Judicial Watch Announces $4.975 Million Settlement of Ashli Babbitt Wrongful Death Lawsuit with U.S. Government

 

(Washington, DC) – Judicial Watch announced a $4.975 million settlement today in the wrongful death lawsuit against the U.S. Government filed on behalf of the family of Ashli Babbitt, the U.S. Air Force veteran who was shot and killed inside the U.S. Capitol by then-Capitol Police Lt. Michael Byrd on January 6, 2021. Ashli Babbitt was the only January 6 homicide victim.

 

“This fair settlement is a historic and necessary step for justice for Ashli Babbitt’s family. Ashli should never have been killed, and this settlement destroys the evil, partisan narrative that justified her outrageous killing and protected her killer,” said Judicial Watch President Tom Fitton. “Judicial Watch’s team spent years investigating, litigating, and exposing the truth about Ashli’s homicide. And credit goes to the hundreds of thousands of Judicial Watch supporters who fought this cause! President Trump was an absolute rock in supporting Ashli’s family and advocating for justice!”

 

Babbitt, 35, owned and operated a successful pool business with her husband Aaron. Ashli traveled alone from San Diego to Washington, DC, to attend the Women for America First (aka Save America) rally on January 6, 2021, at the Ellipse near the White House.

 

The wrongful death lawsuit was filed in San Diego, California, Ashli’s home venue, on January 5, 2024, against the U.S. Government on behalf of the family of Ashli Babbitt and transferred to the District of Columbia over objection (Estate of Ashli Babbitt and Aaron Babbitt, et al. v. United States of America (No. 1:24-cv-01701 (formerly 3:24-cv-00033)). In settling the lawsuit, the parties signed a “Stipulation for Compromise Settlement and Release:”

 

to settle and compromise each and every claim of any kind, whether known or unknown, including claims for wrongful death, arising directly or indirectly from the acts or omissions that gave rise to the above-captioned action under the terms and conditions set forth in this Stipulation.

 

This Stipulation is not and should not be construed as, an admission of liability or fault on the part of the United States, its agents, servants, or employees, and it is specifically denied that they are liable to Plaintiffs. This settlement is entered into by all parties for the purpose of compromising disputed claims under the Federal Tort Claims Act and avoiding the expenses and risks of further litigation.

 

In consideration for the Plaintiffs’ agreement to accept the terms and conditions of this settlement, the United States agrees to pay Plaintiffs the amount of Four Million, Nine Hundred and Seventy-Five Thousand Dollars ($4,975,000.00)…

 

The lawsuit included claims against the U.S. Government for wrongful death, assault and battery, and various negligence claims.

 

As the Babbitt family alleged in its lawsuit:

 

The shooting occurred at the east entrance to the Speaker’s Lobby. After demonstrators filled the hallway outside the lobby, two individuals in the crowded, tightly packed hallway struck and dislodged the glass panels in the lobby doors and the right door sidelight. Lt. Byrd, who is a United States Capitol Police commander and was the incident commander for the House on January 6, 2021, shot Ashli on sight as she raised herself up into the opening of the right door sidelight. Lt. Byrd later confessed that he shot Ashli before seeing her hands or assessing her intentions or even identifying her as female. Ashli was unarmed. Her hands were up in the air, empty, and in plain view of Lt. Byrd and other officers in the lobby.

The facts speak truth. Ashli was ambushed when she was shot by Lt. Byrd. Multiple witnesses at the scene yelled, “you just murdered her.”

 

Lt. Byrd was never charged or otherwise punished or disciplined for Ashli’s homicide.

 

The lawsuit also alleged:

 

Lt. Byrd, who is a (U.S. Capitol Police) commander and was the incident commander for the House on January 6, 2021, shot Ashli as she raised herself up into the opening of the right door sidelight.… Not one member of Congress was in the lobby, which was guarded by multiple armed police officers. Additional armed police officers were in the hallway outside the lobby and/or on the adjoining stairway. Ashli could not have seen Lt. Byrd, who was positioned far to Ashli’s left and on the opposite side of the doors, near an opening to the Retiring Room, a distance of approximately 15 feet and an angle of approximately 160 degrees. Sgt. Timothy Lively, one of the armed officers guarding the lobby doors from the hallway, later told officials investigating the shooting, “I saw him . . . there was no way that woman would’ve seen that.” Lt. Byrd, who was not in uniform, did not identify himself as a police officer or otherwise make his presence known to Ashli. Lt. Byrd did not give Ashli any warnings or commands before shooting her dead.

 

The lawsuit had been set for trial in 2026.

 

Judicial Watch has been pursuing five lawsuits to secure transparency regarding Babbit’s death and other government activities on January 6.

 

In January 2023, documents from the Department of the Air Force, Joint Base Andrews, MD, showed Byrd was housed at taxpayer expense at Joint Base Andrews after he shot and killed Babbitt inside the U.S. Capitol on January 6, 2021.

 

In November 2021, Judicial Watch released multiple audio, visual and photo records from the DC Metropolitan Police Department about the shooting death of Babbitt in the U.S. Capitol Building. The records included a cell phone video of the shooting and an audio of a brief police interview of the shooter, Byrd.

 

In October 2021, Judicial Watch uncovered records from the DC Metropolitan Police about the shooting death of Babbitt. The new records include the January 6, 2021, Metro PD Death Report for Babbitt (identified as Ashli Elizabeth McEntee-Babbitt Pamatian). The investigators note that the possible Manner of Death was “Homicide [Police Involved Shooting].”

