THE DIFFERENCE BETWEEN OATH OF OFFICE, OATH OF ENLISTMENT

Marine Corps Base Quantico – Warrant Officer Hugh Thompson willingly disobeyed a commander’s orders and even threatened to open fire on American troops when he saved the lives of at least 10 Vietnamese civilians during the My Lai Massacre. Not only was Thompson never punished for disobeying orders, but he was later awarded the Soldier’s Medal for his courageous actions.

If the orders given that day had been lawful he could have faced court martial or even charges of treason under the Uniform Code of Military Justice.

The My Lai Massacre was not the first or the last time a military force would be misused or corrupted. This type of power abuse is what the UCMJ and Oath of Office were designed to prevent and also what allowed Thompson to do the right thing without punishment.

 

There is an important difference to understand when reading the Officers' Oath of Enlistment compared to the Oath of Office.

• Both officers and enlisted service members swear to support and defend the Constitution of the United States,but in the Oath of Enlistment, service members swear they will “obey the orders of the president of the United States and the orders of the officers appointed over [them], according to regulations and the Uniform Code of Military Justice.”

Officers do not include this in their Oath of Office.

Instead, they swear to support and defend the constitution and “well and faithfully discharge the duties of [their] office.”

Why are the two oaths different and what does it mean that officers do not swear obedience to the president or higher ranking officers?

This concept traces back to the intentions of the Founding Fathers who created our governing system with a separation of powers and series of checks and balances between the three branches.This ensures no single branch or person gains too much power and becomes corrupted.

• By swearing allegiance to a set of ideals and laws, our military is not bound by the orders of a single person, but are dedicated to the defense of the people and their way of life.

Despite disobeying orders and even threatening to open fire on American troops, Thompson’s actions prevented further war crimes and defended the lives of noncombatants in Vietnam.This is the purpose behind the Oath of Office allowing for the disobedience to unlawful orders.

 

The obligation and responsibility to act against unlawful orders is not exclusive to officers. Article 90 of the UCMJ statesthat service members are only obligated to obey lawful orders. This gives authority to small unit leaders and even riflemen to use their judgment to serve honorably and disobey orders when they do not uphold the moral standards of our service. Not only does this act as a safeguard to corruption and abuse of power, but it also develops a sense of responsibility and leadership at all levels of command.

 

If this is the case, however, then why is the distinction made between the two oaths when both enlisted and officers are not obligated to follow unlawful orders according to the UCMJ?

• Officers, especially at higher ranks, have a unique position of authority and influence within the organization that could be taken advantage of for political gain.Swearing loyalty to the Constitution instead of the president or any other person means that officials cannot manipulate officers in order to gain control over the military and become dictators.

• The intent is to ensure our military fights in defense of the people and their way of life instead of being misused for political gain.Article 90 of the UCMJ allows for legal disobedience of unlawful orders for both enlisted and officers.

 

The officer’s oath acts as another safeguard against power corruptionby not swearing obedience to the president or other officials, but rather to the Constitution. As a result of these two, our military is capable of having people like Thompson, who can correct situations where the military is being misused without fear of punishment for their actions.

Giving the individual Marine responsibility for judging orders as right or wrong keeps our service members accountable and helps keeps our honor clean as a professional warfighting organization.

US MILITARY OATH OF ENLISTMENT AND OATHS OF OFFICE 1/2

The wordings of the current oath of enlistment and oath for commissioned officers are as follows:

 

“I, _____, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; andthat I will obey the orders of the President of the United Statesand the orders of the officers appointed over me, according to regulations and the Uniform Code of Military Justice. During the Revolutionary War, the Continental Congress established different oaths for the enlisted men and officers of the Continental Army:

 

Enlisted: The first oath, voted on 14 June 1775 as part of the act creating the Continental Army, read:

 

“I _____ have, this day, voluntarily enlisted myself, as a soldier, in the American continental army, for one year, unless sooner discharged: And I do bind myself to conform, in all instances, to such rules and regulations, as are, or shall be, established for the government of the said Army.”

 

The original wording was effectively replaced by Section 3, Article 1, of the Articles of War approved by Congress on 20 September 1776, which specified that the oath of enlistment read:

 

“I _____ swear (or affirm as the case may be) to be trued to the United States of America, and to serve them honestly and faithfully against all their enemies opposers whatsoever; and to observeand obey the orders of the Continental Congress, and the orders of the Generals and officers set over me by them.”

