DCFS denies lawmaker's claims agency illegally used interns to investigate, remove kids

 

Illinois (KHQA) โ€” Illinois State Representative Jed Davis (R-75) is accusing DCFS of allowing unqualified interns to investigate and separate families โ€“ but DCFS says that Davis has "the law and facts wrong."

 

Representative Davis has both the law and facts wrong. Every DCFS employee who is conducting child and abuse investigations is qualified and certified to do so. DCFS attempted multiple times to explain this to the Representative and his associates, including in a face-to-face meeting scheduled prior to the press release, which Representative Davis cancelled," DCFS said in a statement to KHQA on Tuesday.

Illinois State Representative Jed Davis accuses DCFS of "moral failure & legal disaster"

State Representative Jed Davis (R-75) issued a press release on Monday, demanding immediate and sweeping action and accountability after uncovering a systemic failure inside the Illinois Department of Children and Family Services. He claims DCFS interns are uncertified and unqualified under Illinois law, but says they've been allowed to investigate families, leading to the removal of children from their homes.

 

"This collapse of lawful procedure isnโ€™t a clerical error โ€” itโ€™s a moral failure and legal disaster," said Rep. Davis. "DCFS is conducting formal child abuse investigations with uncertified interns, despite laws requiring certification before an investigator touches a case. Families are paying the price."

 

Davis says Illinois statute leaves no room for differing interpretation. He says the Child Protective Investigator and Child Welfare Specialist Certification Act of 1987 (225 ILCS 420/), along with (20 ILCS 505/21(d)), requires certification before employment in any official investigative capacity.

 

Davis argues these safeguards exist to protect children, preserve family rights, and ensure only trained, legally certified professionals handle life-altering decisions.

 

"DCFS does not have the power to rewrite law for convenience," Davis said. "For years, the agency has allowed uncertified interns to conduct and carry out abuse and neglect investigations, file legal findings, and initiate family separations. This disregard for the law is both dangerous and unacceptable."

Davis says internal records and past agency statements confirm the certification requirement. In a 2009 federal review, DCFS acknowledged the mandate for all child protective investigators to be certified before employment begins. Davis says the law remains unchanged โ€” only DCFSโ€™s decision to ignore it has shifted.

Danielle Spencer, Dee From Whatโ€™s Happening!!, Dead at 60

 

Danielle Spencer, the actress who played Rajโ€™s sarcastic little sister Deadra โ€œDeeโ€ Thomas on Whatโ€™s Happening!!, died Monday. She was 60 years old.

 

The news was posted by her former Whatโ€™s Happening!! co-star Haywood Nelson on Instagram Tuesday.

 

โ€œDr. Dee, our brilliant, loving, positive, pragmatic warrior, without fail, has finally found her release from the clutches of this world and a body,โ€ he wrote. โ€œWe celebrate Danielle Spencer and her contributions as we regret to inform her departure and transition from a long battle with cancer.

 

โ€œWe have lost a daughter, sister, family member, Whatโ€™s Happening cast member, veterinarian animal rights proponent and healer, and cancer heroine. Our Shero. Danielle is loved. She will be missed in this form and forever embraced.โ€

 

Spencer played Dee, the precocious and meddling younger sister on Whatโ€™s Happening!!, for three seasons beginning in 1976. Loosely based on the 1975 film Cooley High, the series started out as a summer replacement on ABC. After it ended, a spinoff of the show titled Whatโ€™s Happening Now!! was ordered, running from 1985 to 1988. Spencer reprised her role, recurring as a college-aged Dee for 16 episodes.

 

In 1996, she pivoted from acting and became a veterinarian, and though she considered herself to be semi-retired from the business, she still occasionally acted. Her other TV credits include The Brady Bunch Hour and Days of Our Lives. She also played a vet in the 1997 James L. Brooks movie As Good As It Gets.

Andrew Do, ex-OC official, ordered to pay $878K in COVID bribery scheme

 

SANTA ANA, Calif. - A federal judge in Santa Ana Monday ruled that former Orange County Supervisor Andrew Do owes the government $878,230.80 for his conviction in a bribery scheme.

 

Federal prosecutors and defense attorneys agreed in court papers filed last month that Do should have to pay between $800,000 to just over $878,000 in restitution for his bribery scheme. County officials filed a motion seeking $10.2 million, the full amount of money granted to the nonprofit accused in the scheme.

 

Do, who was sentenced to five years in federal prison in June and is expected to begin serving his term Friday, faced a restitution hearing Monday before U.S. District Judge James Selna, to determine how much the defendant owed the government. Do did not appear at the hearing as there was an agreement beforehand that he could skip it, but Selna delayed a ruling on the hearing so his attorneys could put it in writing.

 

Federal prosecutors argued that Do should repay $868,612 for the money he and his family took in the scheme, plus $9,618.80 in legal fees for the county.

 

Do's attorneys argued their client should repay at most $802,692, receiving credit for some of the work Do's daughter, Rhiannon, did for the Viet America Society, the recipient of the bribes.

 

Kevin Dunn, an attorney representing the county, argued that Do should have foreseen that the contracts for which he got kickbacks would not be executed legally. Dunn said Do, a former state prosecutor and public defender as well as an elected leader, should have understood that the federal grant money would not be spent on its intended purpose.

 

But Selna said it was "significant to me" that Do only pled to conspiracy, which would limit his liability in the scheme.
