I think "building a foundation" is about admissibility of evidence in court. Judge Jeanine and Rudy Giuliani were talking about building a foundation with ref to Cohen tape, Here is a transcript from YT of salient part of convo. Read carefully the lines about "building a foundation" and "admissibility of evidence."

02:30 it to see and we got him on tape putting

02:33 it in the drawer well you know mr.

02:34 president I mean mr. mr. mayor you and I

02:38 both know you're a former prosecutor I'm

02:40 a former prosecutor you've got to lay a

02:42 foundation for the admissibility of any

02:44 tape and what struck me the first time I

02:47 heard the tape and we'll get to how CNN

02:50 got it in a moment was you have to

02:52 number one make sure that it's

02:56 admissible in evidence if it's recorded

02:58 with the permission of one of the

03:00 parties and it was because Michael Cohen

03:03 recorded it it was unethical because

03:05 he's the lawyer but that's another issue

03:07 then we have to lay a proper foundation

03:09 anyone listening to that tape knows that

03:12 all of a sudden it's cut off it's

03:14 garbled at a crucial period of time when

03:17 the president seems to be saying no no

03:19 no I make a check out we don't we don't

03:22 use cash yes and no questions about it

03:25 you and I both know they cannot tamper

03:27 with this but the only way for us to

03:30 read to figure out if this is accurate

03:32 is for you to get the original tape how

03:34 you gonna do that well we've got a whole

03:37 footage this this could be a recording

03:40 of a recording we're not sure yet that

03:42 they can probably determine I mean

03:45 you're right we may never be able to

03:48 determine that but we have determined

03:50 the fact that he tampered with the tape

03:52 in the sense that he abruptly

03:54 mid-conversation

03:56 turned it off now we know he didn't do

03:58 that for a good reason

03:59 because a guy that goes into a reporter

04:02 and hides his tape is things and says

04:05 I'm not taping it and that is taping it

04:07 for two hours it's definitely not

04:09 someone who didn't intend to deceive as

04:11 Lanny Davis falsely said well in

04:13 addition to that is lying but that's

04:15 another issue you and I both know that

04:17 in order for the government to admit

04:19 something into court they've got to show

04:22 its continuing custody and the

04:24 no changes additions or deletions have

04:26 been made if they cannot prove that

04:28 there are no deletions or changes and we

04:31 don't know where it's been

04:33 is could that be the reason that it was

04:35 leaked to CNN and do you have any idea

04:38 how isn't that interesting because last

04:40 week at this time Jay Sekulow and I were

04:43 being accused of leaking it Maggie

04:45 Haberman who got the story to her credit

04:48 made it clear that it didn't come from

04:49 us there's only one other place that

04:51 could come from Cohen and Lanny Davis

04:53 and people wondered well why don't they

04:55 put it out this is harmful to to to

04:59 Cohen I think they put it out because

05:01 they wanted the doctored version obscure

05:04 wherever else might be on that day which

05:06 will be very I'm sure it'll be good for

05:08 us that I think is lost to us it was

05:10 never recorded in the first place

05:12 I was hoping he had possibly erased it

05:14 and we could maybe recover it but it was

05:17 never it was never recorded in the first

05:20 place
