Alan Dershowitz Says He Can Help Team Trump Prove WSJ’s Epstein Story Was ‘Malice’

Harold HutchisonJuly 20, 2025 4:44 PM ET

Noted attorney Alan Dershowitz said Sunday he could be called as a witness in President Donald Trump’s suit against The Wall Street Journal, arguing that he could help “prove malice” in the case.

Trump announced he’d filed suit against the WSJ and its owner, Rupert Murdoch, Friday over an article that claimed he sent disgraced financier Jeffrey Epstein a bawdy letter celebrating his birthday. Dershowitz told “Sunday Agenda” host Lidia Curanaj he also was contacted by the WSJ over a letter he reportedly sent, which the outlet couldn’t produce.

“I’ll probably be called as a witness in the case, because they also called me, and they said that you wrote him a letter with a mock cover of Vanity Fair,” Dershowitz told Curanaj. “And I said, ‘I may have, I don’t remember, this was 23 years ago. Just send me a copy of the letter with my signature and I’ll tell you whether it’s authentic or not,’ and they said they couldn’t do it.”

“And so they published the story without authenticating it with me, and that will be an important point in trying to prove malice, so I suspect I will be a witness if this case ever goes to trial,” Dershowitz continued.

WATCH:

Trump secured a $15 million settlement with ABC in December 2024 after he sued the outlet March 19, 2024, for defamation over comments made by “This Week” host George Stephanopoulos during a contentious March 10 appearance by Republican Rep. Nancy Mace of South Carolina. CBS settled a $10 billion lawsuit filed by Trump over the editing of an October 2024 interview with then-Vice President Kamala Harris, who was Trump’s opponent in the 2024 presidential election, drawing criticism from inside the company.

Some of President Donald Trump’s supporters have criticized him and Attorney General Pam Bondi over the handling of the Epstein files, with the president being “ratioed” on Truth Social over the matter, Newsweek reported. Trump fired back at the critics in a Wednesday post on Truth Social and also defended Bondi in a lengthy statement posted July 12 on the site.

Trump announced in a Thursday night Truth Social post he was asking Bondi to seek permission from the courts to release the grand jury transcripts from the Epstein case. Bondi said in a response posted on X that DOJ would move to unseal the documents Friday.

House committee could grant Biden witnesses immunity to get them to talk

July 20, 2026

As key witnesses in the investigation into former President Joe Biden’s mental decline continue to evade House questioning by invoking their Fifth Amendment rights against self-incrimination, lawmakers could grant them immunity to encourage them to talk, according to a legal expert.

Three witnesses close to the former president pleaded the fifth during depositions before the House Committee on Oversight and Government Reform in less than two weeks, with more likely to come.

Committee chairman Rep. James Comer, R-Ky., said the witnesses, Annie Tomasini, who served as an assistant to the former president and deputy director of Oval Office Operations, former First Lady Jill Biden’s chief of staff, Anthony Bernal, and Dr. Kevin O’Connor, Biden’s physician, have pleaded the Fifth in “a pattern…seeking to shield themselves from criminal liability.”

Attorney and legal scholar John Shu notes that the committee could grant certain congressional witnesses immunity, a common tactic that would require them to testify because they no longer could self-incriminate and be subject to prosecution.

“Both the DOJ and Congress have been known to grant immunity. It would prevent witnesses from asserting the Fifth Amendment, because once you have immunity you can’t be prosecuted,” Shu said.

None of the witnesses, including those who have yet to appear, have been charged with any crime. However, echoing Comer’s assertion that the witnesses may be shielding themselves from criminal liability, Shu argues they could be pleading the fifth to avoid self-incrimination.

“Those witnesses will still want to avoid any kind of self-incrimination, even if they themselves didn’t commit a crime, because they may have been part of a conspiracy to commit a crime or they may have lied in some other setting. While we don’t know whether there was a criminal conspiracy, certainly a witness wouldn’t want to talk about his or her participation in it,” said Shu.

Biden opened the door for Congress to subpoena White House officials and aides. The former president waived executive privilege for Peter Navarro and Steve Bannon, who served during Trump’s first administration.

