A Supreme Court justice is using her opinion to scold Justice Ketanji Brown Jackson for the second time in two weeks. This time it is because she doesn’t know the basics.

 

Progressive Justice Sonia Sotomayor explained that the Court can’t declare an order of President Trump’s to be unconstitutional if the order does not actually exist.

 

Sotomayor told Justice Ketanji Jackson that she agrees with her that President Trump can’t restructure federal agencies in a way that is inconsistent with constitutional mandates. However, that question is not before the Court.

 

The President ordered agencies to plan reorganizations and reductions in force consistent with applicable law. Those plans are not before the Court.

 

Ketanji is a DEI hire who is way in over her head. She should resign.

Judge Xinis Okays Abrego Lawsuit Against the US Government

 

U.S. District Judge Paula Xinis, an Obama appointee, denied the Justice Department’s motions to dismiss Kilmar Abrego Garcia’s lawsuit over his deportation to El Salvador, calling one of the government’s motions “meritless.”

 

The basis of the lawsuit is that the deportation was a mistake which the DoJ admitted.

 

Xinis did not immediately rule on Abrego Garcia’s motion to be moved to federal custody in Maryland, pending his criminal trial in Tennessee on human trafficking charges.

 

She also ordered his return.

 

Attorney General Pam Bondi possibly didn’t have to bring Abrego back. There are rumors in the media that Secretary Noem was opposed to his return.

 

Now he’s in line for a big payout from the US taxpayers.

 

Xinis thinks she is so important that the administration had to notify her of their every move in wife-beater, accused MS-13 employee, Abrego’s case.

 

Xinis said she found it “highly problematic” that there had been a plan by the government to investigate Abrego Garcia and bring him back for prosecution without informing her court that it was doing so. “We knew it was coming because eventually it was unsealed,” she said. Abrego Garcia’s attorneys told Xinis they found out about his return to the U.S. from news reports.

 

Two courts previously found that Abrego was a member of MS-13.

Vance on Mamdani: ‘Who the Hell Does He Think He Is?’

 

Vice President JD Vance roasted New York City mayoral candidate Zohran Mamdani for trashing the United States on Independence Day, asking, “Who the hell does he think that he is?”

 

Mamdani, the Ugandan-born Democrat nominee to lead the nation’s most populous city, said the U.S. is “beautiful,” yet “contradictory” and “unfinished” in his one post on the July 4 holiday:

 

He concluded his message with “No Kings in America,” a reference to the leftist “No Kings” protests that took place across the country in June.

 

Speaking at the Claremont Institute’s Statesmanship Award dinner in Rancho Santa Fe, California, on Saturday, Vance called out Mamdani’s hypocrisy coming from an immigrant family who fled to the U.S. for a better life:

 

“Today is July 5, 2025, which means, as all of you know, that yesterday we celebrated the 249th anniversary of the birth of our nation,” the vice president told attendees. “You know, the person who wishes to lead our largest city had, according to multiple media reports, never once publicly mentioned America’s Independence Day in earnest, but when he did so this year, this is what he said — and this is an actual quote.”

 

Mamdani’s exact words were, “America is beautiful, contradictory, unfinished. I am proud of our country even as we constantly strive to make it better, to protect and deepen our democracy, to fulfill its promise for each and every person who calls it home. Happy Independence Day. No Kings in America.”

 

After reading Mamdani’s post, Vance said, “There is no gratitude in those words, no sense of owing something to this land and the people who turned its wilderness into the most powerful nation on Earth.”

 

Vance went on to point out the ethnic conflict Mamdani’s family, of Indian heritage, was forced to flee under the former president of Uganda, Idi Amin, to get to freedom in the U.S.:

Has he ever visited the gravesite of a loved one who gave their life to build the kind of society where his family could escape racial theft and racial violence? Has he ever looked in the mirror and recognized that he might not be alive were it not for the generosity of a country he dares to insult on its most sacred day?

A dangerous illegal immigrant is complaining about the living conditions at Florida’s Alligator Alcatraz ICE detention facility, claiming he hasn’t showered in four days, the lights are on 24/7, receives food once a day with worms in it, and the mosquitoes are “the size of elephants.”

The illegal alien, Leamsy Izquierdo, has been at the detention center since Friday after being charged with aggravated assault with a deadly weapon and battery, according to NBC6 South Florida.

Izquierdo also said he isn’t allowed to go outside, and the tents are freezing.