 

Officers: Continental Congress passed two versions of this oath of office, applied to military and civilian national officers. The first, on 21 October 1776, read:

The first oath under the Constitution was approved by Act of Congress 29 September 1789(Sec. 3, Ch. 25, 1st Congress). It applied to all commissioned officers, noncommissioned officers and privates in the service of the United States. It came in two parts, the first of which read:

 

“I, A.B., do solemnly swear or affirm (as the case may be) that I will support the constitution of the United States.”

 

The second part read:

 

“I, A.B., do solemnly swear or affirm (as the case may be) to bear true allegiance to the United States of America, and to serve them honestly and faithfully, against all their enemies or opposers whatsoever,and to observe and obey the orders of the President of the United States of America, and the orders of the officers appointed over me.”

 

The next sectionof that chapter specified that

 

“the said troops shall be governed by the rules and articles of war, which have been established by the United States in Congress assembled, or by such rules and articles of war as may hereafter by law be established.”

 

Although the enlisted oath remained unchanged until 1950,the officer oath has undergone substantial minor modification since 1789. A change in about 1830 read:

 

“I, _, appointed a ___ in the Army of the United States, do solemnly swear, or affirm, that I will bear true allegiance to the United States of America, and that I will serve them honestly and faithfully against all their enemies or opposers whatsoever, and observe and obey the orders of the President of the United States, and the orders of the officers appointed over me, according to the rules and articles for the government of the Armies of the United States.”

 

Under an act of 2 July 1862 the oath became:

 

“I, A.B., do solemnly swear (or affirm) that I have never borne arms against the United States since I have been a citizen thereof; that I have voluntarily given no aid, countenance, counsel, or encouragement to persons engaged in armed hostility thereto; that I have neither sought nor accepted nor attempted to exercise the functions of any office whatsoever under any authority or pretended authority in hostility to the United States;that I have not yielded voluntary support to any pretended government, authority, power, or constitution within the United States, hostile or inimical thereto. And I do further swear (or affirm) that, to the best of my knowledge and ability, I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter, so help me God.”

 

An act of 13 May 1884 reverted to a simpler formulation:

 

“I, A.B., do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign or domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter. So help me God.”

 

This version remained in effect until the 1959 adoption of the present wording.

"As commander in chief, I have no higher responsibility than to defend our country from threats and invasions, and that is exactly what I am going to do," said President Donald J. Trump during his inauguration address today as the nation's 47th president, alongside Vice President JD Vance.

 

"America will soon be greater, stronger and far more exceptional than ever before," he said. "I return to the presidency confident and optimistic that we are at the start of a thrilling new era of national success. A tide of change is sweeping the country. Sunlight is pouring over the entire world, and America has the chance to seize this opportunity like never before."

 

"We will measure our success not only by the battles we win, but also by the wars that we end, and perhaps most importantly, the wars we never get into," Trump said.

 

"My proudest legacy will be that of a peacemaker and unifier,"he added.

 

The 60th inaugural swearing-in ceremony took place at noon inside the Capitol Rotunda, with Supreme Court Chief Justice John Roberts administering the oath of office to the new president and Supreme Court Justice Brett Kavanaugh swearing in the vice president.

 

In the audience were former Presidents Joe Biden, Barack Obama, George W. Bush and Bill Clinton, former Vice President Kamala Harris, members of Congress, all nine Supreme Court justices and family members of Trump and Vance.

 

Trump thanked Black and Latino voters for helping him get elected and added that on this observance of Martin Luther King Jr.'s birthday, "we will strive together to make his dream a reality. We will make his dream come true."

 

Trump said he'll declare "a national emergency at our southern border," with troops ordered there. Trump also said he'll reinstate service members who were let go because they objected to COVID-19 mandates, and they will receive full back pay.

 

Carrie Underwood performed "America the Beautiful," and Christopher Macchio sang "Oh, America!" and the national anthem during the inaugural ceremony. The U.S. Naval Academy Glee Club sang "The Battle Hymn of the Republic."

 

The theme of this year's ceremonies is "Our Enduring Democracy: A Constitutional Promise."

 

In addition to the swearing-in ceremony and the inaugural luncheon at the Capitol, the president and vice president are scheduled to review the military parade, which will take place inside Capital One Arena due to frigid weather.

Iran accuses Israel of trying to spoil nuclear deal with US

Nobody can deny Tehran the right to have a peaceful nuclear program, according to Foreign Minister Abbas Araghchi

 

Israel is trying to prevent Tehran from reaching a nuclear deal with the US, Iranian Foreign Minister Abbas Araghchi said in his first press conference since the escalation between the Islamic Republic and the Jewish state on Friday.

