive profits.

He says they amplify outrage… https://t.co/NLGukbxnlw pic.twitter.com/Xkyv69LZaT

— Mario Nawfal (@MarioNawfal) February 25, 2025

Still, his critics assert that social media platforms are not manufacturing discontent; Brazilians use these platforms to voice genuine frustration with the government and Supreme Court decisions.

Lawsuits pile on Moraes

According to Folha, Trump Media and Rumble are challenging Moraes’ orders, which demanded the latter shut down the account of right-wing commentator Allan dos Santos and hand over all of his user data. The plaintiffs argue that these orders violate US sovereignty, constitution, and American law.

Moraes had allegedly issued the orders in secret and capped Rumble from disclosing their contents. The video platform previously left Brazil in December 2023, citing what it described as unjust censorship demands from Moraes. These included orders to ban multiple content creators, including elected members of Brazil’s Congress.

In January 2023, leaked documents revealed that Moraes had issued directives to multiple social platforms, including Rumble, giving them only two hours to comply or face substantial fines. In response, Rumble opted to suspend its operations in Brazil rather than comply.

Pressure from the Trump administrationand Elon Musk, who both vowed to shield American technology companies from foreign censorship, forced Moraes to reverse an order against one account belonging to podcaster Monark.

However, almost immediately, Moraes reportedly made new directives to Rumble’s former lawyers in Brazil, instructing them to represent the company again so they could receive more judicial orders on its behalf.

Attorneys representing the company affiliated with President Trump argue that restricting Rumble’s operations in Brazil also impacts its business, as the platform provides services necessary for maintaining the data servers of the Truth Social network.

Victor Davis Hanson: Trump Must Avoid These 3 ‘Civilization Killers’ When Tackling the National Debt

Donald Trump is the first U.S. President in over 30 years who is seriously talking about reducing the country’s budget deficit, trade deficit and yes, the national debt, which has ballooned to over $37 trillion.

However, he must follow a specific formula, otherwise, it will end in tragedy, argues Victor Davis Hanson on today’s edition of “Victor Davis Hanson: In His Own Words:”

“Jermone Powell, the head of the Fed, will not lower interest rates even though there's been a good jobs report, a good inflation report, a good corporate profits report. GDP is gonna be evaluated, apparently, upward and there's been low energy cost. That mortgage is still 4.25% Fed rate to 4.5%. And that means mortgages are still 6.5%, 7%. And that housing market is slowing as a result.

“So, you've got to get that down. And the way Trump has to do it is just two ways: Either cut the budget or raise taxes—which will strangle the economy—or continue the tax cuts. And hope two things: that the tax cuts—the extension—will prime the economy, along with cheap interest rates.

And the question that we all have now: Is cutting taxes on tips, is cutting taxes on Social Security, is cutting taxes on first responder, etc.—all of which Trump has mentioned—is that really stimulus as opposed to, say, accelerated depreciation investment for businesses? I don't know the answer. But I do know, as a historian, that if you do not cut the deficit and the national debt and you have bond raters like Moody's or the Fed that will not lower interest rates, you're going to be in a crisis.”

Donald Trump's approval rating skyrockets with Hispanics

Story by Kate Plummer • 1d

Newsweek hides the data paragraphs down!

President Donald Trump's approval rating has increased among Hispanic voters, a new poll has revealed.

According to new polling, Trump's approval rating among this demographic has increased by 22 percent in a month.

Why It Matters

Despite frequently facing criticism for hard-line immigration policies that target migrants from countries in Latin America, Trump has recently made significant gains in favorability and approval among Hispanic Americans.

Hispanic voters were one of the key groups who proved important in securing Trump's win in the November 2024 election. The demographic has generally leaned Democratic, but Trump increased his share of the Hispanic vote from 16 percent in 2016 to 42 percent in 2024.

What To Know

According to an InsiderAdvantage poll of 1,000 likely voters,59.6 percent of Hispanics approve of Trump's job performance while 40.4 percent disapprove. The poll was conducted between May 17 and 19 and had a margin of error of 3.09 percent.

This is roughly a 22-percentage point increase from an earlier poll—when 1,200 likely voters were surveyed on April 30 and May 1—that found that 38.4 percent of Hispanics approved of Trump and 42 percent disapproved

This poll had a margin of error of 2.83 percent.

A Civiqs/Daily Kos poll, conducted between May 17 and 20 among 1,018 registered voters, showed Trump's approval rating increasing by 15 points among Hispanic voters to 57 percent from 42 in April.

(Of course)However, an April CNN pollfound the proportion of Hispanic Americans who approve of Trump had dropped by 13 points since February,

More general polls have been less favorable for the president. An RMG Research/Napolitan News poll, conducted between May 14-21 among 3,000 registered voters, showed Trump's approval rating at 48 percent, while 50 percent disapproved. The poll had a margin of error of +/- 1.8 percentage points.

What People Are Saying

Mark Shanahan, an American politics expert who teaches at the University of Surrey in the U.K, told Newsweek: "We're in a period of yo-yo polling, often among the same demographics, which pretty much reflects the president's current yo-yo policies, especially around trade. For Hispanic voters, the two policy areas that have moved the dial most for them are the economy and immigration and their positive/negative view of the president can change within a couple of news cycles."

"On immigration, many established Hispanic-heritage citizens are supportive of Trump's fairly extreme policy towards undocumented immigrants and their families, while others, perhaps with more recent ties to Central and South America, are solidly against this administration's actions," he continued.

He added: "On the economy, it has looked recently as if Trump has rolled back a little from his confrontational stance on tariffs, and markets have settled down. We've seen oil prices tumble, and even the price of eggs is dropping away. So, while these may not actually be concrete signs of an improved U.S. economy, some voters are seeing them that way. The Trump administration is still a roller-coaster ride, and it's far too early to claim on the evidence of one poll that he's succeeding in office."

Clarissa Martinez De Castro, vice president of the Latino Vote Initiative at UnidosUS previously, told Newsweekthat "partisan patterns seem to be holding." "In this early days of the administration, partisan patterns seem to be holding, withLatinos who voted for President Trump largely staying put," she said.

In April, Trump told Fox News: "The Hispanic people have been supportive of me like no other candidate but certainly no other Republicancandidate."

"I love them, they love me."

What Happens Next

Trump's approval ratings will likely fluctuate throughout his presidency. The extent to which he commands public support will be tested in the November 2026 midterm elections.