Iran receives Chinese surface-to-air missile batteries after Israel ceasefire deal

The Islamic Republic is trading oil for Chinese air defence missiles as it looks to rebuild capabilities destroyed by Israel, sources say

 

Iran has taken possession of Chinese surface-to-air missile batteries as Tehran rapidly moves to rebuild defensives destroyed by Israel during their recent 12-day conflict, sources have told Middle East Eye.

 

The deliveries of Chinese surface-to-air missile batteries occurred after a de-facto truce was struck between Iran and Israel on 24 June, an Arab official familiar with the intelligence told MEE.

 

Another Arab official, who spoke on the condition of anonymity to discuss the sensitive intelligence, said that the US's Arab allies were aware of Tehran's efforts to "back up and reinforce" its air defences and that the White House had been informed of Iran's progress.

 

The officials did not say how many surface-to-air missiles, or SAMs, Iran had received from China since the end of the fighting. However, one of the Arab officials said that Iran was paying for the SAMs with oil shipments.

 

China is the largest importer of Iranian oil, and the US Energy Information Administration suggested in a report in May that nearly 90 percent of Iran’s crude and condensate exports flow to Beijing.

 

For several years, China has imported record amounts of Iranian oil despite US sanctions, using countries such as Malaysia as a transshipment hub to mask the crude's origin.

 

"The Iranians engage in creative ways of trading," the second Arab official told MEE.

 

Israeli Prime Minister Benjamin Netanyahu and US President Donald Trump are expected to discuss Iran and its nuclear programme when they meet on Monday.

 

MEE reached out to the White House for comment but did not receive a response by the time of publication.

Deepening relationship

 

The shipments mark a deepening of Beijing’s relationship with Tehran and come as some in the West noted that China and Russia appeared to keep a distance from Iran amid Israel's unprecedented attacks.

 

Israel achieved air superiority over Iran's skies during the conflict, destroying ballistic missile launch pads and assassinating Iranian generals and scientists.

 

Despite this, the government endured the strikes. It was also able to continue firing ballistic missiles at Israel, decimating several sensitive sites in Tel Aviv and Haifa before a ceasefire took hold.

 

In the late 1980s, Iran received HY-2 Silkworm cruise missiles from China via North Korea when it was at war with Iraq.

 

The Islamic Republic used the missiles to attack Kuwait and strike a US-flagged oil tanker during the so-called tanker wars. In 2010, there were reports that Iran received HQ9 anti-aircraft missiles from China.

 

Iran is believed to use Russia's S-300, which is capable of engaging aircraft and UAVs in addition to providing some cruise and ballistic missile defence capability, as well as older Chinese systems and locally produced batteries such as the Khordad series and the Bavar-373.

 

These systems are believed to have a limited ability to shoot down the US F-35 stealth warplane that Israel operates.

 

China already sells its HQ-9 and HQ-16 air defence systems to Pakistan. Egypt is also understood to have China’s HQ-9 system, according to reports.

Gunmen Hijack 33 Tons of Gold, Silver Concentrate in Truck on Mexican Highway

 

Authorities in Mexico are remaining tightlipped about how a team of gunmen was able to hijack a truck carrying 33 tons of gold and silver concentrate. The high-stakes robbery comes as Mexico’s government continues to claim that public safety is improving and that the country is safe.

 

The robbery took place on Monday when a tractor-trailer carrying minerals was traveling from the Mexican state of Durango to the Port of Manzanillo in Colima State, where it was expected to be shipped out. However, while the truck was moving through the state of Jalisco, a group of gunmen in at least two vehicles intercepted the truck, overpowered the security detail, and kidnapped the driver.

 

According to information released by Grupo Bacis, the mining company that owned the precious metals, the gunmen held the security detail and driver for almost two hours while they stealing the cargo. After the gunmen released the victims, they made their way to a nearby tollbooth where they asked for help. Mexican authorities were able to find the tractor-trailer soon after, but the cargo was gone. The company has not placed a value on the stolen cargo; however, it is expected to be in the hundreds of millions of dollars.

 

While authorities have not released any information on the case, the dominant criminal organization in Jalisco is Cartel Jalisco New Generation, one of the six cartels designated as foreign terrorist organizations by the U.S. government. In Jalisco, CJNG operates with almost absolute impunity and has historically controlled all major crimes in the region such as extortion and ransom kidnapping in addition to drug and human trafficking.

Supreme Court Tells Judge to Fall in Line

 

In polite but firm judicial language, the Supreme Court made it clear on July 3 that Massachusetts federal district court Judge Brian Murphy wouldn’t get away with dodging the stay the court had issued against him in an important immigration case.

 

According to the court, Murphy is bound by the prior order and cannot “enforce an injunction that our stay rendered unenforceable.”