A House Select Committee investigating the Jan. 6, 2021, Capitol riots subpoenaed Navarro and Bannon. The pair refused to comply with the subpoenas and were subsequently imprisoned for Congressional contempt.

Shu noted, “What goes around, comes around…Executive privilege goes with the office, not the president” – meaning when Trump took office in January, he inherited the right to waive the same privilege for Biden officials, leading to the former president’s aides being subpoenaed.

“Annie Tomasini and Anthony Bernal know that, and that’s partially why they didn’t assert executive privilege and instead pled the fifth, because Trump waived their privilege,” said Shu.

Questions regarding Biden’s mental fitness were raised well before the 2020 presidential election. Republicans and many in the conservative media continued to raise questions regarding the former president’s health throughout his presidency.

However, the White House claimed Biden received regular medical exams, showing a healthy, competent president.

The House committee announced in early June that it was expanding its investigation into the “cover-up” of Biden’s “mental decline.”

Comer sent letters to five former senior Biden White House aides, “demanding they appear for transcribed interviews.” Comer’s committee is investigating “potentially unauthorized issuance of sweeping pardons and other executive action.”

VDH: Gavin Newsom Abandons Californians for 2028 White House Delusions

California Gov. Gavin Newsom seems to be more interested in podcasting, siding with protesters, and pointing fingers at the Trump administration than actually fixing the problems in his state.

Newsom’s record long record of failure is evident in the was California is spiraling out of control: a crumbling infrastructure, surging poverty, and broken immigration enforcement.

Victor Davis Hanson has a message for Gavin Newsom on why his priorities are not only out of touch—but dangerous—on today’s episode of “Victor Davis Hanson: In His Own Words.”

“He’s now inserted himself into the ICE deportations crisis in California and siding with the protesters that are trying to obstruct ICE. And he has a very incoherent position. … I guess the supposition is that Gavin thought it was quite moral for 12 million people to break the law, but it’s quite amoral for somebody to try to rectify the situation and enforce the law.

“ You look at a state that is in complete free fall, it is a catastrophe, and rather than addressing transportation, energy, poverty, housing, gasoline, what are you doing? You’re campaigning for president. And you’re in Twitter wars with the president of the United States. And you’re defending the catastrophic governance in Los Angeles. And you’re trying to impede the enforcement of a law that if it was enforced, you would be the biggest beneficiary.”

VDH: Elite Universities Final Cave to Trump

Elite universities know they’re in the wrong. For years, they’ve been:

Charging upwards of 60% for “overhead” costs for federal research grants.

Blatantly violating the U.S. Supreme Court’s 2023 Civil Rights ruling barring race-based admissions and hiring practices.

Allowing rampant antisemitism on campus.

Reliant on international students from illiberal regimes.

Facing both mounting pressure from the Trump administration to change their ways, and vocal opposition from their Marxist students and faculty to remain the same, university presidents are starting to fold:

So, how do these presidents do it? They're afraid of their students. They're afraid of their Marxist faculty. So what they're doing is, essentially, they're talking to the Trump administration. And they're going to go right back and they're going to say, ‘You know, I did not want to do this. I really did not want to cut a deal. I want to keep going with DEI. I think we have a right to. But I can't. Donald Trump's a tough customer. If I don't cut a deal with him, we're gonna go broke. We'll get no federal funds. We'll get no federal grants. We'll get an even bigger tax on our endowment. So I've got to cut a deal. He made me do it.’

July 18, 2025

It’s been a surreal few weeks, from the Epstein files disappearing, to President Trump’s F-bomb over the situation in the Middle East - and even Elmo’s X account getting hacked to spew antisemitic filth.

So, what should Trump’s next steps be? Should the Epstein files be released? And what about the ongoing conflicts with Russia and the Middle East?

Joining Piers Morgan to make sense of it all is author and host of No Spin News Bill O’Reilly and Harvard mathematician and founding member of the so-called ‘intellectual dark web’ , Dr Eric Weinstein.
