Public Servant = Gives up certain rights while on the job in exchange for pay. They are not above the public but below, they are PUBLIC SERVANTS and they answer to the public, and they should identify to the public. There are states where you don't have to ID until after lawfully arrested, however even in states that allow detention and ID based on RAS, it is NOT simply based on "being suspicious, it's "Reasonable Articulable Suspicion you have committed a crime, are committing a crime, or you are about to commit a crime, based on the totality of circumstances.
I'll give you an example, and this has been upheld in court numerous times, cops keep unlawfully demanding ID across the nation.
Lets say a cop sees someone looking into and recording in multiple cars parked on the street. Now, the cop might think "they're going to break into cars" but the cop has no REASONABLE ARTICULABLE SUSPICION based on the totality of circumstances, because they have to make a large "leap" to crime from what the person is doing. Being nosy isn't a crime, and it's perfectly legal to look at and record what's in plain view from public.
Now lets say the cop also sees him try multiple doors or he's carrying opening tools, THEN the totality of circumstances would meet REASONABLE ARTICULABLE SUSPICION OF A CRIME.
We're talking about recording in plain view in public, not someone walking through your yard up to your window and recording inside. Now if they're on public property and your curtains are open, you have no expectation of privacy.
"Suspicious" has nothing to do with it, they need (in the most lax of states) REASONABLE ARTICULABLE SUSPICION OF A CRIME. It doesn't matter how "suspicious" you think they are, they're not violating the law.
It's not illegal to be nosy. It's not illegal for instance for a private eye to take pictures of what people expose to the public. As the US Supreme Court upheld, what you expose to public is public. The onus to create privacy is on YOU.
