BIRMINGHAM, Ala. (WBRC) - Following the tragic case involving a 3-year-old boy who died after being left in a hot car while in DHR custody, WBRC spoke to a legal expert on what charges are possible.
Officials say ‘Ke’Torrius Starkes, Jr “KJ”, of Bessemer, was left in that vehicle for around five hours in Birmingham while in the care of a contracted worker on Tuesday.
Sometimes cases like this never make it before a judge, but attorney Darius Crayton says this one is unique.
“These are tough cases, and honestly I do not envy the prosecutors that have to make the decision where or not to bring charges here,” Crayton shared.
The attorney with Farris, Riley & Pitt also has experience working inside the Jefferson County District Attorney’s Office.
He tells WBRC hot car deaths are not typically prosecuted because many happen after a parent accidentally got distracted.
However, other circumstances might result in charges.
“If it’s a case where a parent goes to a drug house or something and they go inside and start using or purchasing or something along those lines where they’re doing something illegal and then they come out and the child has passed away in a hot car, then that case will be prosecuted,” he said. “They were participating in some sort of illegal activity.”
The attorney says there is no official charge for a hot car death in Alabama. They fall under child abuse or child neglect depending on the circumstances.
In the devastating case of ‘KJ’, the boy was in the care of Covenant Services, a third-party contracted worker for DHR.
Crayton says this makes this case even more complex because it brings the state into the mix.
“If the child is in the state’s custody and that’s when the death takes place, you could certainly be looking at a civil fine, a civil claim to be brought against the state,” Crayton shared.
In cases that are prosecuted, the attorney says the people held responsible for the child’s death could face up to a year in jail at the very least.