A Chinese-owned Battery Plant in South Carolina Halts Construction

 

A Chinese-owned company is halting construction of an electric-vehicle battery plant in South Carolina, in part because of the Trump administration’s tariffs and a potential loss of federal subsidies for clean energy.

 

Automotive Energy Supply Corp., or AESC, began construction of the $1.6 billion factory in Florence in 2023, after securing a deal with BMW to make battery cells for the German automaker.

 

In a message to employees on Thursday afternoon, AESC’s top U.S. executive said the company was pausing construction work because of “economic uncertainty arising from current federal policy and tax issues.”

 

“Our intent is to finish construction of the facility once stability and predictability have returned to the market,” Knudt Flor, AESC’s chief executive for the U.S. and Europe, wrote in the memo.

 

While construction of the physical buildings is nearly complete, the work of installing equipment and assembly lines has halted, said current and former employees.

 

Some of the employees said AESC would face a hefty tariff bill for the machinery if they imported it now, because it is mostly brought in from China.

 

Tariffs on Chinese imports have fluctuated wildly since April, rising to as high as 145%, before falling again amid a truce between Washington and Beijing as the two sides try to come to an agreement.

 

Separately, tariffs on steel and aluminum recently announced by President Trump, as well as on machinery containing the metals, only adds to AESC’s costs, two of the people said.

 

Battery plants were already under pressure before Trump’s election, because carmakers had delayed or walked back their plans for new electric vehicles.

 

Billions of dollars were poured into building new battery factories in recent years, spurred on by the subsidies from the Biden administration. Many of these factories were constructed in the Midwest and Southeast of the U.S., in a region that came to be called the Battery Belt.

 

Now many of those subsidies are being targeted by Republicans at the same time regulations and tax credits aimed at driving EV sales are also at risk.

 

The current version of a tax bill before Congress would end EV battery production subsidies a year early and make them unavailable to companies with ties to certain countries, including China.

 

AESC’s headquarters is in Japan, but it is majority-owned by China’s Envision Group, which purchased the battery-making unit of Japanese automaker Nissan in 2018.

 

“AESC has invested over $1 billion into the Florence facility, and we anticipate being able to resume construction once circumstances stabilize. AESC fully intends to meet our commitments to invest $1.6 billion and create 1,600 jobs in the coming years,” the company said.

 

The AESC factory is supposed to supply battery cells to a new BMW factory in Woodruff, S.C. Under the original deal, these batteries were to power the German company’s EV models that are expected to go into production starting in 2027.

 

BMW said its plans to open the Woodruff plant next year, as planned. It referred any questions about the AESC factory to that company.

Teen arrested in mass shooting plot at a Washington state mall faces multiple charges, DA says

 

An Oregon teen has been arrested in connection with an alleged mass shooting plot targeting the Three Rivers Mall in Kelso, in southwestern Washington, officials said.

 

The suspect, whose identity has not been disclosed due to his age, allegedly planned to detonate a chlorine bomb to create chaos and panic before shooting fleeing patrons exiting a movie theater, the FBI Portland Field Office said in a statement on Thursday. The Columbia County, Oregon, Sheriff’s Office arrested the suspect on May 22, the FBI said.

 

Kelso is approximately 50 miles north of Portland, Oregon.

 

The suspect currently faces charges of attempted murder in the second degree, attempted assault in the first degree, two counts of unlawful use of a weapon, tampering with physical evidence, disorderly conduct and two counts of unlawful possession of firearms, according to the Columbia County district attorney and the charging document.

 

“This plot was as serious as it gets,” FBI Portland Special Agent in Charge Doug Olson said in the statement.

 

“An alarming amount of indicators of a cogent path to violence were met – at no point in this plan did it seem like the suspect wouldn’t follow through with their plans,” the statement said.

 

The suspect will be held in custody until a June 20 hearing, Columbia County District Attorney Joshua Pond told CNN Friday evening. “The hope is that certain plans can be developed and put in place to ensure his safety and well-being, as well as that of the community,” said Pond.

 

The plot was reported as a tip to the FBI on May 19 and the suspect was identified the following day. According to authorities, the juvenile, a resident of Columbia County, subscribed to a “nihilistic violent extremist ideology” and shared his plans in online chats.

 

Guy Edward Bartkus, the man accused of bombing a Palm Springs fertility clinic last month, also had nihilistic ideations, FBI officials said at the time.

 

According to FBI research of past violent actors, nihilistic ideation refers to a “preoccupation with themes of violence, hopelessness, despair, pessimism, hatred, isolation, loneliness, or an ‘end-of-the-world’ philosophy,” said retired senior FBI profiler Dr. Mary Ellen O’Toole. “Nihilistic ideation is a very pessimistic view of the world.”

 

The teen is 14 years old and had some changes to his schooling “in the last few months,” according to Columbia County District Attorney Joshua Pond and the charging document in the case.

 

Officials placed the suspect under court-authorized surveillance before the arrest, citing evidence of both intent and means to carry out the attack.

 

The FBI said the plan included details on the use of an improvised explosive device, a specific route through the mall, and a sequence of actions culminating in the suspect’s planned suicide at the mall.

 

In a search of the suspect’s home, law enforcement later seized three firearms, multiple boxes of various types of ammunition, four knives, some clothing that the FBI believes “he was intent to wear for the attack,” and five digital devices, Olson said.

 

Authorities are urging the public to report suspicious behavior and encouraging parents “to engage with their children and have an open dialogue about their online activity.”