 

The sixth round of talks between Washington and Tehran,which had been scheduled to take place in Oman on June 15, was canceled after Israel launched airstrikesagainst Iran on Friday in what the Islamic Republic has called a declaration of war.

 

Iran responded by launching multiple volleys of ballistic missiles at targets in Israel, including the country’s largest city, Tel Aviv.

 

The countries continued to exchange strikes overnight and during the day on Sunday, with Israel attacking Iran’s energy infrastructure and what it called sites “related to the Iranian regime’s nuclear weapons project.” Tehran fired more missiles at targets in Israel, including near Haifa and Tel Aviv; at least 10 people were reportedly killed and around 200 wounded in those attacks.

 

In his comments on Saturday, Araghchi reiterated that the Iranian authorities maintain a “firm conviction not to possess a nuclear weapon.”

 

However, he noted that“those who are willing to deprive Iran of our right to possess the nuclear program for peaceful purposes, they have no right to do so.”

 

“This is a crystal-clear matter. The Zionist entity [Israel] is not willing to see us reaching an agreement or a diplomatic solution with the US,”the minister said.

 

According to Araghchi,a breakthrough could have well happened during the canceled talks between Tehran and Washington.

 

“The previous round of talks, the Americans presented a number of proposals, which were not totally acceptable to us. We presented our response and our viewpoints,and we were supposed to present a counter-proposal. Our proposal could have opened doors for an all-out agreement with the Americans,” he claimed.

 

Earlier on Sunday, US President Donald Trump insisted that Washington“had nothing to do”with the attack on the Islamic Republic and urged Tehran to return to diplomacy, saying that “we can easily get a deal done between Iran and Israel, and end this bloody conflict.”

 

The Iranian foreign minister said thatTehran does not believe the US claimsthat it wasn’t involved in the Israeli aggression. “We have evidence to the contrary,” he stressed. (The problem here is Tehran lies all the time, and has done this during negotiations.)

 

(These are the same tactics they’ve used through the negotiations, it’s hard to believe Tehran and definitively Israel. I suspect BiBi will have serious opposition in Israel. What is the U.S. supposed to do when Israel, is always trying to drag the U.S. in their self created wars. Bibi did intentionally destroyed the negotiations with Iran.)

Ukrainian drone attack deep inside Russia kills one – governor

Ukrainian drone attack in the Republic of Tatarstan in central Russia has resulted in one fatality and multiple injuries, according to the head of the region, Rustam Minnikhanov.

 

“During the interception of the UAV, debris struck a checkpoint building at an automotive plantin the Yelabuga district, killing a worker. Thirteen people were injured in total, with one in critical condition,” Minnikhanov stated in a Telegram post on Sunday.

 

The crash triggered a fire at the scene, which was quickly extinguished.

 

In recent months,Ukrainian forces have intensified drone strikes, targeting both border regions and deeper within Russia. National air defense systems routinely intercept dozens or even hundreds of hostile drones per day, although falling debris continues to pose risks to civilians and infrastructure.

 

Ukraine has intensified its drone raids since mid-May, when a meeting of negotiators from the two countries took place in Istanbul, marking the first direct talks between Kiev and Moscow since 2022. The attacks peaked during the final week of May, when 2,300 UAVs were shot down, according to the Russian MOD.

 

(Russia seems to always have very few deaths through all the Ukraine strikes. It’s hard to believe.)

Shooting at anti-Trump rally leaves man critically injured(VIDEOS)

The incident occurred during the ‘No Kings’ demonstration in Salt Lake City

 

One person was critically injured after a gunman opened fire during a protest marchagainst the policies of US President Donald Trump in Salt Lake City, Utah, on Saturday evening. Police said a person of interest has been detained at the scene.

 

According to the Salt Lake City Tribune, the incident occurred on State Street, directly outside the Liberty Sky apartment building. Videos from the event show protesters running in panic after gunshots were fired.

 

A victim has been hospitalized with life-threatening injuries, according to police.

 

“We have a person of interest in custody,” the Salt Lake City Police Department said in a statement. Photos and videos circulating on social media appear to show officers pinning down a man dressed in black and handcuffing him.

 

The ‘No Kings’ marches took place in cities across the US, protesting Trump’s crackdown on illegal immigration and the deployment of the National Guard and active-duty Marines during unrest in Los Angeles sparked by immigration raids. The demonstrations coincided with celebrations of the 250th anniversary of the establishment of the US Army, as well as Trump’s 79th birthday.

 

Earlier on Saturday, police arrested a man in Virginia for recklessly driving his SUV through a crowd of protesters, striking at least one person.
