Douglass Mackey, also known as "Ricky Vaughn," was sentenced to seven months in prison in October 2023 for a meme he posted on Twitter (now X) during the 2016 U.S. presidential election. The meme was part of a voter suppression scheme targeting supporters of Hillary Clinton. Specifically, on November 1, 2016, Mackey tweeted an image depicting an African American woman standing in front of an “African Americans for Hillary” sign. The ad falsely claimed that supporters could vote by texting “Hillary” to a specific number (59925), stating: “Avoid the Line. Vote from Home,” and “Vote for Hillary and be a part of history.” The image mimicked official Clinton campaign branding, including the hashtag “#ImWithHer” and fine print that read: “Must be 18 or older to vote. One vote per person. Must be a legal citizen of the United States. Voting by text not available in Guam, Puerto Rico, Alaska or Hawaii. Paid for by Hillary For President 2016.” This was a fraudulent message, as voting by text message is not a valid method in U.S. elections. Prosecutors demonstrated that Mackey conspired with others to disseminate these deceptive messages, which were intended to trick Clinton supporters into not voting at polling stations. At least 4,900 unique phone numbers texted “Hillary” or a derivative to the number provided, indicating the meme’s reach. Mackey was convicted of conspiracy against rights for interfering with voters’ constitutional right to vote.

 

However, on July 9, 2025, the Second Circuit Court of Appeals unanimously overturned Mackey’s conviction, finding that the government failed to provide sufficient evidence that he participated in the specific group messages with co-conspirators planning the scheme.
