The U.S. Constitution does state that Congress has the authority to determine the punishment for treason. Article III, Section 3 of the Constitution specifies that treason against the United States consists only in levying war against them or adhering to their enemies, giving them aid and comfort. It also states thatCongress shall have the power to declare the punishment for treason.
It will be up to congress to determine what the appropriate consequence shall be.
