That is literally deprivation of rights under color of law though. Burning the flag for political speech is constitutionally protected, using any other law to deprive or intimidate people out of doing it is the very definition of deprivation of rights under color of law and conspiracy against rights.
It's the same as when cops sit there and try to figure out what they can charge someone with who flipped them off, usually disorderly conduct or improper hand display. EVERY SINGLE TIME they do that, they are violating rights, constitution, and federal law.

Let me give you an example. I can walk up to you and tell you to stop talking or you're going to jail. It's free speech and not a true threat. If a cop says that, it's a threat under color of law, and a federal crime.