 

Murphy’s misbehavior comes as no surprise given that he’s one of President Joe Biden’s “Midnight” judges.

 

Sen. Chuck Schumer, D-N.Y., rushed him through the Senate during its lame-duck session after the 2024 election, with Murphy’s nomination barely confirmed on Dec. 2 by a 47-45 vote. Even Sen. Susan Collins of Maine, arguably the most liberal Republican in the Senate, voted against Murphy because he is so radical.

 

The case in question involved a preliminary injunction issued by Murphy preventing the removal of criminal illegal aliens to third-world countries—in this case, South Sudan.

 

On June 23, the Supreme Court granted the U.S. Justice Department’s emergency request for a stay in Department of Homeland Security v. D.V.D. The court’s order, issued over the entirely predictable and banal dissent of Justices Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson, stayed Murphy’s April 18 injunction, “pending the disposition of the appeal in the United States Court of Appeals for the First Circuit and disposition of a petition for a writ of certiorari, if such writ is timely sought.”

 

Even a first-year law student would understand that meant that Murphy could no longer enforce his injunction or take any actions to stop the government from removing deportable illegal aliens to third countries. But apparently not Brian Murphy.

 

As the Justice Department wrote in a motion filed the very next day, Murphy issued an order just hours after the Supreme Court’s order, stating that his related ruling enforcing the injunction “remains in full force and effect … not withstanding todays[sic] stay of the Preliminary Injunction.”

 

The “related ruling” was a second order Murphy issued on May 21 that clarified the April 18 injunction order and remedied what Murphy claimed were supposed “violations” of his April 18 injunction by the government in attempting to remove criminal aliens to South Sudan.

 

Murphy claimed the Supreme Court’s stay applied to his April 18 order but didn’t apply to his May 21 order, and that the government could still not move any aliens to South Sudan.

 

The Justice Department’s motion called Murphy’s action an “unprecedented defiance of this Court’s authority.” This, the government continued, is a “lawless act of defiance that, once again, disrupts sensitive diplomatic relations and slams the brakes on the Executive’s lawful efforts to effectuate third-country removals.”

 

When an appellate court stays an injunction, the DOJ pointed out, the injunction cannot be enforced because the court that issued it has been divested of its judicial authority to enforce that order. But Murphy simply ignored that and told the government it had to comply with his injunction.

 

Murphy’s misconduct was the equivalent of the Wizard of Oz telling Dorothy, “Pay no attention to the man behind the curtain!” In this case, the man behind the curtain was the Supreme Court.

 

In response to the Justice Department’s motion for clarification, the man behind the curtain (the Supreme Court) issued the July 3 order, reiterating that it meant what it had said and that Murphy’s power to enforce his injunction is null and void.

The Justice Department also asked the Supreme Court to consider taking two other actions:

 

Directing Murphy “not to issue further injunctions in this case without first obtaining pre-clearance from this Court” or

“ordering that the case be reassigned to a different judge.”

 

Either action would have been appropriate given Murphy’s misconduct, but the court declined both. But that declination was based on the Supreme Court “‘assuming as we do’ that the District Court will now conform its order to our previous stay and cease enforcing the April 18 injunction through the May 21 remedial order.”

 

Based on that assumption, the court said that “we have no occasion to reach the Government’s other requests for relief.” In other words, the court is assuming that Murphy will now quit defying the Supreme Court.

 

As one would expect, both Sotomayor and Jackson issued a defiant dissent—which the majority dismissed, despite its “provocative language,” since “a claim that a lower court has failed to give effect to an order of this Court is properly addressed here.”

 

Interestingly, Kagan did not join that dissent, even though she had dissented from the court’s original grant of the stay. Instead, she concurred in this “clarification,” stating that while she would have denied the original request for the stay, she could “not see how a district court can compel compliance with an order that this Court has stayed.”

 

One final note on the substantive merits of this case. In issuing his injunction, Murphy misinterpreted the applicable immigration statute, ignoring language specifically giving the government the ability to “disregard” the request of an illegal alien to be returned to his native country when it is “impracticable, inadvisable, or impossible” or when it would be “prejudicial to the United States.”

 

Making that determination remains totally within the discretion of the secretary of the Department of Homeland Security, and there is no provision for it to be second-guessed by a judicial ideologue.

 

And who are the criminal aliens that Sotomayor and her cohorts are so intent on protecting in this case?

 

They’re aliens convicted of homicide, armed robbery, assault, kidnapping, battery, larceny, drug trafficking, and sexual assault, including of children.
